A fake FIR has been registered against three members of a family by fourth member, influencing police.
The fourth member fraudulently transferred the shares of inherited property of other three members on her own name. She announced her fraud two years later and agreed to undo her fraud. Sha also executed an Affidavit to that affect but refused to hand over the share of property to other co-owners.we filed a private complaint and a suit for possession of our shares. She lodged a police complaint denying the willful execution of affidavit. Further alleged the the affidavit was fabricated b y me. police took six months and closed the case.But she used more influence and succeeded in registering the FIR, quoting the case explained by you.
Request advise action by us against this fake FIR.
We have taken bail for now and contemplating further action.
Follow police report/cs n attend court on evry dt n apply for discharge
Acquitted in criminal case of sentence 5 to 7 years..Can he Get gov. Job?

In cognizable offences, an officer can take cognizance of and arrest a suspect without seeking a court’s warrant to do so, if he has “reason to believe” that the person has committed the offence and is satisfied that the arrest is necessary.

Pl indicate what provision was prevailing before informing of such case to police. I think there was nothing and police athorities were doing as they have been approached/ their mersey resulting to stand a false case in case where complanant wants to mis use this section or wants to take the advance of this section or create trouble to opposite party.

I think new guidelines were given by supreme court on lodging FIR on cognisable offence.
