This "man" is treating all of us like little kids, but he is the actual big baby himself, not understanding what is considered Fair Use is actually about. Let's say for instance I would do a parody of The Gallows and they said if you say Charlie in the theater it's bad luck and I would add the actors from Blackadder the Third (season 3), their Macbeth bad luck ritual, because it's funny and fair use. Making fun of the original.
Go to 99 Designs and look at the article he shows. In the _Cariou v Prince_ case he shows he has to specifically crop out the bottom portion of that section of the article because it reads, quote: "Update 4/25/13: Not two weeks after this article was published, the original decision in this case was overturned and the judge ruled in favor of Prince for the majority of works in dispute, claiming that Prince's work transformed the work in a way that it was aesthetically different, and thus acceptable under the argument of fair use."
So Mr. Savage's own examples included one where it was found to be Fair Use and he just cropped out that inconvenient detail.

(I know, I'm pretty late here, but still.) Is it just me, or does this guy somehow seems like a big...child? Y'know, naive, somewhat innocent, oblivious to a fault, can't realize his own mistakes, throws a fit over something he clearly doesn't understand (even though he believes otherwise).
I might be wrong here, but this guy seems pretty childish and immature in just all the wrong ways. Like some kinda sheltered, spoiled brat who doesn't really know how the outside world works, and thus fails a ton because of that ignorance. Again, could be wrong here, but that's how I think Derek was acting here. Hell, even Adum said something similar about the tone of his film, saying it had a weird innocense to it. So who knows, maybe Derek really is that way.

I know IHE shouldn't have made this as big a scene as he did, but it was probably a great thing to bring up the implications of Fair Use and RUclips's faulty system so more users understand. Though you didn't outline the Four Factors specifically, I think you basically said what you need to prove that Derrick has no hold over IHE's video and, essentially, he's masking his poor take on criticism with an abuse of power.

Can't say off-hand since his tweets are now protected, but as best as I can make out he had a bit of back-and-forth with YMS and Adam gave him some constructive criticism which Derek took on board, altering CCStK for its next release. For example the guy in the background who walks out of his house and then backs away is removed and Cool Cat now looks both ways when he crosses the road while chasing the bully.
He sounds like he's on the verge of tears constantly.
Everything about Derek's tone here just angers me. He just sounds so... condescending.

The same day this video was uploaded, Jim Sterling uploaded a video about some kind of new "Fair Use Protection Program" for RUclips partners. Apparently, RUclips is actually going to start providing legal backing to partners who are hit with spurious DMCA claims.
+Dr Shaym You have to acknowledge that google is in a pretty sucky position though. More content is uploaded to the site an hour than anyone could ever check. There's no shortage of infringing content on RUclips (songs, mainly) and people would looooove to sue Google for the $$$. So unfortunately you do have to take a protective stance, but it would be good news if they started helping partners deal with false claims.
+Dr Shaym I think this program is being a little misunderstood. Let me say how I interpreted the announcement. Essentially, what RUclips is going to do, is select specific videos that Google staff consider to be perfect examples of "Fair use". It'll then offer the content creator a million dollars in legal defense if a lawsuit is ever filed over that specific video, and also use that video and others like it as a thing to show companies EXACTLY what Google considers to fall within fair use.
Hakudohshi Haven't watched the video, but it wouldn't stop people filing false claims. Just because they file a claim doesn't mean they're going to start a lawsuit.

Until 1 1/2 years ago I used a laptop made from 2003-2005. I tested the difference between those browsers on there. IE loaded a RUclips video in under a minute. Chrome took 17 minutes to load the same video's page, the audio skipped and the framerate was awful throughout (even at 144p).
Comment on the fact he was recording his screen with an actual camera instead. That's a legitimately unprofessional thing to do, whereas using IE is looked down upon by people who've never had to make do with old technology.
