She is talking about default 3 month baad hota hai. 1 month ka Emi pay nahi kar sakti. 3 months ka hone ke baad iske toh pasine chutenge. Hamesha bank galat nahi hota. Upar se time bhi nahi bata rahi kab tak arrange honge. Bank ko bhi jawab dena hota hai RBI ko NPA pe.

The legal process to follow proper recovery procedures of loan is follows:
Once customer misses to pay EMI on time then the account becomes delinquent and then collection process starts. Collection process involves sending first sms then followed by email and then if customer stills does not pay then remind customer via a phone call. If still customer misses to pay then a legal letter should be sent. If customer still do not pays, then and only then recovery process should be started. If any bank starts recovery process without completing collection process, then that bank can be sued for this mis management and harassment. Recovery process can only be started after collection process of 90 days are over. Starting recovery process before 90 days is not allowed.
Its banks responsibility to get mortgage. First they grab % to clear the loan without verficiation and then assault. These incapable managers should get proper response for gundagardi

Assume if the same lady gives money to someone and if the person doesn't pays her back. She will go to police and create all types of ruckus
The money is from a source which doesnt belong to someone personally.
And the person can only send the response from the customer to the superiors for further action but cant talk rudely or force/threaten anyone.
Isnt it a crime under IPC for threatening someone.
Also, if someone is defaulter, then, go through the legally proper way.
Deliver the notices and then the money be taken through the seizure of asset of equivalent value.
But you cant do it in this way.
And it would be better if uou know your loan amount wont be returned then dont provide loans to undeserving candidates.
Give loans to people who have good record of returning the money on time or dont give ur money.
But tbus activity of workers is extremely punishable.
@@xclzv5900 I agree that banks should go proper way but we all know how slow proper way is. Banks gives terms and conditions that needs to be fulfilled. Bank has money of every person. A failure of bank due to bad loans would lead to massive and countrywide issues. I agree that banks do malpractice when issuing credit cards etc but when we are knowingly taking debt we need to be ready to fulfil our duty of repayment. If you cant be sure, its best to not take the loan and if the loan was taken with best intention and understanding of mind then its on the customer to approach bank and ask them to give them some relaxation. I dont like the way bank gundas talk but this is why I am never a creditor of them. If I am a creditor I would never allow anyone to even call me.
The point is, there is no use of even this lady going to police and creating the ruckus.. Police will simply tell any lender that the issue has to go through Court notice or in case cheque is involved, cheque bounce system.

Why can't we understand if a person is taking a loan and we can't repay whose fault it is? She is trying to act smart? It's his duty to make defaulters to make payment. As a customer you are going to ask for a loan then default . Please guys understand
What you are saying is absolutely correct..but problems never come into life with prior information or intimating..with the cost of living out of 140cr population most middle class families do face such financial condition reasons can be multiple..that does allow any collection person to talk with customers with this note ..bank has its own process..what she was saying is nothing wrong..if you find a customer acting very smart or intentionally not paying amount in that case bank can take legal action instead of this activities..
So many cases are there where a third-party collection people usually visit customer residence to abuse n insult n threaten..how can you support such activities.

Lady has no intention to pay her dues. She didnot confirm any expected date to pay and just show casual approach towards her responsibility to pay on time. Person doing follow up is doing his job to collect unpaid amount. His words are perfect to her casual approach. She is arrogant and tried to divert her default and wrong intention to other senseless mail or whatever she demanded.
Employee is doing wrong, there's no rite to visit before 3 month, lady doesn't have money at the moment and also she can't manage she has 3 months to pay dues she is using her rite only what company has given to every client.

@@Review_0007 your intentions are also wrong. Every single emi is the responsibility to collect by collection guy. There is no rule that follow up will start after 3 emis default. After 3 emi default, customer will convert to NPA non performing asset and then legal notices will serve to client through court. Go and get some knowledge. Don't mislead here.

The lady is absolutely right. People don't understand and still giving fault to the lady. Banks have no legal rights to have recovery agents and have no rights to forcefully go to someone place to recover money. The case may go opposite if they visit uninvited. Moreover, the recovery agents are always harassing to customers. It is clearly written on the loan agreement that period of emi default is 90 days as per RBI guidelines and banks cannot force anyone to forcefully to clear EMIs every month when they can't pay it. Proper procedure should be followed and this lady gives everyone a good knowledge on how to handle those recovery agents. These recovery agents doesn't have any idea about rules, laws or guidelines but simply gets a contract by banks thinking that they can just simply threaten anyone to pay loan defaults.

Shame on you for lending your support to that impolite, illiterate woman who has no intention of repaying the loan. Banks find it difficult to easily approve loans because of such shameless people who don't pay their loan on time or don't pay at all.
I also took emi loan from hdfc twice and always paid on time. Mujeh ajtak kabhi bank ka call nahi aya k peso dedo wapas kyuki mein time pe paise bharta thaa. Jab paise liye ha toh time se bhardo ya harrasent jhelo.
The lady seems to be a seasoned crook. She's instigating the bank officers and then blaming them for being discourtious. Look how she's arguing that she's not taken the loan from the caller but she's taken the loan from the bank (as if the bank was some living individual person)!

It's a business model. Give a bad loan, you know the customer cannot pay on time. Add interest, hound them with collection team(every corporate has a collection team who run after payment be it B2B or B2C), most somehow manage to pay the loan back with the interest buy taking loans from relatives or but mortgaging. Banks try getting it through corporate extortionist rather than going legal as going legal will cost the bank more than hiring a person who can frighten the customer. So she fell prey and yes if she does not pay back she defaults and the bank register another bad loan and then go to RBI and say they will go bankrupt there by creating a panic state in the mind of all their customer and finally the govt. steps in and this hurts the entire systems.

Learn what are court guidelines for recovery of such loan. Your banks are required to do all the due diligence before giving loan.

But that doesn't mean that the onus is only on the banks. The person applying for the loan should be even more responsible: they must have the decency to return the borrowed money on time with interest. Or else they must not take any loan. Even an idiot can tell if he would be able to pay back someone at a particular time or not if he knows his cashflows.
The thing is it's the business of banks to give out loans for profit. And there are certain amounts for which mortgaging an entire house is too much. Like Rs 5 lakhs, Rs 12 lakhs etc. Banks in these cases give out loans based on the monthly income of the borrower. But what happens is that these people think they can do away without payment and they instead choose to spend money on short term things. In such cases, the banks have done their due diligence and it's the fault of the borrower.
Irresponsible borrowing led to the 2008 financial meltdown. A person who wilfully defaults on loan payments is not worthy of being considered a person: he's an animal, a thief! He should be sued for everything he has. And most importantly he/she deserves no mental peace.

Ia pretty sure you do not know the rules. The woman is abiding by tue rules. A loan can be considered as a default only after 3 EMIs are missed. A collection agent cannot reach out to a customer without authorization from the bank, which has to be communicated by bank directly to the customer. The bank cannot send anyone to the customers residence without authorization letter for collection. These are rules which are set by RBI.

Never worry about unsecured loan payment if somehow a person fails to repay ontime, they can just make pressure to pay but they can't put u in jail or can sell ur assets to recover.

There is no space for recovery agent. The agreement is between the bank and the borrower.....if it is a default the bank can only approach the court. Nothing more. No threaten no muscle no abuse.

Don't talk to any one else other than a bank employee or nodal. Rest are inconsequential. Report to cyber cell and with the local PS for harassment, send a copy to the bank nodal. The bank will get a shiver.
