Many people who commit such crimes have problems paying attention and have poor listening skills. They also often are poorly educated and struggle with literacy. Further, this defendant may have memory problems due to mental illness or medication. Note, these are not excuses for the crimes, but they do explain why so many of these defendants seem confused or shocked in court, and it also helps to explain, along with poor impulse control, why they continue to commit offenses.
a. She was off her meds b/c she had not transferred her health care when her attending psy quit the health care provider. b. She appears to be on drugs at the 2nd hearing. Sadly, this happens at times with people on meds for her health care condition. They make people feel like they are crawling through a woolen blanket at a snail's pace. I was surprised she was not drug tested. Likely she might be using meth to compensate for what the meds do. I am not optimistic that she will make it for an additional 2 years.

Why do you assume that jail time will solve anything? The US has the highest imprisonment rate per capita in the democratic world, and a lot of that industry is subleased to private corporations for profit. More prisoners = greater cost to the American taxpayer AND greater private profits. Wake up.
Same. I'm getting tired of watching case upon case of people getting probation / probation continued after violations / deferred adjudications / ludicrous slap on the wrist plea deals.
A. 61% Of American correctional facilities report they are over capacity B. Prison is more expensive C. Prison doesn't gIve the Court/Society a chance to force them to love normally, yet not commit crimes, and to get treatment and remedial learning/socialization. I'm sorry you don't get the emotional satisfaction to see more people get longer jail time, but it doesn't benefit society. Also you can always vote for higher taxes to build more prisons. TX has low taxes, right?

The issue is just that there is so much issue with the best psychiatric diagnostic tools themselves, the means of diagnosing people that we use. There was a crisis in, it was the 60s or 70s I believe? Some doctoral study done by a graduating class of new psychiatrists, like 50 or 60 of them, all went to various mental health practitioners in various practices around the USA and all reported identical symptoms. They all described having a SINGLE auditory hallucination, and beyond that, described suffering from an existential crisis. An existential crisis is the penultimate example of an unpleasant psychological state that is NOT mental illness, and similarly, while ONE hallucination is a bit odd, a single hallucination also gets you no diagnosis. None should have been diagnosed with anything, technically. But they all got wildly different diagnoses, many even got locked away against their own wishes. When the story of this was publicized, the DSM was created to combat this crisis of confidence. In practice though, the DSM has high reliability.... as in, you describe x symptoms and show y signs, you get z diagnosis. This reliability is a good thing. But, especially in light of comments made by quite a good number of people who edited sections of the DSM, the actual validity of any of the diagnoses is very sus at best. They describe that they respond to whatever social and professional and financial and other pressures they feel, they are influenced by forces that have nothing to do with "what is the accepted definition of such-and-such illness" and they otherwise make very arbitrary calls, because everything has to be specified in weird, unnatural ways.... Psych diagnosis isnt at all like medical diagnosis, where you measure a thing, objectively, see whichever signs and they mean this one thing, it is all built on a foundation of nothing at all, and that's just how it is. Best we can do for now though, apparently. Obama's NIMH head put out these calls for people to start looking for better ways forward and they strangely got purged from the internet in the years since

I wasn't sure what happened. The audio about that was garbled for us. But it sounded like she might have burgled the church? I just can't see her in black clothes breaking in after dark. Maybe she had access to a collection plate or a bag of cash and she just grabbed it? Either way it did not occur to me that she was going to be in trouble again.I bought completely into what her defense lawyer said on the first go round.

Yes on back to back. The defendant is not able to manage herself in the world. Best guess is defendant does not have option of assisted housing where she is required to stay sober, given extensive mental health support and employment.
It's so easy to get into trouble by not doing the right thing , but so very hard to get out of that trouble and it'll cost you the rest of your life we must make wise choices and not keep getting into more trouble, and I'm so sick of that mental illness excuse they know full well what they be doing, and what is up with these so called attorneys they look worse then the criminals .

Depends, you would be amazed at some things young people have gone through. I'm a retired guidance counselor and I can't tell you the number of times I've had to call CPS because I suspected a child was being abused, assaulted, neglected, thrown out of their house, abandoned, exposed to drug use, etc etc. It's heartbreaking. I'm not saying that some kids aren't just brats and plain awful people. It takes time to sort out which is which.
I wonder if any of Judge Boyd's rulings ever get overturned on appeal because dang, she is meticulous. Compassionate but ruthless, and she always still treats them so respectfully, even when scolding them. I do like the back to back hearings, also. Ongoing sagas are more interesting sometimes.

But the 80s even into the 90s just seemed more relaxed, I walked or rode my bike all over town and was gone all day, no fear of anything. The music, movies, fashion everything was so fun. I have a 25 and 28 yr old, I think you all generation was really the end of the care free times. I'm rambling, but you would of loved it

Do the lawyers think that saying a defendant has mental health issues has any affect on the VICTIM of the crime or does that reverse time and undo the crime? If not why bring it up? I mean if they have drug problems they can ask for treatment WHILE IN PRISON but again, is this a get out of jail free card? I mean I am bi-polar but I still got a traffic ticket I had to pay.
She is not bi-polar. Neither of the offenses was a traffic violation with a fine. One was assault with a deadly weapon; the other appears to be some kind of burglary at a church. She was off her meds initially as the attend psy quit the medical provider. She appeared to do what she needed to for most of the original probation. Looking at her in the 2nd hearing, I suspect she is using meth to compensate for what her meds do to her. I am not optimistic that she will complete successfully with the extension. Tho she was visibly relieved she did not get 20 years. I suspect she needs a more active/intensive case management system--I believe SafeP does that.

A fair, decent, respectful judge. Not squishy soft or sweet. Not retaliatory nor harsh. This judge is simply smart and a decent human.
