  • Charlie Roadman, an Austin criminal defense attorney, discusses the process of starting probation. The first step involves completing paperwork with an attorney, followed by filling out a probation intake form with basic demographic information and three references. After appearing before the judge, where a typical misdemeanor plea takes about 45 seconds, probationers meet with an in-court probation officer. This officer goes over about 40 conditions of probation, including prohibitions on alcohol and drug use, and provides a map of the courthouse and a probation assignment form.
Probationers are then directed to two locations: the tax room to arrange payment of court costs (usually around $500-$550) and the probation building for further processing. They receive a probation handbook, available for download on Roadman's website, which outlines general probation information. The first meeting with a probation officer is typically scheduled three weeks from the court date. In the interim, probationers attend an orientation session to review the handbook.
Roadman emphasizes five keys to successful probation: acting happy and cooperative, bringing a book for long waits, avoiding alcohol and drugs, asking for travel permission well in advance, and promptly completing classes, community service, and paying fees. He advises a compliant and positive attitude towards probation officers and reassures that he can usually resolve issues unless there are probation violations.

My case doesn't involve alcohol at all, neither have I ever sniffed a DWI or DUI and have never abused alcohol. Why can't I have a beer or 2 given the fact that im NEVER shown to have been a nuisance of any kind regarding it? Weed and illegal substances ofcourse is understandable, but why can't I have an ounce of alcohol ?
