His insurance company isn't suing him, did you not even listen? The victim his bodyguard punched is the one suing Jack. The only reason his insurance company is involved is to respond to the judge and inform the court that they are not responsible for covering the incident as his insurance would have been required to provide him with a lawyer if this had happened as his home.
As a claims rep who has done these suits, Atozy is half right/wrong because, what the insurer did is file a motion to the court saying they do not owe coverage because their policy doesn’t owe for X. Most civil litigation has some insurance company involved due to the fact that nearly all policies contain a liability side where a insured can seek indemnity/defense for any accident they are involved. Looks like the insurer did their review and found no coverage (most likely due to the fact that dude operates a business with his social media and a renters policy had no coverage to business related incidents) That being said. He is 100 screwed because, likely dude doesn’t have a pot to piss in reality and cost alone to defend will be approx 300k-400k which doesn’t include trial. Not to mention he would be hated by any jury and is probably facing punitive damages which is something you can’t fucking escape on.

I tell them I am filing and opening a SIU fraud case for the state and carrier to officially open a fraud investigation as of this moment, here is your directives and duties under law (hand him paper). Pretty much this and I’ll add a bit of extra as well since I’ve work claims like these as a insurance rep Every renters/homeowners/commercial policy has a Liability Coverage section that deals with accidents that insureds are involved with as long the claims meet the definitions of bodily injury or property damage. Jack tendered a claim to his carrier for two reasons which is normal for anyone with a policy 1. Indemnity - Insurer will pay for covered claims to a 3rd party if the insurer is legally liable 2. Defense - Insurer obligations to provide defense counsel at the insurers expense to defend him What happened here is he got hit with a denial for both indemnity and defense since its most likely denied due the fact that the assault was in the commission of his business which is self evident as he runs a social media business. Most policies have a hard stop that will differentiate between a business vs in house caretaker and etc. As to willful it’s questionable since it’s the decision to not covered it under as intentional is state dependent of where the policy resides in and as well what the insured says. They most likely reserved intentional acts but are mainly denying on the business exclusion since it’s the most black/white exclusion in any policy

Licensed adjuster here. Renter’s Insurance plans typically offer liability coverage that can assist the insured if they’re being accused and sued for negligence, whether an incident took place on the insured’s property or not. It may help pay for another person’s medical bills if the insured is found to be liable. The catch is the damage must be unintentional or accidental. If it is found that damages or injury were intentional (as in this video), the insurance company has the right to opt out of representing the insured per policy guidelines. This same liability coverage is also offered under homeowners insurance plans as well….Sorry this response is so long 😅

Work in insurance here. Renters insurance often includes a coverage called personal liability. This coverage is a set cost to both defend and pay out on your behalf for damages covered that you are held liable for. Renters insurance does extend to protect you anywhere in the US (eg. say you’re at a friends house and accidentally serve them food they are allergic to and they sue you for medical bills). The problem comes from 1. It’s personal liability, not business liability. 2. It’s a policy exclusion, aka the wording of the policy specifically excludes coverage for an incident such as this. TLDR: Jacks attempted use of renters insurance is only about 80% as dumb as it seems.
I hope that some day laws are put in order to make platforms legally accountable for the content they are housing. Right now they shift almost all responsibility on the creators, while they are the one's enabling this kind of behavior.

If Jack hadn't filed a claim, it's likely that the plaintiff would have sought to have State Farm joined to the lawsuit anyway, because you want as many deep pockets attached as possible when suing someone. But, as SF points out, liability insurance is for things like *negligence*, not intentional or willful acts. Kane acted willfully and unreasonably, so there should be no coverage for Jack under this policy. If he has other liability like an umbrella policy, they'll probably also get dismissed. 50 states have 50 different rules, but AFAIK no US state allows indemnification against willful acts. You don't want people thinking they can cause harm intentionally with impunity. The upshot is that I'm not surprised they filed the claim and got SF pulled into the suit. But they'll file a motion to be removed from the suit and will most likely win that motion.

Not as hilarious as you think. Mine covers me if I get sued for accidentally injuring someone somewhere else and also if I am sued for defaming someone. Insurance policies have all sorts of riders and additional coverage you can buy. Even the fact that this was an intentional act to cause harm isn't a slam dunk for the insurance company because it wasn't Jack who intentionally caused the harm. Jack was just negligent and created a scenario where the victim was harmed, which is actually something that the policy would cover in many circumstances.
Hello insurance producer here. Renters insurance comes with liability insurance for bodily injury lawsuits no matter where they are. This is to cover accidental situations unlike that one. In example if you bump into an old lady she falls and breaks her hip and sues you then the liability insurance will cover that. Since he hired the guy it should’ve been under a business liability policy or a commercial umbrella policy.
This guy needed to be corrected by his parents when he was a kid. And now he is trying to make it everyone else's problem that they were failures as parents. If you're kid is looking up private address of random people you have an obligation to stop them and correct that behavior.

Every renters/homeowners/commercial policy has a Liability Coverage section that deals with accidents that insureds are involved with as long the claims meet the definitions of bodily injury or property damage.
Jack tendered a claim to his carrier for two reasons which is normal for anyone with a policy
1. Indemnity - Insurer will pay for covered claims to a 3rd party if the insurer is legally liable
2. Defense - Insurer obligations to provide defense counsel at the insurers expense to defend him
What happened here is he got hit with a denial for both indemnity and defense since its most likely denied due the fact that the assault was in the commission of his business which is self evident as he runs a social media business. Most policies have a hard stop that will differentiate between a business vs in house caretaker and etc.
As to willful it’s questionable since it’s the decision to not covered it under as intentional is state dependent of where the policy resides in and as well what the insured says. They most likely reserved intentional acts but are mainly denying on the business exclusion since it’s the most black/white exclusion in any policy

If it is found that damages or injury were intentional (as in this video), the insurance company has the right to opt out of representing the insured per policy guidelines. This same liability coverage is also offered under homeowners insurance plans as well….Sorry this response is so long 😅

Work in insurance here. Renters insurance often includes a coverage called personal liability. This coverage is a set cost to both defend and pay out on your behalf for damages covered that you are held liable for. Renters insurance does extend to protect you anywhere in the US (eg. say you’re at a friends house and accidentally serve them food they are allergic to and they sue you for medical bills). The problem comes from 1. It’s personal liability, not business liability. 2. It’s a policy exclusion, aka the wording of the policy specifically excludes coverage for an incident such as this.
TLDR: Jacks attempted use of renters insurance is only about 80% as dumb as it seems.

Renter's insurance often includes general personal liability like homeowner's insurance does. If Jack hadn't filed a claim, it's likely that the plaintiff would have sought to have State Farm joined to the lawsuit anyway, because you want as many deep pockets attached as possible when suing someone.
But, as SF points out, liability insurance is for things like *negligence*, not intentional or willful acts. Kane acted willfully and unreasonably, so there should be no coverage for Jack under this policy. If he has other liability like an umbrella policy, they'll probably also get dismissed.
50 states have 50 different rules, but AFAIK no US state allows indemnification against willful acts. You don't want people thinking they can cause harm intentionally with impunity.
The upshot is that I'm not surprised they filed the claim and got SF pulled into the suit. But they'll file a motion to be removed from the suit and will most likely win that motion.

Even the fact that this was an intentional act to cause harm isn't a slam dunk for the insurance company because it wasn't Jack who intentionally caused the harm. Hello insurance producer here. Renters insurance comes with liability insurance for bodily injury lawsuits no matter where they are. This is to cover accidental situations unlike that one. In example if you bump into an old lady she falls and breaks her hip and sues you then the liability insurance will cover that. Since he hired the guy it should’ve been under a business liability policy or a commercial umbrella policy.

This guy needed to be corrected by his parents when he was a kid. And now he is trying to make it everyone else's problem that they were failures as parents. If you're kid is looking up private address of random people you have an obligation to stop them and correct that behavior.
His mom not only didn't stop him, but drove him to the house.
Yeah, he got set up for failure early on, but now he is old enough to know better.
