In 2019, Shamila Batohi returned from The Hague to lead our National Prosecuting Authority (NPA). During the Zuma presidency, the once-proud NPA had been hollowed out by state capture; Batohi was a welcome appointment who promised to restore the organisation and ensure speedy convictions of state capture perpetrators. The same year, former prosecutor Hermione Cronje returned to head up the NPA's sharp end: the Investigating Directorate (ID) which would investigate, arrest and prosecute state capture and complex financial crimes. Batohi and Cronje: two powerful women with the same aim. But within two years, Cronje left for a second time. Since then, the NPA has made several high-profile arrests, but the progress on state capture cases is dismal, and crucial ones have been struck from the roll. Is the NPA still in crisis, despite angry denials from current leadership? Carte Blanche, in association with amaBhungane, looks at what has gone wrong at the National Prosecuting Authority.

I still have enormous respect for the NPA, and the many competently individuals who spend their lives working to protect this county. I even have respect for Batoi for coming to the interview. BUT it is clear, that the NPA is failing to bring these criminals to book. They need resources, they need support, and they need to stop making excuses.

Shamila Batoh says it’s up to us to decide what we think of the NPA and how well they are doing. So, if we say you aren’t doing enough by not even having an extradition docket ready when a country part of Brics has a fugitive in custody, then what? If you lack the resources to prosecute high profile cases at least say so publicly. RSA have a history of undermining the judicial system but why be part of it, and not saying anything, Carte Balance must ask and then we hear what is going on from the horse’s mouth. It just seems like all those before her was just there for the salary.

It is so plainly obvious that Shamila Batohi is not the right preson to head the NPA. She is not a closer, she is in over her head. Her arrogance and defensiveness in these interviews only points to the fact that she is not fit for purpose.
At first I thought the NPA was useless - th3n I realised they are useful in their uselessness. Useful to those who want to create a facade of due process but actually aim to curtail judicial processes. It's a shame.

We (several people and I) were not matriculated and gifted with degrees,but we were shown the door politely when the "new" regime took over. We were replaced by youngsters like this woman and watched blunder after blunder in horror. I remember how we begged our old C.O. for a chance to come back,but even he and the others were frustrated and retired too. 😢

To be fair, were the recordings of internal meetings legally obtained? How many convictions did Cronje obtain in her time? Valid criticisms for Nulane and Koko. Guptas not so much. UAE is the source of the problem. Not everything is NPA fault: state capture findings is not admissible evidence in court. Investigations and work needs be done to get the matters to the stage of court readiness. That takes time and access to the Zondo database which the NPA does not have. There is extreme pressure to enroll state capture matters whilst at the same time criticizing matters still under investigation . In these circumstances, it's little wonder that prosecutors go to court half-corked! Let's not malign the entire NPA for there are actually prosecutors that are doing excellent work amidst many challenges!

I think we should just let the people who committed state capture go, it's apparent that the people who are tasked to bringing these people to justice are not up to stask.😊😊 So now it's a matter of collecting as much salary as possible while pretending to be doing something meaningful.
