What a great channel for help this information is priceless .I'm in the midst of a small claims file and yesterday I just noted the defendant noting in default. Its for the max amount.im still confused since I online filed and I don't understand why I wasn't asked to pay the 89.00 for noting in default yet I have a copy from the website that says the defendant is in default.Im in step four and that's where it's interesting
Can documents (plaintiff’s claim, etc.) be served by registered mail to defendant’s mailing address or do we need to send process server to physically serve documents also?
Assuming that this relates to a civil action in Ontario, the court rules regarding the service of documents are quite specific and you must follow these. Specifically, Rule 16 deals with the service of documents - see www.canlii.org/en/on/laws/regu/rro-1990-reg-194/latest/#SERVICE__148668 I am intending to do a lecture on service of documents next, as i believe the topic is important.
Hi...Can you tell me if a counter claim verbal witness in a small claims court has to provide a written statement to the plaintiff first....one would need time to go over what maybe said surely...
Witness statements are normally not required in Ontario small claims court unless one is only relying on a statement and not producing a witness for viva voce evidence (there are specific rules for this). Since there is no discovery process in small claims court, a witness's testimony at trial could be a little surprising at times. One can avoid such surprises by carefully reviewing the pleadings and documentary evidence.
They always say in Canada has human rights but I don't see is real. Thank you for your lecture. The small claim is up to $35,000 now. It has been changed.
I want to submit a claim but I do not have the address of the person. How Do I get this to serve them?
Follow them home! (Or to work...depending on personal or business-related claim.)
I'd love to know too
how to check status of my small court case in Ontario. I filed about 1 year ago.

Jocko: please type a SPACE after periods at the end of every sentence. It will improve readability of your posts! Thanks.
