First off, let me just say this was a great episode! Loved it!
Hit and runs can be either misdemeanors or felonies determined by how much and what type of damage occurred, but in this case where it was on a motor vehicle with an occupant who might have been injured this was probably a felony case and that guy should have been arrested immediately and BAC/Narcotics checks could be performed afterwards or at the station. Either way, what I'm trying to say is that guy should have been cuffed on the spot.
