    Brother Yusha Evans said in one of his lectures that no matter how advance the DNA testing method is, the result will never be 100% match.

      saying stuff like this makes you look like a idiot and undermine both science and islam. DNA testing is more Qati'i then 4 witnesses' or any proof like that. but that is precisly its problem, its too easy to convict people with it, shariah isn't to mindlessly convict people.

    Even if the DNA testing was 100% proof that a child is not theirs, It can't be used for a case of infidelity, as it is easy to claim a case of being forced.

    Off topic question: What if the woman is raped, how is she brought to justice in Islam when she has to produce 4 witnesses. Since 4 witnesses are very difficult to produce in the case of rape.

      Here she doesn’t have to prove with four witnesses that she was attacked sexually (without claiming that this person did zina even though it’s understood). She can assert that she was attacked in front of a judge and if she has enough evidence from either two witnesses or other strong, substantial evidence than the judge can move forward with prosecuting and punishing the one who did this heinous act. There’s definitely room in a court of law for them to prosecute if there is other evidence, even if they aren’t eyewitnesses. And this person would be subject to the punishment of highway robbers, which is very severe.

      Even CCTV can be useful. Outside Sharia it is the same manner, it is difficult to provide multiple eyewitness accounts. Even if you bring one the kuffar question its authenticity and even at times slander the witness.

    Assalaamualaikum, the Yemeni haba’ib of the house of Ba’alawiyyah don’t have the same Y-DNA as Arabs/Semites despite claiming descent from the Prophet sallallahu alayhi wassallam. Do we stick to the fact that their ancestor’s claim to being descended from ahl al bayt is unfounded or can we strengthen our argument with the DNA results like some people do?

      I’m sorry, but I think their website is next to useless when it comes to registration. Most people do it when they get here in person. Yes, it is annoying, but this is how Egypt works. Paperwork is never easy here.

    You have to take the changing circumstances into consideration. Today, in the W3st and even in many Muslim societies like Morocco or Tunisia or Turkiye, a sane Muslim cannot assume that the woman is like traditional Muslim women in their chastity.

      Without a doubt there are changes, but it doesn’t mean that we’re now allowed to go suspecting or running our mouths about any individuals. And just because a matter happens, doesn’t mean that it needs to be made public and only if it is made public, will it then be addressed in such a way.

We can run our mouths internally, or say in general terms that yes, women are most likely 304s without being specific to an individual. Do not fall into the trap of enabling the xual revolution liberation by granting them free and undeserved chastity cards. Take into account the side of the man and the burden and shame and losses that come with marrying these types by assuming the best. The shubhah of Zyn4 is enough to blemish the character. 'Dating' is enough proof, and we don't need to see the actual act to advise a prospective husband of the morality of the future 304 wife.

      This is from an actual lecture that was in shortly before these videos popped up from that ignorant fool that tries to monopolize azhar to just his train of thought.
      If you know Arabic, you wouldn’t be able to hear the professor here, warning people from talking bad about other scholars of Islam such as ibn taymiyah even if we disagree with them.
      And to be honest, the person who was speaking is extremely ignorant, and the more he speaks the more it becomes clear. He was given positions of authority, and that only proved to be more of a fitna for him

      Yes, it shouldn’t be talked about or spread about people unless it’s for the purpose of advising privately someone who needs to know. It’s sad to see that a ton of people spread this online and even if this matter is as they say it is, we’re not allowed to talk about it as such unless we have four eye witnesses seeing the act.
      عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ:
      “أَتَدْرُونَ مَا الْغِيبَةُ؟” قَالُوا: اللَّهُ وَرَسُولُهُ أَعْلَمُ. قَالَ: “ذِكْرُكَ أَخَاكَ بِمَا يَكْرَهُ.” قِيلَ: أَفَرَأَيْتَ إِنْ كَانَ فِي أَخِي مَا أَقُولُ؟ قَالَ: “إِنْ كَانَ فِيهِ مَا تَقُولُ فَقَدِ اغْتَبْتَهُ، وَإِنْ لَمْ يَكُنْ فِيهِ فَقَدْ بَهَتَّهُ.”
      Translation:
      Abu Hurayrah (رضي الله عنه) reported that the Messenger of Allah ﷺ said:
      “Do you know what backbiting is?” They (the Companions) said, “Allah and His Messenger know best.” He said, “It is to mention something about your brother that he dislikes.” Someone asked, “What if what I say about my brother is true?” He replied, “If what you say about him is true, you have backbitten (ie gheebah) him. But if it is not true, then you have slandered (from buhtaan) him.”

    I think the reasoning should be approached in this manner.
    Juristically speaking, Allah has ordained that adultery can only be established by witnesses, since the Qur'an only mentions this condition, therefore this is specific ( خاص) and all other methods have no capacity to establish infidelity.
    An approach using usūl ul fiqh is better than critiquing the DNA imo.

      The main point of this video is not necessarily to talk about the how in this particular issue, but rather to look at the wisdom behind it.
      There’s a big principal when it comes to punishments, and it’s that we only apply them when it absolutely has to be applied, and anything that can be an excuse for not applying them, then we take it. So we don’t do any extra reasoning for proving something when it comes to applying a punishment, and we stop exactly where we have textual evidence and don’t go any further than that.
      ‫لَّوۡلَا جَاۤءُو عَلَیۡهِ بِأَرۡبَعَةِ شُهَدَاۤءَۚ فَإِذۡ لَمۡ یَأۡتُوا۟ بِٱلشُّهَدَاۤءِ فَأُو۟لَـٰۤىِٕكَ عِندَ ٱللَّهِ هُمُ ٱلۡكَـٰذِبُونَ﴿ ١٣ ﴾‬
      • Sahih International:
      Why did they [who slandered] not produce for it four witnesses? And when they do not produce the witnesses, then it is they, in the sight of Allāh, who are the liars.
      An-Nūr, Ayah 13
      So in this, we can see that this is the only way.

      Yes Legally ( Shariah) Speaking , however this only means that if one's spouse isnt caught doing the deed by 4 witnesses hence the punishment for such a crime not liable
      However your missing the key point of the argument, what the DNA test proves is your childs perternity ( which islam also ensures through the iddat period if the male spouse dies) so lets make one things here perfectly clear the punishment for adultry and perternity are not related issues in the shriah
      It just happens to be the case that if your married to someone in todays day and age and you have 5 kids with your wife and due to some reason you find out that are not the biological father of one of your kids , it can indicate that your spouse has not been faithfull.
      its just happens to be the case that shariah only accepts eye witnesses for punishment of adultry not preceeding and post ceeding evidences
      Furthermore there are many out-lining issues that your conclusion doesn't cover
      e.g
      1) if wife cheats but the perternity of the children still pretains to the husband
      2) etc
      AGAIN PUNISHMENT IN SHARIAH BOUND BY STRICT CONDITIONS BUT STILL THINGS CAN BE TRUE EVEN IF THE CRIMINAL IS NOT LIABLE TO PUNSIHMENT
