You can slow down to half ahead if a crossing fishing vessel or risk of collision is apparent., take a last min action and, check the water depth to starboard, WHF broadcasts that if you like
Right of way isnt the correct terminology. There is no right of way in the rules. There's either, stand on, give way or those required not to impede the passage or safe passage. Also using the term fishing vessel isn't correct, please refer to rule 3. You're also saying a fishing vessel should be displaying the lights of a fishing vessels and a trawler the light of a trawler, but both are deemed to be a vessel engaged in fishing. I'm sorry but this isn't a very good analysis of rule 10. Also a VEF CAN fish in a TSS.
The answer is; under rule 18 the pdv is required to keep clear of a VEF, except where rule 10 otherwise requires. It does otherwise require. Rule 10 states a VEF shall not impede the passage of any vessel following a traffic lane so therefor under rule 8f shall take early action to allow sufficient sea room.
The situation seems like the VEF hasn't so I would sound 5 short blasts, call the master, engage hand steering, conduct a chart assessment and radar assessment. If still no action for the VEF, due to a vessel on my port side I shall slow down and allow the VEF to pass.
It's important to note there is no stand on vessel in this situation. The PDV is a give way vessel under rule 18, but the VEF is required not to impede my passage.

Actually the same were my answers.PDV to give way to fishing. The situation by it's self is quite difficult and could be interpritated both ways. But rule 10 gives the idea - that all other rules are to be implemented. so - Fishing vessel, executing fishing is the vessel to be avoided. Otherwiese - it says, shell not to impede ( 10 I + rule 8). When in court - it would be the case, which place, which TSS was the collision / allision. and who's lawers more strong. All the rest - have a safe sailing.

Just to clarify on your analysis captain, a fishing vessel can only be classified as a fishing vessel if she is engaged in fishing but if the fishing vsl is underway to somewhere for example home port then he is considered a power driven vessel and must act accordingly.

Sir, rule 8 f iii requires of a vessel the passage of which is not to be impeded remains fully obliged to comply with the rules of this part, my analysis is FV is not following the rule 10 & 8, but I am still the give way as per rule 18. Your thoughts please.
can you also talk about if the fishing vessel does not take action? call master sound 5 short blasts and make a broad alteration to stb or port if safe to do so?
Absolutely Sam. I did not delve into it since I was only focusing on explaining the responsibilities of vessels according to the COLREGs (in this case Rule 10). But you are right, short 5 blasts followed by flashing the lights should precede, you may also slow your speed.
Thank you sir for the analysis, but i have a doubt here " In question 4 if the fishing vessel makes a wide alteration to STBD to pass astern of the P.D vessel its course would then be in the NW direction which is opposite to the general direction of traffic flow for the lane". So would it be appropriate for the fishing vsl to alter its course to port join the traffic flow for the lane and exit the TSS?
Sir, what if the fishing vessel is now a saling vessel, RAM or NUC vessel? Rule 18 still don't apply?
I should just apply 17b that say as soon as it become apparent that the give way vessel is not taking action, I may take action by my action alone?

@@wildatheart7575 Rule 18 does not say except 9,10,13...it says where rules 9,10,13 otherwise require. Rule 18 still applies in a TSS.
