    This video really should mention discrimination arising from disability explicitly. I know it’s a complex law but it’s so important for disabled people who are constantly fighting against the altitude ‘we’re not discriminating against you if we’re treating you the same.’
    It’s supper important especially for individuals with hidden disabilities like autism who might, for example, get banned from a shop for having a meltdown.
    There just isn’t enough awareness that this sort of thing is discrimination and it seems to me you just missed an opportunity to help fix that.

    Why is class not a protected characteristic? Working class people are regularly discriminated against

    • @c0d3w4rri0r
      @c0d3w4rri0r Месяц назад

      I think partially because it’s very difficult to define what class is. There is a part of the equality act called the public sector social economic duty which requires the government to have special consideration to the economic and social status of individuals and attempting to avoid discriminating against them. The thing is this part of the act requires a special secondary instrument to be brought forward in parliament before it becomes active and the government has never issued such a statutory instrument. So the laws on this have never come into affect.

    I find it funny theres an equality law, but then theres companies and groups specifically hiring based on gender and race (minorities) in the UK, excluding british natives simply because theres more of them. Which means if youre a majority, you have to compete for a fewer amount of spots against more people. If youre a minority you have to compete for more spots against fewer people. Is this not discrimination? Intentionally letting companies and groups offer groups based on race more oppurtunity? REAL equality would be either looking at the demographics of the UK, for example 87% white people and 13% minority and making sure your company or group reflects that too, equal competion. OR just hire people based on their skill, not gender or race... If this this kind of double standard continues, what else is there left to happen other than more building discontent in the country. This is how Reform is building in popularity as it addresses these very things and talks about real change to an outdated way of thinking regarding equality (treading on eggshells around none natives and none standard genders).

      @c0d3w4rri0r Месяц назад

      Except its well-established in British caselaw that so-called positive discrimination hiring practices are illegal. Generally you can advertise that you are interested in minority candidates, you can make special efforts to try and make sure that more minority candidates apply for a job. But if you hire a minority candidate because they are a minority candidate and not because they’re the best person for the job generally speaking that’s breaking the law.
      And if you think you’ve been rejected for a job because they wanted to hire a minority candidate to look progressive then you might have a cause for a lawsuit if you want to bring one. Although I think in the case of job applications it goes to employment tribunal not the County Court?

    Nightclubs are "public services!?

    • @soranasanduu
      @soranasanduu 2 года назад +4

      Yeah, they’re public services that the public can use. They’re not protective services such a police etc, that’s different.

    • @c0d3w4rri0r
      @c0d3w4rri0r Месяц назад +1

      @frankbauer1397 The equality act applies to services in general not only “public services” like hospitals and schools. Your corner shop is considered a service, so all nightclubs and pubs. I think you might be thinking about so-called “public functions”? For example when the police arrest you I am not providing you with a service but it is a public function. Services and public functions are both regulated by the equality act.

    I needed to know about this because I have social anxiety disorder and depression but my place doesn’t care about my disability they think I am faking it and my manager always mocks my disability what shall I do?

    • @Vavala3534
      @Vavala3534 2 года назад +4

      I fully sympathise because social anxiety disorder can actually cause you to be unable to speak up or even to hold a conversation because of the overwhelming anxiety. People who suffer with this may go bright red or stutter in 'normal' situations. People who fully understand phobias such as a fear of heights or public speaking, most often do not understand social anxiety disorder and those suffering from it are seen as odd. It is a torture. If you have been diagnosed by your GP, make sure that this diagnosis is recorded in written form and submitted to HR or management at your workplace. Consult the anti bullying policy in your workplace, get advice from your union representative if you have one, and keep a diary, recording every instance that belittles you or makes you feel uncomfortable in your workplace. You may be able to get more advice from specific helplines or citizens advice. I'm just throwing out some ideas. Good luck with improving your situation.

    Wait so you are saying that banning the afro hairstyle is racist?

    • @c0d3w4rri0r
      @c0d3w4rri0r Месяц назад

      @robinpopps189 It would depend on the context but potentially yes. Obviously black people are more likely to have an afro. It could be indirect discrimination to ban them. But indirect discrimination can be justified if it’s proportionate. The question would be could you actually construct a reasonable justification for banning an Afro.

    • @robinpopps189
      @robinpopps189 Месяц назад

      @c0d3w4rri0r yes. Depending on the size of the afro, wearing protective head equipment such as helmets and working in the food industry as a chef or anyone else who prepares food. Its more common sense than anything else. On the other hand though, the perfect job for someone with an afro would be a Bob Ross impersonator

    • @c0d3w4rri0r
      @c0d3w4rri0r Месяц назад

      @robinpopps189 exactly those maybe examples where maybe you could justify banning an Afro. But say you’re talking about a child in school and the school thinks that Afros are untidy or don’t look good with their school uniform. This is a lot harder to justify. A lot of the equality act is very contextual. What might be legal in one context can be illegal in another.

    This is utter nonsense. This act discriminates against native white Britons, effectively marginalizing the majority of the population in one go.
