It is quite concerning when the first officer tells you that the use of section 43 in this case would be patently illegal and a few minutes later a second officer in the presence of the first invokes section 43 and violates your rights. Even worse in my view is that the first officer did not stop the second officer from performing what was a known illegal act. The fact the first officer did not even attempt to dissuade the second from doing so is baffling. It makes one wonder just how unaccountable are the police in the United Kingdom and why they continue to remain unaccountable to the citizens for these violations of citizens lawful rights. Others rightly pointed out that mi5 and other security forces protecting the sensitive buildings in that area undoubtedly used facial recognition on you. Obviously, they did not get any hits or you would have been arrested on the spot. With that being the case, the use of section 43 would have been doubly illegal on its face. The first officer said section 43 use was illegal in your case and facial recognition checks undoubtedly backed his opinion up. Either filming in public is legal or it isn’t. Either you are legally required to identify or you are not. There is no he’s causing trouble, he’s trying to provoke officers, what does he expect filming sensitive sites… He is a citizen and in fact a well known citizen with more than 100k followers acting well within his rights under law and when citizens are doing so they have every expectation of being left alone to do so. Old Bill can ask a question and they can observe only to the extent that they find themselves unable to articulate a crime was committed. Final point, Old Bill was tracking you on camera the entire time. London is the second most monitored place in the world behind China, who has the largest facial recognition system in the entire world. Security forces knew well before they approached you that no crime had been committed. This is not some rural area we are talking about. So either the monitoring systems are inadequate and the citizens of the United Kingdom have been sold a bill of goods or they work well so citizens shouldn’t even be approached by Old Bill since they’ve already been electronically vetted. What they cannot do is violate citizens rights, put their hands on people, arrest or detain citizens when no violation of law can be articulated. Either the United Kingdom is a place of lawfulness or it isn’t.
Well they're highly trained anti terrorism police. The way they got the information they wanted of him (his phone) was one of them played the bad cop and one of them played the good cop. And done it very well. Played into his brain, the bad cop was mean and told him the risks if he didn't show them his phone and the good cop was very polite and acted like his friend. I find this whole thing fascinating. The terrorism act used against someone publicly and openly filming seems stupid even by the logic of those using it. We live in an age where you can buy so many high quality hidden recording devices that just being in the area would then be suspicion of recording. Did they lay hands on you and search your person? This is an important point if they did or did not. In this case I would say it is better for them if they did search you, if abusing their powers anyway why not go all the way. If they didn't search you, that shows that they never actually suspected you were a terrorist to begin with. Which is what they have to have at a minimum to use 43 and search you or your stuff in the first place. Be honest. What cop anywhere would NOT search someone they really believed to be a terrorist? None. Every last one would do so in a heart beat. These guys did not think you were a terrorist. He threatened you with the use of powers to get compliance and abused those powers when you refused. I do hope you persue this further, including litigation when the police inevitably blow off your complaint.
The best thing is AB always goes prepared: no ID nothing which would lead them to his name , no vehicle etc. He assumes that every time auditing they could search him.
I've watched a couple of your videos now and noticed that for some reason there seems to be no officer in charge of the incident in many cases. This is a prime example: First the guy with the short beard is the one talking to you, then comes in the guy with the long beard and in the end the gray-haired officer who hasn't been involved much before (just briefly said a few words) decides to detain you and force you to show the footage, after long-bearded guy had told you he wouldn't do that and both beards had said you were not detained. Is this common procedure in the UK? One cop lets you go and five metres away another one detains you for the exact same suspicion?
Section 43 needs to be looked at, police seem to be using/abusing it far to often for photographers just to get their own way. The bearded cop blatantly lied to you, saying it would be illegal to use section 43 then all of a sudden it was ok because his colleague said so. And they wonder why the public have lost faith in them 🙄

Well AB, you're now in the system. MI5 (Home Office "Military Intelligence" Security Service) obviously called out the Met armed response team after viewing you on multiple cameras. An enhanced camera image would then be checked with the DVLA database in Swansea and linked to your driving licence image, so they probably already had a good idea who you were. They could then pull your car insurance details and log your car reg number and would be able to track your car via the TFL camera system all the way out of London. Actually, there are currently over 1,000 TFL traffic cameras in and around London and Camera Ref 4327 (Cam No.234 Millbank) would have picked up your interaction with the response team, while Camera Ref 6501 (Cam No.497 Parliament Sq) would have picked up your interaction with the rude WPC who told you to "Keep Walking". You're never alone in London.:-)

@@leathleyg5995 Can you point me to where the list of protected buildings is, in the TACT (2000 or 2006). I don't think there is, but am happy to be pointed in the right direction. Sec 58 legislation, as far as I am aware, offers no extra protection for cetain buildings.
I have previously stepped in and told you the police treated you badly. In this instance I think the police demonstrated complete professionalism and diligence and should be congratulated for doing the job decent people expect them to do. You on the other hand are completely unrealistic regarding the risks to public safety and need to take your head out of your backside.

So it doesn't cost obviously until you get fined at court. You can easily defend your actions and the unjust actions of the police on the street in these circumstances by knowing 5 pieces of the law and the PACE codes of practi, it's not difficult.

I’m curious, what difference would it have made if you had filmed the cameras, as far as I’m aware filming cameras is still not illegal. I myself, would have Ben extremely tempted to tell them this and inform them that if they continued on this course I would return and film the cameras and then done that.

Is there a way you can lock out your phone before handing to them? or maybe record your videos to a protected file where a password is required to open and view? Seems Sec 43 covers a wide berth when abusing personal rights.
The danger is that if they don't get to see the images, they may just end up seizing it anyway to search at their own convenience. So it's a decision the auditor has to make. Show the images, or risk having the camera/phone seized.

The biggest loss to UK policing was the requirement of a degree to become an officer..... Something a 35 year old military veteran has no intention of doing. The result is lefty, university indoctrinated officers that prefer to to police feelings instead of crime.

@@16MXD I would respectfully disagree. Day by day our rights & freedoms are being eroded. “Your safety & security” always being the excuse used. The patience, courage & self discipline AB used was exemplary, and while that may have provided those officers with some “inconvenience” and a not inconsiderable amount of cognitive dissonance, it was their choices which prolonged and escalated the situation, led to the rights infringement and no doubt the consequences (personal & professional) which will ensue. If nothing else, this will give those officers pause for thought about their conduct & the importance & fragility of the rights they are supposed to defend & uphold.
Tbh you can see why these guys are the ones trusted with firearms. Very calm and collected. Clear explanations. No sarcastic or childish comments. Surely there are different sides to this interesting vid? These police, especially the one with the beard, appear to be highly trained, patient and polite and a cut above the average coppers or deputized low IQ traffic wardens etc. They are trying to do their job of protecting an evidently sensitive location. Imagine if another person was filming but for terrorist purposes, and the police negligently stood by and ignored such gathering of information, and it was later shown that an incident could have been avoided if they had questioned appropriately. My guess is that the police were able to ID you even though you exercised your rights to not give such info. What would be ironic is if your efforts to successfully exercise your rights exposes vulnerable security blind spots which causes the system to further tighten up laws due to the exposing of such security issues... Treading on such thin lines can go either way.

If the building is so vulnerable that it's weaknesses are plainly visible from a public street, then they should be assigning resources to fixing that, not paying for 10 armed green beret cops in a van to waste 40 minutes negotiating with a guy with a camera.
He wasnt detained as he agreed to show footage then when they mentioned that they want to check whether he recorded protected entrances and cctv locations he wanted to run away like a chicken, so thats why they eventually were forced to detain him rightfully to check the camera footage

He kept asking is he free to go and did not watch to show footage or stop recording but he had little choice. Incorrect. Section 43 of the terrorism act with reference to photography. Police are allowed to stop and search members of the public if they have reason to believe that the material they have captured can be used for terrorism. Due to pointing his camera blatently at security and entrances/exits they had reason to believe. The stop and search allows them to view material captured and if they believe it is related to terrorism seize the device. No deletion of content can be requested unless court ordered. Police responded textbook to AB
Great video and I've enjoyed many others of yours, however playing devils advocate here what if they seen someone recording a sensitive area but didn't challenge them, then only for the same person to go back the next day and carry out a terror attack? How should they deal with that?
Bloody hell man. I thought they needed a warrant for your phone. That was something else. Two out of three of the officers didn't want to search you or question your rights. I don't think the man with the beard was very happy that his colleague was going against what he had already promised. He really didn't want to go back on his word. If you were simply walking by and took some notes, would they demand to see those notes? And if so, what would prevent you from scouting the building, remembering the locations of whatever bullshit they say is secret, and simply waiting until you are alone to record it? If that is a punishable offense, then they would have to stop and interrogate everyone in the immediate area of the buildings whose exterior apparently holds important State information!

Recording makes all the difference. These were not normal coppers as you said, these looked like DPG. But this is the difference between well educated, well trained, non-combative Police, who know their job are good at their job and have no personal chips on their shoulder.

It is quite concerning when the first officer tells you that the use of section 43 in this case would be patently illegal and a few minutes later a second officer in the presence of the first invokes section 43 and violates your rights. Even worse in my view is that the first officer did not stop the second officer from performing what was a known illegal act. The fact the first officer did not even attempt to dissuade the second from doing so is baffling. It makes one wonder just how unaccountable are the police in the United Kingdom and why they continue to remain unaccountable to the citizens for these violations of citizens lawful rights. Others rightly pointed out that mi5 and other security forces protecting the sensitive buildings in that area undoubtedly used facial recognition on you. Obviously, they did not get any hits or you would have been arrested on the spot. With that being the case, the use of section 43 would have been doubly illegal on its face. The first officer said section 43 use was illegal in your case and facial recognition checks undoubtedly backed his opinion up. Either filming in public is legal or it isn’t. Either you are legally required to identify or you are not. There is no he’s causing trouble, he’s trying to provoke officers, what does he expect filming sensitive sites… He is a citizen and in fact a well known citizen with more than 100k followers acting well within his rights under law and when citizens are doing so they have every expectation of being left alone to do so. Old Bill can ask a question and they can observe only to the extent that they find themselves unable to articulate a crime was committed. Final point, Old Bill was tracking you on camera the entire time. London is the second most monitored place in the world behind China, who has the largest facial recognition system in the entire world. Security forces knew well before they approached you that no crime had been committed. This is not some rural area we are talking about. So either the monitoring systems are inadequate and the citizens of the United Kingdom have been sold a bill of goods or they work well so citizens shouldn’t even be approached by Old Bill since they’ve already been electronically vetted. What they cannot do is violate citizens rights, put their hands on people, arrest or detain citizens when no violation of law can be articulated. Either the United Kingdom is a place of lawfulness or it isn’t.

I find this whole thing fascinating. The terrorism act used against someone publicly and openly filming seems stupid even by the logic of those using it. We live in an age where you can buy so many high quality hidden recording devices that just being in the area would then be suspicion of recording. Also, surely recording cameras cannot be any different to recording anything else in public view. Surely ultra high sensitivity buildings also have hidden cameras also? Did they lay hands on you and search your person? This is an important point if they did or did not.
In this case I would say it is better for them if they did search you, if abusing their powers anyway why not go all the way. If they didn't search you, that shows that they never actually suspected you were a terrorist to begin with. Which is what they have to have at a minimum to use 43 and search you or your stuff in the first place.
Be honest. What cop anywhere would NOT search someone they really believed to be a terrorist? None. Every last one would do so in a heart beat. These guys did not think you were a terrorist.
He threatened you with the use of powers to get compliance and abused those powers when you refused. I do hope you persue this further, including litigation when the police inevitably blow off your complaint.

I've watched a couple of your videos now and noticed that for some reason there seems to be no officer in charge of the incident in many cases. This is a prime example: First the guy with the short beard is the one talking to you, then comes in the guy with the long beard and in the end the gray-haired officer who hasn't been involved much before (just briefly said a few words) decides to detain you and force you to show the footage, after long-bearded guy had told you he wouldn't do that and both beards had said you were not detained. Is this common procedure in the UK? One cop lets you go and five metres away another one detains you for the exact same suspicion?

There are no 'exemptions' surrounding the use of section 43 powers, as far as I know.
Well AB, you're now in the system. MI5 (Home Office "Military Intelligence" Security Service) obviously called out the Met armed response team after viewing you on multiple cameras. An enhanced camera image would then be checked with the DVLA database in Swansea and linked to your driving licence image, so they probably already had a good idea who you were. They could then pull your car insurance details and log your car reg number and would be able to track your car via the TFL camera system all the way out of London. Actually, there are currently over 1,000 TFL traffic cameras in and around London and Camera Ref 4327 (Cam No.234 Millbank) would have picked up your interaction with the response team, while Camera Ref 6501 (Cam No.497 Parliament Sq) would have picked up your interaction with the rude WPC who told you to "Keep Walking". You're never alone in London.:-)

I was thinking the exact same thing what is the issue with filming a camera?
Because if this was hostile surveillance eg. terrorists, serious and organised crime or surveillance gathering by unfriendly or potentially hostile states the location of security/CCTV cameras can be significantly important as well as the building layout etc. This could, if used for such reasons threaten the Security Service (MI5) which plays such a vital role in the National Security of the United Kingdom. I am very much a supporter of our freedoms which is why I understand the high level of security around both these buildings (MI5 & MI6) who keep this free country safe. The danger is that if they don't get to see the images, they may just end up seizing it anyway to search at their own convenience. So it's a decision the auditor has to make. Show the images, or risk having the camera/phone seized.

Great audit AB you remained composed and stood up for our rights. Despite these guys being very reasonable with you (in particular the bearded cop) I still think they shouldn’t have used section 43 which ultimately you had to give up your rights and that isn’t on.
Sensitivity of a building does not come before a human beings rights. I could pull up Google Maps hit street view and look at those cameras.

The patience, courage & self discipline AB used was exemplary, and while that may have provided those officers with some “inconvenience” and a not inconsiderable amount of cognitive dissonance, it was their choices which prolonged and escalated the situation, led to the rights infringement and no doubt the consequences (personal & professional) which will ensue.
If nothing else, this will give those officers pause for thought about their conduct & the importance & fragility of the rights they are supposed to defend & uphold.

Surely there are different sides to this interesting vid? These police, especially the one with the beard, appear to be highly trained, patient and polite and a cut above the average coppers or deputized low IQ traffic wardens etc. They are trying to do their job of protecting an evidently sensitive location. Imagine if another person was filming but for terrorist purposes, and the police negligently stood by and ignored such gathering of information, and it was later shown that an incident could have been avoided if they had questioned appropriately. My guess is that the police were able to ID you even though you exercised your rights to not give such info. What would be ironic is if your efforts to successfully exercise your rights exposes vulnerable security blind spots which causes the system to further tighten up laws due to the exposing of such security issues... Treading on such thin lines can go either way.

He kept asking is he free to go and did not watch to show footage or stop recording but he had little choice. He wasn’t going to willingly show which is why he forced them to exercise the little power they have in this circumstance. Police are allowed to stop and search members of the public if they have reason to believe that the material they have captured can be used for terrorism. Due to pointing his camera blatently at security and entrances/exits they had reason to believe. The stop and search allows them to view material captured and if they believe it is related to terrorism seize the device. No deletion of content can be requested unless court ordered. The police officer with the beard i think did a great job handling the situation and is a true asset to the Met police force.

Recording makes all the difference. These were not normal coppers as you said, these looked like DPG. But this is the difference between well educated, well trained, non-combative Police, who know their job are good at their job and have no personal chips on their shoulder.
I think you are looking for trouble there, what would you do if someone was filming your property like that, and i know that you gonna say its public property but still its doubious.
