The laws in Utah, Colorado and other states with big ski industries give resorts near complete immunity from suit unless a resort is clearly negligent, and then there are low caps on damage awards. So if the Utah skier in this story here ducked a boundary rope and went out of bounds as indicated, his estate won't even find a lawyer willing to try suing Snowbasin because it will be a waste of time.
The media needs to understand that using the phrase "staying within the safe zones" is not helping. Even though you may stay within the boundaries of a ski area there are still significant risks including conditions that can take your life. Don't turn your brain off just because you are within the boundaries. Ski areas/resorts take measures to mitigate risks but it is impossible to eliminate then.

Go ski in Europe. There may or may not be signs and ropes marking every patch of ice out there. Or marking a thousand foot cliff. You just actually have to be aware, alert and responsible for yourself. It’s just skiing. It isn’t rocket science. Ski areas in the US spend millions on insurance, when they should just be able to say “ski at your own risk” and be done with it. 🤦♂️

Yes, a closed area within resort terrain is definitely off limits, but any area outside patrolled terrain is wilderness or backcountry. "Out of bounds" is inappropriate terminology.

he fell in bounds? there's a tram that goes to the area he was in. he just decided to hike around "Out of bounds" and then ski a chute he had no business on while everyone watched from John Paul lodge.
It’s our choice to do the things we enjoy. No one should be allowed to make those choices for us even if they are deadly. As they say “My body my choice”.
Go to the Alps where the mountains are much bigger & steeper & there are no ropes to duck. People & these resorts need to just stick to personal reponsibility & stop being such sissies everytime something bad happens. It's life, there's risk.
"Raises concerns"? Maybe for non backcountry skiers. We dont travel into those zones with safety and rescue equipment because its safe. The dangers are known.

I lived in Reno NV back in the mid 90's. Every year the same warning was repeated. Let someone know where you're going, don't go off by yourself, take water and snacks in your pockets. And every year they were looking for someone. 🤔

There is no such thing as "out of bounds." There's patrolled terrain & unpatrolled. Just like the ocean has designated beach swimming areas with lifeguards & most other areas with no lifeguards, crazy shore breaks, rip tide, undertow, rip current, jagged rocky boneyards, not to mention the ubiquitous marine creatures anywhere & everywhere that can hurt humans.
No there is absolutely an out of bounds when you purchase a ski pass and use the lifts to get up the mountain. Once in the ski area, you are expected to abide by the established boundaries and if the ski area allows it, leave it at designated backcountry access points. In Colorado this is now punishable by law in the form of fines and jail time in addition to loosing your pass. Other places it's less defined but you can still get in a ton of trouble with the law, Utah included. The thing most people don't realize is ski patrol, search and rescue, county sheriffs, they all work together, and are often the same people wearing different hats. They also have to take a hard line approach sometimes. Tourists and novices often think they are above the rules or they just don't understand the extreme risk, so they need the additional threat. The backcountry is never closed per se, but there are specific rules regarding using the ski area to access it. For good reason, people put thier own lives at risk every time there is a serious backcountry rescue... or body recovery. Most people don't consider the nuts and bolts of a job like that, it can be extremely dangerous, and they don't get paid enough.

If you are "wilderness" because you are outside of the boundaries of a patrolled resort then yes, you'd still be out of bounds. Nobody that skis this stuff ever thinks that way, but snot-nosed kids that become pros by watching RUclips videos sure do. So yeah, when I'm hiking up and backpacking a chute in one of the cottonwoods, I'm out of bounds. LoL! 😂
