    This! I highly recommend this! When I went to an appeal hearing, I brought my workplace attendance listings and my corrective actions records from work which detailed my lates, absences, my need for excessive breaks, my detailsmed conversation records, anything that could've helped and boy did it help! The ALJ got a clear view of my post-stroke ailments & issues, and I eventually won my appeal. Definitely follow this video's advice!

    These videos help me win my case I got the maximum amount because of my condition if you watch these videos you will win never ever ever send anything to the mail walking into the office and take the time to do it right I like to say thank you sir for helping me now I can sleep better before you fill out your application online make sure you have times and dates of your condition and you have to go every single Hospital in check your records small amount of footwork equals a win on your part

    Very good points. it would be advisable to keep a log or jurnal on your treatements, intereaction with Doctors, providors and activities or problems related to your conditions. You would never know when you might need the info.

    I am so grateful! These videos saved me from an almost certain decline. I wrote an outline about everything my co-worker would/could have seen. Went to his bank to notarize his letter on what he witnessed. I disassociated so badly, everyone in the room watched me struggle to tell the story. An outline would have been helpful, lol

    You’ve clarified so much for me… I have an incredibly rare illness called mastocytosis and it’s very complex and difficult to describe and overwhelmingly debilitating… I haven’t worked for most of my adult life except for 3 years out of 30 if that… Long story short I don’t have any medical coverage and I haven’t had any for a long time. Other than the standard treatment for the disease there is no cure… treatment for it is basically avoiding triggers and over-the-counter antihistamines And just suffering through each day.
    Anyway what you said about their consultative Reports… They sent me to a psychologist who asked me nothing about my physical illness in reference to its manifestations psychologically… And he diagnosed me with three different personality disorders and also “the likelihood that I would exaggerate my illnesses and that I was preoccupied By my physical illnesses”… note, however, I have been going to psychological therapy for depression for the past three years and they disagreed with his diagnoses of the personality disorders that he assigned to me. Nor had anyone else ever diagnosed me with any personality disorders and I’ve had testing and therapy and counseling with other doctors etc.
    My hearing was rushed and at the end the judge told me it was because they had two hearings that ran late that morning… They denied my witness… And they hung up on me when I was still trying to explain my complex disorder.… I’m having a terrible time finding an attorney to take my case because it is complex. I am in the appeals phase after my hearing which went really badly as I stated.
    Do you have any advice for how to find an attorney and not scare one away with a massive amount of information that I have? I keep getting referred by each attorney that I speak with to a different one. I know it’s because it won’t be an easy case. It’s hard for me to even write this right now to explain because it gets so depressing for me.

    Can you do a video on tips for self representing. I love the advice your giving and it's really helping me out alot. Due to the position I'm in I cannot get a lawyer and I have to self represent. I'm confident I have a, strong case and Im still collecting as much evidence as I possibly can. Thank you again.

      You do know that SSD lawyers take cases under a contingency (no fee unless you win contract). You won't have any up front cost. Getting a lawyer is far better than representing yourself.

      I had a friend who did it by herself 6 times lost she's super smart but once she got a lawyer the 7th time won. Get lawyer pay later do yourself a favor.

      I would not wait until just before your hearing - give your lawyer 2 or 3 months at least to make sure the file is ready. Hearings are done in person. You can retain a lawyer and communicate with your lawyer over the phone if you wish.

    Be your own informed representative. Let the evidence speak for itself. If it can not get more evidence.

    I had an active DCFS case because of my hallucinations and depression. I, unfortunately, lost custody of my children because of my emotional and mental state- can I submit this information into my file?

    I heard that an ssdi applicant can request that their consultive exam be done by their private doctor!

    Please help me. My husband had his hearing yesterday. When it was over our lawyer said we may have to go to federal court. Does this means we lost? He was suppose to be best in town smh.

      Your lawyer can be the best and still you will need to go to federal court. Either the weakness of the evidence or a biased ALJ can be dispiriting.

    and even this is getting more difficult---- doctors giving full support on disability there are many reasons for this but its becoming more difficult to win yer doctors support and the reasons are many but without them your screwed

      when i first met my specialist and showed her records i had from another state she was so nice agreed i had some issues and the minute i mentioned disability she changed her tune real quick like well maybe you aint that bad and i cant get you your disability and so forth

    Mr Ginsberg, hello and thank you for your ongoing info series. Resently, I am hearing in various websites such as "Social Security works" and other sites or news outlet that Trump or McConnell or whoever's are introducing legislation to basically gut SSDI and or Social security in general . I'm about 15 months out from going to full SSA retirement age from SSDI since 2006. Can you please dispell alone of the misinformation on this topic and address it to me specifically and in a video. Thanks

      All I know at this point is that several months ago (pre-coronavirus) the Trump Admin floated some proposals to reduce the past due benefit for SSDI from 1 year to 6 months and to tighten up some of the listings. All that has been put on hold so I don't see any significant changes anytime soon.

    Question. 3 years ago i applied for disability due to depression and anxiety at that time i was denied. I am reapplying now. My funcional report from my Psychiatrist was sent to SSDI at that time. Would SSDI be able to retreive that report at my attorneys request?

    Mr. Ginsberg, how about a video or two about some lifestyle tips to reduce your chances of becoming disabled in the first place? I've been researching such laws in recent times due to a family friend and I'm worried I may be in this boat in the future (I'm 32 years old and in average health). I want to know what are some things I can do to reduce risks in life. Obviously not smoking and not doing drugs and taking vitamin C, and getting exercise and not skydiving or doing anything dangerous. And ?

    I was denied last time because of reports from a doctor I saw 3 time for 15 minutes max and never went back to because he was useless. Ugh

    In filing for benefits at initial and reconsideration phase would it be advisable to submit some pictures of myself and the accommodations ive had to make to address my disability. It seems like it may make it more human for the examiners?

      I don't think that would hurt but I have never seen an adjudicator or judge refer to photos in a decision.

    If someone has PTSD that really makes them "uncomfortable" with men in their personal space or in more personal situations (like in a small exam room), is there a way to request a female doctor for your SS exam because of this, or at least a female nurse to stand in on the exam?

      Caitlin you can and should make that request to the adjudicator. Whether they will honor your request is a different story.

    If the vocational expert find 10 jobs you can do does that mean you lost period?

      That is probably not a good sign. However, some judges start with a hypothetical that contains very mild limitations and then proceed by adding more and more restrictions. At some point you want the VE to say "no jobs."

    I received a partially favorable decision. I filed July 2016. I had knwe surgery April 2016 I received my awards letter stating they agreed I was disabled but changed the onset date to my bday 0ct 2016 with a review scheduled Jan 2024. I didnt have legal counsel they said I could file for a reconsideration on the dates. Well I filed late never heard a thing been getting my disability for 13 months. Last week I got a letter stating I have a hearing Aug 21st. This is before I had been watching your videos. The letter said I would see a judge and a vocational expert would be present. I had filed the reconsideration late hadn't heard a thing for 9 months. I had already decided this decision was good based on your videos. So I called the local ss office and told them I agreed with the decision and did not want a hearing. The ss office said to come by bring a letter stating my name ss# and that I no longer wanted to have a hearing that I now understood and agreed with it. I know now because of your videos they used a grid to make the decision. They made the onset my 55th bday. I was a welder for 35 years with a HS education. In your opinion it wouldn't have been worth the risk. Am I right. Also I have learned alot from your videos and thank you

      Thanks I understand. I did make up my mind and canceled the hearing being that it was a issue of a few months back pay. They the ss office said to cancel the hearing to put it in writing and bring it to them. I just said in the letter I understand the decision and stand by it. I felt like I was putting my disability at risk by going in front of a judge. I'm sure you understand. I received no back pay but it was only 5 months anyway.

    If someone had attendance issues at almost all of their jobs would that help their disability case? My hearing is in September I'm trying to make sure I can give them all the info I can that will help my case.not to mention I got a letter today saying I gotta exam in august....apparently the judge ordered it

      Yes, attendance issues are very good evidence.

    if the VE said no there are no other jobs but my medical records aren't that supportive can i win based on the VEs answer ?

      If the judge's assessment of the evidence is reflected in his/her question to the VE and the VE says "no jobs" you would win. Note that judges typically ask multiple questions to the VE, only one of which reflects what the judge is really thinking. Also, judges know what the VEs will say in response to their questions so the whole question/answer process is a bit of a dog and pony show.

      I filed for my ssdi July 2016 for knee disability after contracting septic arthritis MRSA in the knee joint having a total of 3 surgeries. I received a award letter in Jan 2016. It was a partially favorable decision. I had claimed April 25 2016 the day of the first surgery as onset. They agreed that I had severe range of motion. That based on my education and work experience I had that I became disabled on Oct 16th 2016. That happened to be my 55th bday. I appealed a little late the onset date. Last week I received a letter I was having a hearing Aug 21st 2018. I thought I was asking for a reconsideration. I found out I was going in front of a judge and a some sort of vocational expert would also be there. I wasnt expecting this. After seeing your video on partially favorable decisions I decided for the few months back pay it wasnt worth it. I also now understand they used the grid you talked about to make the decision. I called the ss office and said I no longer wanted to appeal that I agreed with the decision. They said I could cancel to write a letter stating my name and ss# and they canceled my hearing. My award letter had me scheduled for a review in 7 years. Did I make the right decision. I could possibly have had my partially favorable decision reversed. Correct? Thank you.

    Mr.Ginsberg I had my hearing today and when the judge asked the vocational expert if there was any work I could do she said things like janitor light duty caferteria worker light duty n a couple more but when he asked abt if it would be okay for me to miss 10 or more days of work a month due to my Bipolar ,Ptsd,and Gad she said no.I was applying physical for disc herniation n mental.Whats your impression?Thx

    Flyids around my heart
    Splite upper abdomen muscke that need surgery
    And my frbro has becone so chronic
    The docter in italy at pain clinc put me on morphine .the pain is real

    I have recently applied for SSDI after years of trying to push through my multiple disabling issues. It has progressively gotten worse this past year and in March I’ve become completely unable to work and my employer which is a physical therapy office had suggested I apply for SSDI. My question is in your opinion do you think I have a strong case? My condition stems from a connective tissue disease called Ehlers Danlos Syndrome, it causes frequent painful joint dislocations, multiple herniated discs in neck and lower back, migraine headaches, brachial neuritis, neuropathy down my arm from pinched nerves and moderate spinal stenosis in my neck. I have sciatic pain and I also have a heart condition diagnosed as Supra ventricular tachycardia and postural Orthostatic tachycardia syndrome, hyperthyroidism, Graves’ disease, IBS, colitis, GERD, hiatus hernia, esophageal ulcers, anxiety, I’m also having dysfunction of a major joint which would be almost all of my joints but specifically I’m scheduled for Ankle and foot surgery this fall and will need a second surgery following that. I have carpal tunnel and impingement of my ulnar nerve. I am at different doctors numerous times a week or month. I’ve tried so many different medications and am on quite a few strong meds for pain and my heart condition. I also suffer from insomnia and am also on medications for that. I’m still in the beginning stages of my application but in your opinion do you think I have a chance at being approved?

      Denise if your medical record is consistent with what you have written and one or more of your treating doctors will support you with a narrative report or a functional capacity evaluation then it does appear that you have a very solid case.

    I have a Long term problem dealing with my mental illness, does the statement have to be turned in prior to the hearing or can it be given at the hearing?

      Any written statement should be submitted at least 5 business days prior to your hearing.

    Speaking of Rheumatoid Arthritis, I've suffered from this chronic disease all my adult life. I have a long work history, close to 30 years. Just last year, I had a very bad flare up that caused me to stop working. I reluctantly applied for SSDI and was promptly denied. What happened? I meet the listing for inflammatory arthritis. I'm 47, not 50, so I don't meet the grid rules, but I thought my age might be close to not making it much of an issue. What am I doing wrong?
