    Mam SECRETARY is not bothered to give replies to letters and also co.op.Hsg. so.Registar instruction given to proper replays to give the member then also no action.
    What is to be done.
    We all members are above 75 years old.

    If the flat is below the common terrace of the society bldg, and there is machinery of communication installed on the common terrace, that is causing leakage and the flat below is continuously facing leakage issue for many years, what can be done in such a case. The society managing committee is not responding to the issue and only doing eye wash repairs, can the committee be held responsible for any damages to the flat and his her life of family members who are living in it?

      External Leakages are the responsibility of society. In case the committee is not resolving the issue, you may do Complaint to the Registrar office. Evidences should be attached for this.

      Monthly minutes to be signed by all members who are attending along with Secretary. But on the agenda Secretary will be signed.

    Mam IN our society there are 3 buildings 5,6,7 and bt other society of building no. 8,9 keeping there dustbin in our promises without informing anyone and because of that our society promises is getting very dirty and when we asked them keep The dustbin at there promises then they started fighting with us our secretary also not taken any objection or action against them. Pls suggest what to do?

      Jab election hote hai tabhi Registrar ko inform karna mandatory hota hai. Approval k liye wait karne ki jarurat nahi lekin kise As secretary appoint kiya hai, uska appointment ka information letter through Registrar ko dena mandatory hai.

    If there two joint members are in society for one flat and one member has sold their rights to other member, in that case can society take transfer premium and transfer fee...? Please guide.

      If this transaction is within blood relation, then only membership transfer and share transfer charges should be paid. Rest amount no need to pay.

    Any notification is there for above 2 clarifications 1.How many Casual Vacancy can be filled and after how many years of MC elected.
    2.Can member selected/elected on casual vacancy seat hold the post of Secretary, Chairman or a Treasurer.

      AGM ye mudda uthaye. Sabko bolne ka haq hai AGM me. Registrar ko complaint kar sakte hai but majority honi chahiye.

      Aap managing committee ko letter likh kar bataiye aur agar koi nahi sunta hai to aap registrar office me complaint kar sakte hai. Office bearer k upar ye log action lete hai

    Can bills given every month regularly be treated as notice to defaulting member? And after full year a defaulting member is not paying the dues as per bills received by him. In such case can secretary take action under bye law no 49, for expulsion of member....in this senario can m.c. force him to vacate the flat...by police action...can police indulge in such cases is there any ipc code that applyes in such case...kindly reply

      Sir, aapka problem aapke akele so solve nahi hoga. You need to complain to Registrar but along with the majority of general body members.

      @@anandarya6230 To defaulters you may send warning letters first and then damand notices. In case they are not responding then you can take legal action. You may refer Bye Laws No. 70 and 71. Committee should take initiative for this.

    One illegally made associate member has filed dispute in cooperative court against society and myself one member and another associate member made by me with due mutation in societies record.. Opp number 1 is society.
    But society never attendant any call from the Court nor to the Cooperative department and hence the dispute I am sacred opponent remaining going on for 15 years.
    😊 Is there no provision to Punish such office bearers were negligent totally.?
    Dispute prolonged 15 th year.??

      You cannot make bye laws. You can discuss this point in your society AGM and if all agreed can make a resolution for this.

      Society or Managing committee can not pass any resolution which is contrary to the bylaws. In case the General body majority passes such resolution then Registrar's approval is a must for such resolution.

      Pehle to inspection kare ki encroachment kaha par hua hai. Uske baad unko ek warning letter dekar inform kare..nahi mante hai to penalty lagane ka decision lekar solve karne ki koshish kare

    Basically everything is to be looked by secretary. Strangely so much of work but no salary. Secretary has his/her own life and family to take care of. On top of that he also need to take care of entire society. This is not fare.

      क्योंकि उन्होंने पावर बना ली होती है। उनकी पहुंच बन चुकी होती है। आप ही सोचिए एक तरफ सेक्रेटरी और चेयरमैन ।दूसरे तरफ सारे 100 या 200 फ्लैट ओनर । फिर भी पावर किसके पास । सेक्रेटरी की चलती है किंकी पैसा मेंटेंस का उसके पास आता है।पैसा जहा पावर वहा😢

    Society members if they don't follow rules without permission they carry out modification in their flat after argument they don't pay society dues and enjoy water, electricity, security coverage you talk about these problems. Secretary knows his job ‌बोलना आसान है , कायदे हे मगर मेंबर्स मानते नही

      Ka koi sdasya naya secretary banane ke liye taiyar nahi hai, isiliye current jo secretary manmani karata hai building kuch unke friend sadasya hai jo maintainance 2sal se diya nahi phir bhi unke kam karat hai or hum regular maitaoance pay karke bhi hamara kuch kam nikla to vo karne ko talta hai ha phir kuch karan dear kam nahi karta.
