also I fail to understand as To why Lower court and high court did not understand the need for affidavit
Because priyanka srivastava judgement came in yr 2015 about affidavit to give in 156(3) it means previous to this no requisite condition to give affidevit was prevailing. Is it so pl clarify at the earliest.
