    HR is NOT your friend. They are there to protect the company only. NEVER talk to HR except for basic needs, paperwork etc. Never tell them anything beyond the basics. Ever.

      @@cryder106 No one. That's the point. And, I'm not a union kind of guy, so I started my own business. Problem solved lol. I really hope being an employee improves beyond the endless rat race grind of indentured servitude it is now. Till then, no thanks.

    The latest tactic from my employer in the Cleaning Industry is the demand that I download an app on MY personal cell/mobile phone to log in and out , receive commands, etc. The app has tracking as well. Unbelievable gall to utilise my personal phone against my will. There is no stipulation in the terms and conditions of my employment that no. 1, I must have a phone and, secondly, that they can utilise my personal phone at their whim. I will not comply.

    So I have a question? My daughter is a 16 yr old full time student, who recently got hired to work part time. In her interview and application she stated the hrs available that she could work due to her schooling and her being involved in sports. She requested weekends off and to work only Mon-Thurs. as she is a cheerleader who has to attend Friday night football games and her Colorguard practices are on Sunday afternoons and she wanted to have one day off (Sat) to not have anything going on. Her employer agreed to her terms and hired her. On her day off (Sat) she went shopping at the store she works for and her employer first asked if her if she would work Sats than when my daughter refused, while reminding her why, she was threatened with losing her job and/or only being scheduled one day a week if she didn’t comply to working Sats. Can she legally do that??? What are employees rights in this instance and if they have none why hasn’t these laws been changed as this seems to be a REAL problem in employment and is totally unfair I feel as my daughter was forthright about her availability from the start.

    I went to work on a regularly scheduled and the door were lock. No work. I was not notified that there would be no work. I was told by some I could make claim for wages for that day. Is this correct?

    Quick question for you guys. I work for a transportation company in Colorado and have a set schedule that is all within state lines. I work 50+ hours a week and I’m not paid overtime. I have talked to other employees that have been doing the same schedule for years and have never crossed state lines. This is a very vague DOT law. I need clarification. I feel that this company is exploiting 95% of the employees that are drivers under federal and state DOT laws. In fact the office that I work from does not provide out-of-state service we all have set schedules that are printed and detailed all within. State lines. Most of us work 50+ hours a week.

    I filed 3 discrimination suits with the eeoc on my employer who hired a man I had to train then he sexually assaulted and molested me on the job and when I made the complaint to the sheriff office my boss told me I couldn't come back to work at the school until after the school investigation was over they never called me back to work or paid me since the day I press the charges on the man but everything was going perfect until they hired a sick pervert I hope I win these discrimination cases cuz I need this money to help me improve my living situation I lost almost everything I worked for since I lost that income complete nightmare it's been.

    Hello, I recently started employment with a company. I was told I was hourly. how ever it is (15.00hr x 40hrs wkly) I was told no overtime is authorized. However I'm Oncall and expected regularly to exceed the parameters given. So I end up working past 40hrs each week. When I say no to frivolous calls I'm penalized. I'm on salary based on this principal.

      That you are listed as hourly but working salary. You can request to have your position changed due to this yet you must closely examine the thin line between the boarder they have you at.

    What about your unused sick and vacation pay? My previous employer has not paid me for my 17 hours of vacation and 80 sick hours I accrued. I left voluntarily not terminated. In Illinois. I’ve looked it up but can’t find a straight answer.

    There is so much that go on now with direct deposit...simply because the employee doesn't always see their paycheck stub...so when working over time...if they aren't checking the pay stub.......they may not be aware that they are not being paid for all of the hours worked---------this happened to me recently).....there is regular time wages.....overtime wages ....shift differential (extra money for shift worked.....be it midnight, weekend etc)...........watch out for places of employment that change out their time clock

    My boyfriend employer is doing shady, unethical, and illegal things and he's getting away with it cause the employees are afraid to step up. In Michigan, you after to pay within 14-15 of the initial payday set. My buddy who works with my boyfriend is a minor who hasn't been paid overtime from a month or so ago. And my buddy just recently got paid but his check bounced and has $200 in dept and $30 bad check fee and the employer has yet to pay back. This isn't the first time he wrote a bad check. He's outwardly expressed he's not paying people after a certain time is they aren't done the cleaning but gets mad because they aren't given enough time to clean so they leave cause they aren't getting paid after a certain time.

    Scotland, financial services call centre. Inadequate holiday availability only option is to swap shifts with someone, now they might happen to work longer shifts. They won't pay you for the extra hours you work. But, they still make the other person covering your shorter shift, work their normal hours that day. So they're getting you to work time for 3. Brought it up and they refused and cancelled the swap, saying you can only swap like for like. Trapping you at work when you need a break.

    So much of that happened to me at the last job. Pretty much the majority of those things. They fired me and said I quit when I didn't. I went to the Department of Labor, and still have not gotten any money in over 53 weeks.

    At my work they give no breaks because I work in a restaurant and they don’t tell me when my shift ends I worked a 9 hour shift no breaks

    I am on ada accomodation and i had to get a doctor note to allow 5 offset adjustments for leave .. if emoloyees are allowed 2 adjustments, shouldnt i get those other 2 adjustments since i had to ask for 5 adjustments for medical

    My past employer fired me for supposedly stealing something that a past guest allegedly left behind at an Airbnb. H.R and boss asked me about it and I told them the truth that I didn’t see it but if I did I would’ve definitely given it to them as I previously did when I found a tablet and I gave it to the boss with two of the supervisors as witnesses. So according to a past guest they supposedly left a tablet and according to them they pinged it and it supposedly rang towards my house and I specifically told the people from H.R. to get in contact with the guest and ping it again while reaching out to law enforcement as well and ping it in real time while enforcement are at my house just to see for themselves that I don’t have anything. I’ve never stolen anything in my life not even a pk of gum. I even told them to call law enforcement themselves if supposedly the guest pinged their device towards my house. They wanted me to admit to something I didn’t do. I personally feel like this was a set up and it was very traumatizing for me. I’ve never been through anything like that . I wholeheartedly enjoyed the job. I know as well as they know this was unlawful termination because it never resulted in anything. No proof of anything . I asked to see the supposed screen shot of the pinged device but they said no. I am a million times convinced this was a set up. Besides, don’t you think that if the guest pinged their supposed and it showed where it was, they would call law enforcement themselves to go to the place and check it out. That never happened. I called law enforcement myself, they said there was no reports made at all . This is so suspicious to me. What can I do about this?

    I have a company attempting to force me to sign an intellectual property rights waiver that reads "perpetual and throughout the universe" as a condition of employment. My position that I applied for is in sales , not marketing and advertising. Do I have a right to decline this without losing the job offer? I had an orientation and am scheduled to start training Monday. What can I do here? Can I request an addendum as a reasonable accomodation? I do not think this company has a right to own my intellectual property and likeness throughout the universe as a condition of employment. I am a performing musician and do not want to sign this in order to get the job. Thanks

    I’m in Pittsburgh pa I’m working as a Amazon driver and was told my starting hourly wage was going to be 18 an hour and my first 2 or 3 pay checks showed I was being payed 18 an hour and with out notice or warning of any sort to me and my last 2 paychecks clearly show I’m only getting payed 17 an hour now I was to,d that is illegal what will happen now any and all answers would be greatly appreciated thanks

    I have a odd question maybe not related.
    can a manger of a phone store(not even face to face) write up an employee if he calls the day before and says if you don't go flyer (passing out cell phone brochures ads etc. To businesses) tomorrow I'm writing you up. Then he hung up with out letting the employee speak.(on a Sunday when he knows the employee doesn't have a car. and the gas prices are to high ($3.10) and the company doesn't pay for the gas. (in a retaliation tone for not answering his call earlier because he was with customers all day) it's something the managers have the employees do when it's not busy, and this employee has been busy all day.

    Also smoke break violations. in Ohio employees must smoke 250 feet away from a building. Walmart does this a lot, and the Department of Health will never do anything to the business. I have turned in many businesses and Ohio still does not enforce the law.
    Keep in mind that Ohio is number in heroin overdoses and sex trade businesses. This is because the law enforcement officers will never do anything.
    And there are no attorneys that will start a law suit against any business. lazy
    BUT ex cons who obtain their law license have that get go will sue states. great job ex cons.

    Quick question I recently got employed by an Amazon logistics company and here is my question I was promised an hourly pay rate of 18 dollars an hour and my first 2 or 3 checks were marked at 18 dollars an hour and now my last 2 checks have been marked at 17 dollars an hour I live and work in Pittsburgh pa and was to,d it was illegal on my employers part as I got no warning or documentation of any sort if that is the case what might happen I am going to be getting ahold of an attorney soon I just didn’t want to mess anything up and them find or make a lie excuse why I am getting fired cause they are that way what might be the worse out come of my case and what might be the best outcome any and all answers would be greatly appreciated thanks all.

    Hours & Wages federal government agency that you file a complaint with. Never go HR. I had to threaten the HR department with calling hours and wages. ..they didn't even know what that meant. But I do. There's absolutely nothing in it for me to work and not get paid. That's why I go to work for a paycheck.

    Hey I have a question, I work at a small mini mart in Brookings , that doesn’t have me clock in, and have had me work over the time I’m scheduled for at times, they send me checks that are getting taxed, and I’m not getting paid under the table either. Is that illegal? Would I be able to do something.

    Hope all is well, I want to asked you a question. I have been retaliated against also favoritism which is against the employee handbook, I tried to get legal representation and lawyers seems to dismiss me and I believe its has something to do with because my employer is The Board Of Education. Any advice on this issue I would greatly appreciate it.

    My problem is with FMLA violations, from my supervisor or HR never telling me that I had an FMLA qualifying illness, to not posting the FMLA rules in my shop, to denying my reasonable request to use my accrued vac time when my sick leave ran out, to refusing to respond to my FMLA request even 4 weeks after I learned about and applied for it. I finally quit the job after 3 months of that, 2 months of it without any money coming in, even though I had 6 weeks of accrued vacation time on the books. It was clear that my employer was going to continue to be hostile towards me, not helping me with anything, sharing text messages of my illness to my supervisor, with my co-workers, not giving me the same courtesy as they gave to one or two other guys in my dept who were the same race as our supervisor, and the man even made changes to the call-in sick rules we'd been following for many years, right after I fell ill.
    It was as if the employer was trying to force me to quit my job, with them even breaking rules in the employee handbook. In any case, after being out sick from work for 3 months and not getting any help or compassion or help from my supervisor or HR Dept, I felt that I was left with no choice but to resign, constructive discharge I believe it's called. I did it so that I could start drawing on my pension (I'm a disabled senior citizen).
    On top of all that, the Atlanta lawyers I spoke with about my case say that I didn't earn enough money to make it worth their while to help me (or I couldn't afford them), and they seemed almost upset that I voluntarily resigned rather than hanging around until they found some reason to terminate me. I just couldn't continue going on without any oncome, so retirement seemed my only option for income to pay my light bill, grocery bill, and house payment. That stinks, because I was a model employee with letters of recommendation from everyone I've worked for since the 70's, I've gotten good employee reviews, even from this supervisor, and I've never abused sick leave, so for them to treat me this way was uncalled for and unfair.

My previous employer who's me a couple hundred bucks yet for wages but then he deducted or took out $2,000 cuz I had a rejected load of peas and he said that he can do that but as far as I know or as far as I'm anybody I've talked to that is illegal he cannot take that for me or garnish me for that

      Yes and If you know of any employer that doesn't give at least a 30 minute break for workers that works 6 hours or more.. report them to the department of labor.... that's beyond illegal.

      OK this is my question.Let’s say we work from 6:30 AM until 11am And we get one hour lunch break.We’re supposed to get off at 4:30.Now if we work past 4:35 or six are we entitled to another break after 430 since we only had one hour break for the whole day

    Is this in any state. Because i just started a job as a housekeeper. And I have clock out for my first 15 minute break and my 30 minute break. She says she is trying to keep up with our time like in the rooms. To me that dont make sense. So with my 30 minute break and clocking out for 15 minutes, that's 45 minutes out of my check. When 15 minutes is suppose to be free. I dont feel that is not right. Then she says you can take 10min at 3. The hours are from 8am until we finish. That could be 2,3 or 6.

      No, you can't be docked pay for any break shorter than 20 minutes. 15 minute breaks must be paid.

    . 4 years straight I was made to come in while extremely sick and be around food or id be fired. I finally got so sick and caught covid while working there and they ended up firing me for being sick because I followed the quarantine rules during covids "hay day". which was against the law and to get around what they did, they offered me my job back and apparently thats remedial action which absolves them of their crime (or at the very least no lawyer would take my case because of the remedial action) even though it cost me tons of money among other things. now my most recent job, Kroger; has done something similar while also breaking more laws. a little taste of said "iceberg" is as I was in contact with them the whole time, they put down I abandoned my job even though they knew it wasn't true and the person who signed and made said document was in contact with me the whole time (which I have proof) and the boss would not put me back on schedule to work. I even have proof they knew I was trying to contact them, but they ignored me even when I would go down there in person. "my" union rep who was working for them was working against me even though I paid my union dues. told me I had two options, either drop my grievance which I am not even sure she filed because she won't give me any of the paperwork that I never once saw or was asked about anything at all and when we had the "meeting"(which I believe was just them fishing to see what proof I had concerning what they've done) I was told I wasn't allowed to record or the meeting was mute. so, after they berated me and tried to blame me for everything, they told me to leave and continued the meeting without me which wasn't due to anything I did because I was corgial and polite the whole time. when I got their decision, I was told I had to either drop my grievance or be forced to resign. I told my union rep I want to appeal the decision and want copies of everything including the grievance that they stated was filed and we were in a meeting for among other paperwork which she wouldn't give me and said I had to choose out of the two options she gave me and that she would only send me krogers "offer" I mentioned above. resign or drop the grievance. just a taste of the bs they pulled. not to mention it wasn't just me who was sick, it was my 1 year old daughter who had a fever of 104 to 107 and was throwing up so much she wasn't able to breath. of which they were given doctors notes for my daughter and myself. do I have a good case ?

    Management starts playing dirty games with me for I refused to be captured and used for wrong things. Ever since I started working, she never accepted me, she insulted me from the day I went for interviews. She creates nasty stories against me, drags my name in the mud, creat false stories against me, bribes my colleagues to stand with her, she makes sure that I do not get to learn and know more of the work, she forms stories against me, all sorts of negativity. She bribes some of the workers to watch what office I visit, whom I speak to, such kinds of filthyness. She gossips creating factions and hatred among employees, and abuses policies.

    When I use to own my own business that one hourly paid employee which was me I made myself work 8-16 hours a day 7 days a week without any type of a break. I told myself nope you are not going to take any breaks and you are not allowed to eat food while working. I did not even provide myself any water just drank soda. I ate at the end of the day when I arrived home. I am truly glad that I did not have to obey any of the labor laws since I was the employer/hourly employee. I figured those labor laws and labor safety did not imply to me. I did not wear safety gear including hearing procreations, safety goggles, safety helmet, safety vest because they do not keep anyone safe not even me. My office was in my house I lived in I had made sure while living and doing paperwork that the doors and windows were locked at all times hard to get out if was in emergency, no fire alarms, and no fire sprinkler system, also I made sure there were no fire extinguishers available Incase of a fire especially with power equipment like chainsaw, lawnmower, hedge trimmer, gas cans, company/personal truck, etc. the state and federal labor and safety laws did not imply to me or my company. There were a couple of times police officers did pull me over for speeding and they asked to see my work timecards and I had lied on the timecards just Incase police officers had pulled me over but at the end of the day I destroyed the time cards and told the government how much I grossly earned and applied the government money to the government and paid myself hourly net amount that never included breaks and I never paid myself sick or vacation times at. I forced myself to work when I was sick that my employer which was me never allowed me sick leave. I do not care if that violates all laws and no one can charge me with any of the violations because no one worked for and the state/federal cannot come after me for violating any of them even if people that do not know me contacts the laws because the state and federal will not have anything on me for the violations. I’m impervious to safety and labor violation laws!!! Also the state and federal governments do not make self employed people to sign a contract that we will follow any of the labor and safety laws!!!

    Hi, my name is William.
    I was just fired for a safety violation of taking photos while driving in a company truck... Understandably so, bad things can happen and yes It's company policy. AND WTF does this have to do with the price of beans? Well avid comment reader..keep goin! 🤔
    I was fired Thursday (11-9-2020-) in the name of safety, for the photo I took while driving through west virginia someone reported me because people suck
    I was sent to travel for work last Thursday.
    Just to make a few extra dollars because that's not allowed in michigan, tis the season to trim the fat AKA restrict the wheels that roll the entire corporation and help the brunswick georgia team make some money
    So I located utilities for USIC (united states infrastructure corp)
    Just wanna see if I'm reading this situation right.
    I was fired for safety violation but they had no problem letting me drive from Oakland county michigan through ohio, both virginia's both carolinas and to Savannah Georgia and bonus I would work in brunswick 1 hour south of savannah DESPITE the apparent 230% spike in hospitalizations. (Updates about virus stats have not been acknowledged in recent emails, been quite some time honestl
    But
    Making stops along the way for food, bathrooms plus an overnight stay in a hotel in blacksburg virginia... No mention of safety there.
    We have precautions yes, masks and hand sanitizer provided and the 6 ft rule
    But those aren't fool proof. They are like pads in extreme sports, the work but doesn't mean you're invincible
    Just spitballin here.
    But
    I drove around south east oakland county to construction projects, interacting with contractors galore, naturally, stopping for lunches, bathrooms, and ofcourse other civilian interactions
    Since may 9th, the only reason I was off from March to may was because I had an appendectomy.
    However, like MANY others, capital aka the bottom line for these companies we work for was deemed more Important then our "safety" and we continued to work during a "pandemic" without any additional compensation.
    It's so dangerous apparently... But not? Is it because I spend more time sitting in my truck because we have come to learn that apparently covid can't get you while youre sitting? At least that's what implied at restoraunts and bars.

      No, since 1) "right to work" is not what you mean (At-Will - right to work means you cannot be forced to join a union to gain a job IIRC) - and 2) At-will doesn't mean they can violate federal law (you might need to do some more legwork in terms of documenting things though).

Where as, if the roles were switched, the rings would have been completely different. Same old story. Money talks, bullshit walks. Money is power unfortunately. That is why the underdog story is so popular in Hollywood renditions of judicial litigations. It’s rarely expected and seen. There’s a reason for that. It’s more truth than you and others care to accept.
