Today October 2024 visa bulletin is out, I am eagerly waiting for your explanation why the EB1 final action dates are not moved though it is the first month for fiscal year 2025. Your prediction was close to current.
EB1 India is unlikely to become current even by the end of FY 2025 and may only reach November 2022 at most by then. My lawyer's prediction aligns with Mandar's, but I don't believe EB1 India will become current with the release of new numbers. I think the October Visa Bulletin might show slight movement, possibly reaching June-July 2022. USCIS has been very cautious with their recent movements and, for some reason, they are hesitant to move dates beyond 01 Feb 2022.

I think the national quota is not applicable when the ROW is current (from a reddit post). So, maybe Mandar is right and we may have a substantial upsurge in EB1 for Indian applicants.

That is a fact for most part so why bother. Elections can also impact PD movement.

Mandar, Why can't you predict EB3?. Based on the 485 Inventory for EB2, 2012 has 5471 and Approved so far is 3000, remaining pending is about 2474, so EB2 will move up to Jan 2013. Where as EB3 still have 601 Pending for Year 2012 and 5136 for 2013. EB3 will Move up to July 2013 with no FB spill over.
A few of my friends have an October 2014 EB2 priority date. Yes, we are planning to downgrade to EB3 after the October visa bulletin. Keep both eb2 and eb3 options open

Basically 2012 for India any EB category will be current from oct onwards. 2013 will take 2-3 years to be current, and 2014 will take another 2-3 years after that.
So, in April 2020, the priority date for India was backlogged by about five years to May 2015. Then in April 2021 it gets current. Then in Aug 2023 it gets backlogged by more than ten years and now it is backlogged by 2.5 years. This backlogging and getting current has been constantly happening. Why?
Based on the data that USCIS provide EB2 have 5979 pending i485 till end of 2012, so it is expected to move in 1-2 months max & EB3 has 3153 pending i485 till end of 2012, so we can expect it to move 4-5 months minimum in 2025 & EB1 has 5427 pending till end of 2021 so it's not going to be current any time soon and they 11087 pending I485 application in 2022 alone.

So about 4k from 2012 will be pending and there will be upgrades and downgrades. So I think Mandar is right in expecting 5-6 months (end of 2012) movement. As of now, the date remains at February 2022, and I presume the backlog has likely increased. Given the allocation of 165,000 green cards for the upcoming fiscal year, with 28.6% earmarked for the EB1 category and 7% of that designated for India, approximately 3,300 visas might be available for Indian applicants in the EB1 category. Based on these figures, it appears that there is no way EB1 will be current for Indan applicants in Ocotber. Am I wrong here? I hope I am.
@@piyushashah1 it is difficult to predict as reports are either old and cannot predict porting's. but my guess is that best case, final action date can move to somewhere July 22. May not reach Dec 22 the whole of next year, but filing date will move as USCIS do not have any new application beyond Dec 2022.

Do you really know how much time consuming process either to downgrade or upgrade and switching lanes for the sake of dates. Ultimately both EB2 / EB3 move in parallel. Dont cause more panic for EB immigrants by suggesting speculating things. If you are accurate in prediction atleast put some excel with math calculations using probability methods (if you are expert) rather voicing out.

You should definitely plan a different course of action, best case even if the filling date gets to June-25 - you may not get EAD and AP so early as it took more than 10-12 months for me
Mandar - the Sept visa bulletin does mention the total number of visa available for 2024. It is at the bottom of bulletin and says Worldwide Family-Sponsored preference limit: 226,000 Worldwide Employment-Based preference limit: 160,791

I will be very glad if it moves one full year for Indians, but I dont think it will happen, there are 10000 pending applicants and only 3000 visas.

There will be lot of downgrades to eb2 to eb3 , may be thats the reason hard to predict.

You are missing the spill over from ROW India gets each year as India it the backlogged compared to China

@@desertwineuscis confirmed. There is no horizontal spillover for eb1 in the coming year. All eb1 visas of rest of the world 2024 used

It would spill over to most backlogged country which is India, and ROW spillover has to be within the same fiscal year.

My PD is Feb 11th, 2022 under EB1. Tired of waiting 😢
Mine was Feb 17, 2023 under Eb2 and luckily it became current in July visa bulletin, i hope your’s will be current soon too
