Appreciate the comparison between direct and circumstantial evidence. One of the best explanations I heard last year when I started law school was: If it’s raining and you see it, that’s direct evidence. If you go outside and the ground is wet but you were inside with the curtains closed the whole morning so you didn’t see the rain shower, the wet ground is circumstantial evidence that it has rained. They worded it better than me though!
Juan Martinez in the Jodi Arias case said it’s like if you’re sitting at an empty beach and someone walks by. Then someone comes up and asks if you someone just walked by you can say yes I saw them. That’s direct evidence. Circumstantial would be if you’re at the beach by yourself just your foot prints and you fall asleep for a few mins. Then you wake up and there’s a second set of footprints. Thats circumstantial. Even though you didn’t see the person walk by you can still come to the conclusion that someone else had been there

And let's not forget he's wearing an ankle bracelet that tracks where he is at all times! "Would you like us to send this to the murder site for you, Sir?" What an idiot
Imagine having to tell a 2,4,and 6 year old that daddy killed mommy. Heartbreaking. And searching on his kids iPad. So sic. He put more thought into getting rid of a baddy than he did into what his children’s lives would become and the pain inflicted upon them losing their mom. Intent is clear.

Sometimes you watch a show and get curious like, "could Jesse really dissolve a body like that" Fine. Shows are interesting. Even a "Novelist" can't always get away with murder after "Googling" nearly the same exact questions... I recently watched a video of 'The Behavior Panel' channel who described an elderly woman's subconcious, involuntary physical and verbal reactions that showed possible deception... She's a novelist who was testifying in court on behalf of herself against the charges of murdering her husband... She too, had done searches on her computer that were incriminating, but said they were for the novel she had been currently writing... She was found guilty and is now serving her 25 - Life sentence in prison.
@@HollyMacNaughton I havent heard of the case. I was wondering what they do for authors or writers who search these up for murder mystery novels or crime novels.
I always enjoy your content and perspective on these cases, Bruce. An intelligent lawyer who is down to earth and hilarious. I bet you're a beast in the courtroom!
Same! I was writing a story and had to google like every single questions Googled in this video 😂 I wound up on a dark web website with a crazy amount of information.
But you can prove it's professionally, hopefully...😄 He was a fraud and an art dealer, he should have googled how to be honestly successful in his job or how to get a new one.
CLR, I am so blessed to have found your channel! I'm super excited to hear your podcasts. Your humor is fantastic, so many times I've belly laughed right along with you. I am here for the long haul. Please, keep 'em coming
At some point does the defense lawyer go "I cant do this this is too ridiculous" or are they actually going to try and say he was writing a novel or something as his defense
It would depend on the lawyer. Some would ethical lawyers would still represent this person to ensure that there is not undo burden on the person. An example would be lowering the charges to receive 6 years, instead of 20.
Everyone is defendable. A defense attorney does not HAVE to prove they're innocent. They have to protect the rights of the defendant and make sure that it's a fair trial. No matter how horrible the crime, everyone has the right to a fair trial.
Audio has a hum/hiss in back of this one, you can use a gate in the audio chain effects to cancel out sound below a certain volume to catch most hums or unwanted ambient noise (a gain or compressor is also great to keep the voice consistent in all videos), if it affects the sound or echo or ambience of the office or area, possibly position mic closer to Bruce (maybe even a lav mic) and/or ensure any fans, electronics etc. are not near or on if not needed. Some kickback from audio inputs loose or degraded can cause this too. Great channel.
I love how you qualified “unless you’re writing a novel” because as an aspiring novelist I have absolutely looked up common poisonous plants that are easy to find in the wild as well as countless murder cases. Unless you’re a novelist or you’re really into true crime, it’s unlikely you’ll be searching such things in your spare time.
I live in MA and when this story was reported I thought also this is one of the dumbest criminals. You search on your computer in your home for things involving murdering someone REALLY Cohasset is one of the most expensive places to live in MA. Another reminder bad things can happen anywhere. Thank you for your take on this case.
People who know him said he is way too calculated to be so sloppy. I think he killed her accidentally, freaked out and didn't know how to handle it. I wonder if his attorney is court-appointed.
The search history sounds like something that would be pretty normal in the writing community. 😅 But most writers' SOs aren't missing. And most of us probably don't use children's devices to search sensitive topics. It would feel wrong to run murder-related google searches on a child's iPad even for a fictional murder. For the murder of that child's mother? My word.
@@IoEstasCedonta Something like that! I believe it was more of an essay than a full book, and "How to Murder Your Husband" was written years before the actual murder.
@@bumblebaa2327 It does, doesn't it? But search histories are kinda a meme in the online writing community. People will post about their recent searches and say "No really, FBI/NSA/etc., I'm just a writer, I promise!"
Normally when you are writing a book the searches are spread overtime and include real cases, also some authors and crime enthusiasts use VPNs if they have children with access to their PCs, because they don't want little Jimmy or Jacky to incidentally click on an old search or for Google to do autocomplete/recommended something not for children.
4. If you attempt to dismember girl, say goodbye. You cannot beat cops with a hazy mind of evil that will slip you up on crucial mistakes. Example: Brian Kohberger

Ugghh it just gets me aggravated. Thank you Bruce for talking about this.
He thought of divorce but Ana had all the money and would most likely get custody of the children leaving Brian penniless because as you know MA is a no alimony state.
He thought about divorce plenty. The one she was demanding which would leave him broke. Come on man, learn SOMEthing about a case before posting a comment.

I search for things like that from time to time - most of the other writers I know are certain we're on a watchlist for our bizarre search history. Ex: stages of death. When does rigor mortis start. How long until human eyes begin to dehydrate after death? Followed by: Worst forms of torture in history. Natural poisons. Then there's that random one after, like: What size were Andre the Giant's shoes or what are the highest heels in the world?
“Leave the house for doctor’s appointments or to buy a murder kit”. That had a laughing. It’s a terrible tragedy but some things people do are so stupidly shocking. Very interesting content, thanks 🙏🏼
This is so sad for the kids. It would be amazingly wonderful if she were still alive, but it doesn't seem so... Bruce, you and your team are fantastic! Thank you.
I always laugh when people do in depth Google searches about the exact crime they committed or are going to. Why don't people understand everything can be traced?
@Boots may as well have searched "I Brian Walshe am wondering how to dispose of the person I murdered on (date) at (time)" Those searches make it that obvious

Great video! Not only is he a dumb criminal, but he looks as though he is not the sharpest tack in the box. I also saw that a few years ago her life was threatened but she ended up not following through with the charges. He’s estranged from his family and had supposedly been diagnosed as a sociopath. Yet she still married him. Love can definitely be blind.
While he's clearly not an attractive man, it's a shame she didn't get away when she could have. If someone defrauds people ( reason he had to wear a device), this is a person one can't trust. As a business coach once said, You can't make a good deal with a bad man.
Sociopath is not a clinical diagnosis. It’s possible he had seen a psychologist and was diagnosed with narcissistic or antisocial personality disorder, but that would require many months of therapy (which I don’t see this man doing) or clinical psych evaluations. In other words, don’t believe he was diagnosed as a sociopath just because someone said so online. It sounds very unlikely. Actual sociopaths often don’t come into contact with psychologists who could diagnose them.
Not only that- she wrote a heartfelt letter to the court in his art painting fraud. Saying he's a good man and a great father. It would be best if he could serve his confinement at home blah blah

Im at a loss.. by all accounts he seemed to be at least at or above average IQ, was very cunning (the art buyer he ripped off apparently has bought hundreds of rare and expensive paintings and was only ripped off one time in his career and that was by brian), and has been described with the ability to appear like a normal non crazy guy. Apparently, hes smart enough to know what hes projecting. As i said the art buyer he ripped off said he was extremely personable and accommodating etc. How could any rational person with an average or above average IQ. Not realize prior to the murder that hed be the primary suspect and law enforcement would likely do a thorough investigation which would include dumping his phones and computers etc and find anything he did or searched for online? He had to have known beforehand at least the basics of a murder investigation, and what it entails. Theres some screws loose in his gigantic round pumpkin head because he cant be that stupid. Someone who has trouble tying there shoes MIGHT, and i mean MIGHT make such moronic mistakes.
I had a little daydream about a woman framing her husband like that. She'd have to extract some blood for the hacksaw, but the Google searches and bag of belongings alone might be enough to nail the guy. He'd have to be home when the Google searches were done, and she probably couldn't get him buying the stuff at the store after the last time she was seen by anyone. His behavior in the face of the accusations would be drastically different though.
For the that don’t know what Warhols are. Bruce is talking about fake Andy Warhol paintings. That’s why he “the husband” and alleged killer was on the ankle bracelet.

She's a novelist who was testifying in court on behalf of herself against the charges of murdering her husband... She too, had done searches on her computer that were incriminating, but said they were for the novel she had been currently writing...
She was found guilty and is now serving her 25 - Life sentence in prison.
Jeez, she's called Nancy Brophy, everyone knows that case, ffs, why are you talking about it like no one knows that case? Weirdo...
@@HollyMacNaughtonwell I never heard of the case weirdo. Why would you assume everyone follows every case in the world.
@@HollyMacNaughton I havent heard of the case. I was wondering what they do for authors or writers who search these up for murder mystery novels or crime novels.

The stupid look on his face as the prosecutor is reading his searches.....priceless!
At some point does the defense lawyer go "I cant do this this is too ridiculous" or are they actually going to try and say he was writing a novel or something as his defense
Money is money. Same thing as a consulting firm taking on a sinking company-If they have the liquidity to pay, someone is going to take their money
They will try to get evidence thrown out or try insanity plea or any plea they can get the dumb criminal
It would depend on the lawyer. Some would ethical lawyers would still represent this person to ensure that there is not undo burden on the person. An example would be lowering the charges to receive 6 years, instead of 20.
If no lawyers would represent him willingly the judge would force someone to do so as otherwise it is not a fair trial.

I just came across this channel by accident and I've been hooked!!!
I live in MA and when this story was reported I thought also this is one of the dumbest criminals. You search on your computer in your home for things involving murdering someone REALLY Cohasset is one of the most expensive places to live in MA. Another reminder bad things can happen anywhere. Thank you for your take on this case.
He even researched how to dispose of a 115 pound body. Uh...wife was 115#...

Studying for the NJ Feb bar and Bruce Rivers is some of my best “productive procrastination.”
Bruce Rivers: "There's no good explanation for some of these searches."
True Crime Doc Addicts: *Sweats Nervously*
The search history sounds like something that would be pretty normal in the writing community. 😅
But most writers' SOs aren't missing. And most of us probably don't use children's devices to search sensitive topics. It would feel wrong to run murder-related google searches on a child's iPad even for a fictional murder. For the murder of that child's mother? My word.
reading out the search history with stamps and all does sound like a book. I'm lmao!
Wasn't there that woman who was shopping around a book called "How to Murder Your Husband" that described in detail how she'd murdered her husband?
What I've learned from this is:
1: don't hit your girl
2: don't dismember your girl
Never stop learning
3: if you are trying to dismember a girl, don't ask google what are the best methods
4. If you attempt to dismember girl, say goodbye. You cannot beat cops with a hazy mind of evil that will slip you up on crucial mistakes.
Example: Brian Kohberger
I live in Massachusetts too and hearing this was just sad and unbelievable that this man thought he could have gotten away with this. We also have another disappearance in another case but not too much info on that case.
But this Walsh guy yea...apparently he's never thought of a Divorce. You never know with people. Ugghh it just gets me aggravated. Thank you Bruce for talking about this.
He thought of divorce but Ana had all the money and would most likely get custody of the children leaving Brian penniless because as you know MA is a no alimony state.
He wanted that life insurance
He thought about divorce plenty. The one she was demanding which would leave him broke. Come on man, learn SOMEthing about a case before posting a comment.

Great episode, it highlights that no matter what you type on the web, type it as if a judge will eventually read it.

Such a beautiful person she was, truly a sad situation. What a terrible person to do that. Like you said Bruce , you can’t solve anything through domestic violence. Thanks for the break down 🤟🏼
Except that she probably wasn't. Getting killed does not make you wonderful in reality.
@@seriouscat2231”except she probably wasn’t”…..and you’re basing that on what exactly?
Nobody said that “being killed makes you automatically great in reality” because that’s just something that most people know without a Captain Obvious saying it. Plenty of evil people throughout history have been killed, sometimes quite violently. From all the available information on the Ana Walshe case, she was a normal person with a family, trying to raise her children, and get through life the best she could.

Love can definitely be blind.
looks like Mads Mikkelson if his face got ran over by truck tire.
What is wrong with the Americans it’s 2023 and you still leave it up to the victim to decide whether to prosecute someone for a serious offence ! How are you ever going to protect victims of DV !!! Change the law it’s 2023 not 1823 ! Make the victim compellable like in the U.K. and prosecute dangerous partners and protect the victim 🙈

Great tie! Great vid too! Mr. Walshe reminds me of George Conway.
At first I thought he was being set up. Because I didn’t think anyone could be this dumb.
