He's one of the reasons I decided not to become a lawyer. I can't in good conscience defend someone that I KNOW committed a serious crime like murder, and I can't prosecute someone I know is innocent. But, a defense attorney has to, by law defend his client to the fullest and try his best to get him off, even if you know he's guilty as hell! The same goes for the prosecution. Even if the evidence says the person is innocent, you have to do whatever it takes to send them to jail. Court has become nothing more than a stage with actors. When you go to law school, the better ones even send you to acting class. Trials are not about who is guilty or innocent, it's about winning or losing. It's a game. It's disgusting and sickening. I wouldn't be able to sleep at night knowing I either sent an innocent to jail, or set a murderer free to do it again. But, if your client says "yeah, I did it. But I want to plead innocent", then you have no choice but to try your best to get him off, by law. Otherwise, if it's found that you didn't try your best, you can go to jail. If you're going against an innocent person, you know damn well is innocent, but the DA says I want him to go to jail, you do your best, or you lose your job and will never work in law again.

I don't so much think of it in terms of blackstone's ratio, but rather that if it's okay for the courts to convict a guilty person on shit evidence then it makes it easier for them to convict an innocent person on shit evidence, which is unacceptable. Still, when you say it is better to let 10 child rapists go free than 1 innocent person to go to jail you suddenly find that not so many people agree with you anymore. The comment was more about societal hypocrisy than suggesting that our courts should give less preference to individual rights and due process.

bro, law is a man-made. like every other man-made stuff, it'll never be perfect. the justice system is imperfect but without it the world will crumble. at some point we have to make sacrifice, and that sacrifice is giving EVERYONE a chance at the trials. not guilty until proven so.

@dianabrennan8856 it is, and it's better to uphold the whole constitution than just the ones certain people think are worth upholding. Having the right to counsel is just as if not more important than having the right to bear arms. If you want one constitutional right that fits you and your narrative then you need them all.

Those are some forms of evidence defense lawyers use to get cases dismissed when cops violate the constitution or the law. No man is perfect and while i think most cops are good there are definitely corrupt ones who would break your rights to put you into a situation that they can escalate and cause you to commit a crime or admit to one that didn't occur.

as someone who is an aspiring criminal defense attorney, the whole point of defending is making sure your client gets a fair trial and that their rights are being protected not just let them be free (but ofc thats what every defense counsel wants).

You’ve seen how the most expensive attorneys are the most influential. All that money doesn’t just go to attorneys. Who’s ever paying this dude doesn’t have this country’s best interests.

@@PolitikPolitik-fh2qcit absolutely is, or as close to fair as you could realistically get. Prosecutors aren’t purely virtuous. If a defense attorney can get a guilty man off, a prosecutor can get an innocent man convicted. There’s no such thing as entirely impartial, but if the prosecutor is doing everything they can to get a conviction and a defense attorney is doing everything to avoid that conviction, that’s “fair.”

In what world does an attorney get paid because of the “country’s interest?” Could you even elaborate that dumb statement if you had to? It’s a profession, it’s how these people make their living. The “country’s interests” aren’t relevant to that concept.
