    I never understood "independent" truckers working as OO, but getting loads from a dispatcher. They should work it off a load board, choosing their own loads.
    Sure, OO can decline loads, but then they sit doing nothing as the dispatcher punished them for "disobedience", when a true OO will just go to a load board and pick another load in 10 minutes.

      Well no one really wants to pay all of that extra money to get their own authority and it’s hard enough to drive let alone having to get your own loads from shifty brokers. I just got started with my own truck. It’s way too much to get my own authority than lease my truck to a big company. I hope this explains it.

      @@younglove3362you still have to pay out that money for your own authority. Not something I would want to do that especially now. While you may still get taken by a stupid broker I will still get paid. Maybe when the market gets better and I have the money for my own authority I will do that. Either way it’s still good to lease my truck to a company and use their dispatchers.

      Maybe my insurance is cheaper than running my own numbers plus it’s contract freight also the last company I was leased on with the dispatcher would 3 way call me and the broker to negotiate the load and was never pushed to the side for not taking a load I also looked at the load board and would get the dispatcher to call on loads but at the end of the day some people don’t want to take on 100% of the responsibility of having their own authority

    It is so funny how we have O/O arguing with each other on what is the best way to go. If you own your own truck it makes no difference if you lease your truck out to a company or become a motor carrier. Whatever you want to do is how it’s going to work. Both of you are O/O’s. Either way you both have more freedom than company drivers do. I myself lease my truck to a big company because right now I don’t have to wait to be paid and freight costs are low right now.
    You take on SO much more when you have your own authority that I really don’t want to deal with it. So keep up the hard work O/O’s. Keep up the good work ethic, and let’s help each other out when needed. Lastly be positive… it goes a long way.

      So when a company leases equipment to another company and provide an operator, the operator automatically becomes an employee of said company that is leasing the equipment? That makes no sense.
      For example, the government contracts things like back hoes with operators to fight forest fires. Should those operators now become government employees?
      It should be perfectly fine to contract equipment with operators and not have to pay those operators as employees. Should be up to the company you are contracting with as the operator is there employee not yours.

      You can get paid as a contractor on a 1099, unless of course you’re actually an employee. You can’t own a bunch of equipment and throw guys in to drive and pay them on a 1099. Those drivers are employees. Period.

    NOW EVERY SINGLE INDEPENDENT CONTRACTOR WILL REQUIRE TO register an LLC just to be independent driver, basically like democrats love to do just make it harder for regular people, now regular people have to spend around $1,000 opening an LLC to do same thing and to get paid the same, wao brilliant idea democrats, by the way people in CA deserve it, you get what you vote for

      Hey man I’m on your side here I think we both agree but IMO the LLC should be a no brainer anyway. I’m all for private business & not paying for a business but LLC isn’t that much. Maybe 150$ a year or so depending on some things. But it gives you limited liability which is a big deal if a lawsuit happens & it’s good to build business credit.

      It's free in MI. You just make a phone call and register your company. Not hard, time consuming, or costly. You should have one anyway. Everyone has a side hustle for extra cash. You should be using that as a write off. If also benefits you if you are ever sued. They can sue your LLC....which owns nothing, instead of you.

    I think some of the companies did want to change drivers to “lease operators” to avoid the taxes and health insurance & and other benefits because the truck lease purchase program was really not even feasible for most drivers and they always pushed you to upgrade to a newer truck instead of paying off the current one I am with a different company that actually does a fair lease purchase program and you are truly an independent driver if you prefer to be

    The reason is the barrier to entry is being raised in order to start your own trucking company. It's a conglomeration of mega-carriers who don't want competition, who are pushing these acts. Same thing with the 2yr requirement that affects many insurance carriers, which requires a driver have at least 2 years driving exp before they can be covered by smaller trucking companies. this forces new drivers to work at mega-carriers for 2yrs for half (or less) of what they could be making with a fairly compensating employer. The restriction of leas-ops will mean carriers are limited to employee-status only drivers, which cost carriers (including new ones) much more. It raises the barrier to entry. Next will be a net-worth limit of 1 million dollars to start a trucking business, then it will be raised to 1 million dollars liquid assets. I watched this all happen in the mortgage industry.

    Some of y’all really need to read the law. It doesn’t affect your authority to be an owner operator and run your own authority under your own DOT.
    What this is going to affect is them so-called companies out there calling people independent contractors just so they don’t have to pay them a fair wages and lay all the blame on them once something happens i.e. the contractors.

    When I was a trucker I would get hired as a company driver and then some companies start pressuring you to switch to lease. Not all companies did this. Some companies have all employee drivers and some have a mix of lease and employees. It's for tax purposes and debt and healthcare. These companies save money by putting all financial risks on lease drivers.

    Schneider leases their trucks through another LLC named SFI. This means that the truck is not associated with any specific carrier, allowing you to work as a contractor for any carrier of your choice. Will this law also affect lease operators, or does it only apply to companies that lease trucks but cannot take the truck elsewhere?

      The the issue Is most 1099 worker's don't bother to pay or file taxes anyway! Especially a lease purchase or Uber driver. I did lease purchase for a few years myself and enjoyed my $2,500 a week settlements tax free! Never filed and never paid the IRS.

    I'm confused. I think I understand where this law is coming from when it comes to companies hiring company drivers as Independent Contractors. However, Lease Op. That makes no sense to me. Lease Ops are paying for the truck, insurance, and fuel, and control their schedule. How are they a company driver in that sense? That doesn’t make sense to me.
    Another thing, even the company drivers that are hired as an Independent Contractor. If they have their own LLC and Business checking account and control their schedule and routes, how is that illegal?
    This is dumb on so many levels. This is only going to help the mega carriers and this is going to hurt all of the smaller carriers.

      I’m in the exact same situation as you. I don’t think we have to worry. I think there is always a way around things & loopholes. Business owners like us operate enough that we could defend, they would have to prove that we are an employee & rules and codes are not law. It’s just intimidation to force thier agenda. It’s not gonna be an over night thing that takes us outta business.

    I financed my own truck through my bank and leased onto a company and now I am considered an employee? I pay for my fuel, insurance, repairs,IFTA, registration and I am an employee. I signed a contract of my own free will. This is Bullshit. We need to shut down the FMCSA. I spent $200,000 for my truck in my name and now considered and employee. Bullshit!

      Worse case you just make an LLC sub-S and become an employee of your own company...its not a big deal....took me 20 min to fill out the paperwork and $35 to register the new business. The truck becomes property of the LLC (this is a small hassle as you have to change the name on the title to the LLC) and you, as the owner of the LLC still sign all the contracts, book the loads, etc...its just a tax status change, nothing should change your day to day. Its a bigger hassle for the companies that book you than for you, as they will have to draw up new contracts.

      @@watcher2554 for folks that don’t know. He’s talking about changing your filing tax status for your business LLC to an S-corp which Yu should be doing anyway. Then run payroll & W2 to yourself for your payroll earning every week to yourself personally as an employee to your business. There are tax saving benefits to filing as an s-corp. it’s key to understand your business is not an s-corp, instead it’s your tax status or filing status changes to s corp. research it.

    If you don't have your own DOT #, if you don't have your own authority, and own/lease your own truck independently from another carrier, you're an employee.
    Hopefully, this will stop the lease operators scam since it is always a bad idea to lease a truck from the same company you depend on for your revenue, ALWAYS.

      I buy my equipment just like you from Peterbilt or KW directly... company has 0 to do with it... Use Paccar Financial most of the time. Buy my repairs/services where I choose. Find my loads just like an owner/op with his own authority. What I don't do is wait 30/90 days for payment and I don't have to factor to avoid the wait. I also get the benefit of volume buying for parts, tires, fuel, etc. if I choose to utilize that.... example is I can buy Goodyear or Michelin tires for around $400 each.... market prices are near $800 each.
      I pay the carrier 10% of gross revenue but other then that hardly have any contact with them. I had my own authority and the headaches that go with it sucked. Now I'm operating just like having my authority without the headaches. Yes my lease is unusual compared to the mega companies but I'm still a lease operator. So your attack against lease operators is not accurate. I agree that companies like Prime, Inc. and Schneider are only taking advantage of their drivers and basically treat them like company drivers but they are not known for being fair anyway.
      There are good lease options out there. I'm no different then you... I make all my own choices and get all my own loads and pay all my expenses... I just take advantage of the benefits of a companies perks for a 10% fee.

      Not really you are contracted on with them.. they don't pay for your fuel they do not pay for repairs.. they don't buy you new tires they don't pay hundred percent insuarance,, they don't pay all the plate costs.. they don't buy your food. So if anything you are not even close to an employee,, employees and company drivers like to think you are cause it makes them feel more.supeior or some shit...

    It's all about tax $$$.they want to get that tax $ from lease drivers.the companies pay nothing on behalf off drivers ,then lease or rent drivers pay away less taxes by claiming bunch off stuff.

      However if they do that they must also pay 1/2 of your Social Security/medicare tax . It’s 15.3 percent you pay your self as an independent contractor but as an employee you pay 7.65% of your income and they pay 7.65% plus you will get medical insurance at a cheaper rate, dental insurance , vacation pay etc. I realize most want to stay IC but if you really want that then you will probably have to get your own authority or at least lease on to a company like Landstar where you bring your own truck on (none of this lease-purchase scams of leasing your truck from and back to the carrier ) where you never ever really take ownership and they control your maintenance money and you for that matter.

    You don't get rich working for someone. Being 1099 has help my family alot.
    I know Alex never been a company driver ever but
    I tell you this much!!!!!!!!!!! THE PAY IS BS especially when starting out for the first time ever.
    500 to 700 is BS to be gone weeks or months
    Say you put up with it to gain experience
    Now you at 1,000 to 1,300 a week. That PAY IS BS ( more experience means finding a better company)
    Say You earn more yrs of driving and decide let's go lease purchase or just lease a truck thinking more money
    Now you at 1,500 to 2,200 a week. THAT BS PAY. For 6 days a week
    Why!!!!!!! Because the company is putting away money for all your maintenance and tires and don't forget, you need to save for taxes. Put away 500 to 700 to the side.
    Now u making company money in hopes to one day own your own truck which will have over 600,000 miles with about 2 yrs of good working left of life
    You gotta go out and be your own boss or Find that company where u can bring in your truck and pays alot
    Those lease purchase in mega carrier's will work u to death. If you leave the lease, all that money in your maintenance account is gone to make your rig road ready for next driver.
    Dart transport
    Get paid the same day u Deliver
    1 yr of lease, maintenance account had 8,000 dollars.
    Walk away to better company thinking I'll get back about 5,000 to help me get thu Orientation for next job.
    They took it all away plus a 500 shop bill remaining balance.
    That ant right
    Truck was still in good shape
    You gotta go get your own rig and make your own moves to get that big money

    No one can own a truck and or truck/ trailer combination in America and haul freight for money without the government of the United States issued authorization or authority. And that is why you would have a truck and lease it to company to use there authority to operate and have access to that companies customers, which if done the right way everyone involved should be able to make money under that arrangement. The problem is when people hire truck drivers to drive their truck and want to pay them as contract labor or 1099 employees just like Owners Operators leased to a company, and anyone can see the difference in these to situations.

    "Lease Operators" should mean a driver can lease a truck from a trucking company, but SHOULD not be restricted on loads and have the abilty to access load boards just like any other O/O. Only difference is one driver owns their truck and the other leases their truck.

    Before Trump's tax law, both contractors and employees were able to take a Per Diem deduction when filing federal taxes. Trump's revised law eliminated the deduction for employees while keeping it for contractors. Some employers try to make up for this by splitting pay into taxable wages (taxable) and Per Diem (non-taxable). However, they often take a slice of the tax savings to cover the added cost of the extra bookkeeping and the employer's share of FICA and Medicare. For 2022 the Per Diem deduction for contractors was $69 per day for each day spent on the road. I have not yet seen if it changed for 2023. This was to cover meals and incidentals like soap and toothpaste and made it unnecessary to have a receipt to back up each deduction. Employees also cost companies for unemployment compensation and worker's comp.

      Exactly. We’ll put. Most people over look this. I’ve never seen someone else notice this. I saw this very early on. That’s why IC & LP drivers really benefit bc we have the power to fully use the deduction. Instead the carriers find a way to take piece of everything & most people have no clue they’re being taken advantage of.

      But make sure if this is you that you check the refs for per diem. For 1099 to use per diem as a tax deduction, the max you can deduct is I think 80% of the daily per diem rate. There’s info online. A few little things like that to pay attention to, to make sure you’re in the green if ever audited.

    If you have your own authority and are incorporated, it will change nothing as you are a 1099 Corp to Corp. This, as some people correctly point out, only changes things for the current grey area that companies are exploiting to avoid paying employer taxes.

    I wanna be a lease owner op this year. I'm not letting these trucker scares from the government to deter my decision.
    As a 12 year company OTR/Regional driver, trucking OTR nowadays feel like a 9 to 5 anyways. So if the rule changes... what am I really losing besides going from 1800$ per week to 5000+$ week.

    The thing that gets me is a lot of people big themselves on being a 1099 and don’t even understand the basics of being one. Then when something happens they want to point the finger, there’s something called a Maxim of Law “He who slumbers on his rights has none”. Then you expect the Government to handle it and when they do it’s typically not in no ones favor and if it is, it’ll be in favor of business or every now and then businesses will get the short end of the stick. Why? Well, the government is a corporation. Those that know will understand that and if you don’t, then that means you have some homework to do big time.

      @@F150customs obviously you don’t really know how it works. Because if you did then you would have included that with 1099 after filing you would owe 25-45%, usually 30-35% of your income to the government.
      But that’s just the point why we want it so bad. Because 1099 as a business allows you to write legally stuff off. You could start a side business or turn a hobby into a business, it’s not hard to legally write off and owe little to nothing if educated on some tax codes.
      You would also know it would be terrible if married & kids since you would owe that 30% back every year since you weren’t savy enough to learn business & tax codes.

      As an employee company driver we should get overtime and I hope that gets changed too. Be harder to do that as an Independent Contractor. Basically the main reason he got it right, it’s about the money (and control). They want that tax money automatically deducted from each check and with 1099 contractors they gotta wait for quarterly payments if not annually as many don’t pay like they should quarterly either by choice or just plain lack of funds.

    I’m interested to see how this will affect the mega carriers that lease their trucks to their drivers. Will they do away with the lease programs and make them company drivers? What happens to the drivers that almost have their trucks paid off with them? Things are about to get interesting to say the least.

      I don’t think so. There is a right & wrong way to do these things. These big carriers & smaller carriers that are running clean do things the right way, so that they can still do the lease drivers. This isn’t an outlaw of IC drivers, this is just further clamping down on what they consider employment vs IC worker. It’s still up to the carriers decision, legal battles to follow & the contract that the govt can’t interfere with. There are work arounds & legal loopholes in anything. But maybe I’m wrong, this administration sure is tyrannical enough to find a way to shut it down.

    I'm in the process of putting a small hotshot rig on the road.
    Have LLC in place and about to apply for DOT numbers.
    I have a couple friends that are interested in leasing on to run under my numbers, my book-keeping, and load board, and they bring everything else... Truck, insurance, etc.,
    Those are definitely NOT employees, but I'm afraid that Uncle Scam might be able to twist it some kind of way.
    I'll forget about the lease idea if everyone gonna get skrued!

    The only reason the ATA cares is the mega class will be negatively impacted by this decision. If you actually own your equipment and possess your own authority the ATA is actively trying together legislation together to help put you out of business so everybody can go work for King Carroll.

    LP here! I love being a trucker and aspire to pay this one off to work on buying another until I have a fleet and can help other young men or women achieve their goals, I hate the divide, I’ve worked waste management, local, LTL, and otr for a mega…LP has been the best thing to me and my family…I’m reading comments talking down on us LPs and it’s not cool, I move freight just like a company or OO, I take pride in being a trucker, NOT a lazy, phone holding, foot on the dash, non-cb having, only can drive a automatic, think I know it all driver who can’t even tell you what type of engine their running

    I own my truck free and clear and am happy leasing to a company that manufactures their own products. I pull many different trailers, all taken care of by the company. All I have to do is decide where I want to go, buy my own fuel and maintenance. Been with them since 2007, will retire from them. Again I say I am happy there.

    I’ve worked as an independent contractor classified as an employee. Basically nothing changes only you get taxes taken out and you can still itemize deductions.

      Once classified as an employee you CANNOT itemize expenses anymore. If you have an accountant that says you can you better find a new one. So Fuel, truck expenses, etc are out the window. Try paying g taxes on $300K a year per truck without write offs.... good luck!

    I have talked to a few companies with lease drivers and they told me that they will just drop all of their lease drivers. You can contact to a company but you have to run under your own authority and insurance. Now a days it very hard to stay on top of everything going on and run a company plus drive too.

    Like you said originally, it was designed for California and Uber drivers but there are a lot of shady companies in our country where the owners are not from America and they pushed the 1099 and try the force the truck driver to pay their own taxes which would be fine, but they lure some of these people in With $.50 a mile more and honesty that just don’t cut it there’s a lot of people out there that are very bad at math. I’m not one of them.

    What can one say government just sticking her nose into other peoples business? I just opened my trucking company in the fall I paid 50,000 for insurance not a lot of these lease operators are going to be able to afford that so since the government wants to make a ruling like this why don’t they crack down on the insurance companies and make insurance affordable for guys that need to open up there own independent trucking company it’s just another way the mega carriers are squeezing the little guy out

    They really need to outlaw the lease purchase program that some carriers have, a driver lease purchases a truck, the company pays no payroll taxes, no workmans comp. , no medical benefits, no payed time off, charge the lease operator like 15 cents per mile for maintenance through payroll deduction, if the operator turns the truck in,the company keeps the maintenance fund, it is rarely a good thing for the driver

    I operate under their authority, BUT my name is on the title. I have gotten pissed at a dispatcher. What did I do? Told her to have a great WEEKend. Yes it was 2100 miles to home and I did it. As OWNER I can do that. Coordinator called next day since I did not check in. Asked her what for ! I am going home.
