    1.) contact client, keep them in the loop. Client can also decline ( assert privilege). Our best interest is for the client.
    2.) Coming from judge/court, contact client if it’s an option however if SW contacted client then advocate for client by limited release or confidentiality.
    Based on scenario in video for first/next.

    Hey ray what happens if the exam offers 1) seek legal consultation, 2) contact the client. What do you do in that situation????

    What about consult legal advice? Someone said when you get a subpoena if the answer has this choose first?!?! I’m confused because all study material I’ve studied says client, claim privilege, consult supervisor, legal….

    I am loving your videos! You have a nack for breaking things down. One thing though regarding subpoenas For the exam, this is not a situation where you will notify the client first. You must comply. It's still a great thing to keep them in the loop, but the court comes first.

    I had a practice e question where the correct answer was “consult with your supervisor”, where would this fit in the cereal analogy? It seemed to me that this practice answer was saying I needed to talk to my supervisor before doing anything else. Thanks!

    Hey Ray! Thanks again for all the help with these videos. I am sorry for the plethora of comments. I am studying away for my LMSW test. I took a practice test on the ASWB website. I don't want to break any rules or get in trouble. Paraphrasing, I selected the answer choice to reach out to the client first, but the ASWB marked my answer as incorrect and said I should have reached out to legal counsel FIRST. Any way you could help me with this question? I feel like in general ive been given different feedback if I should go to the client or legal counsel first, and I don't want to get it wrong on the test. Thank you! Once again, I hope I did not break any rules.

    I had a question on a practice exam that said that the first action was to talk to the agency's legal counsel before reaching out to the client to see if we can release the records. Why?

      Hey, Katherine. Yes, that would be correct because it’s still speaking with legal counsel, they just happen to have one at their agency which is useful.

    Hi Ray! I have a question about this topic. If we receive a supoena from a judge or a court order, can we request that they withdraw the order if it would be harmful to the client? Is that an option?
    I know that we can request them to limit the records we send, but can we actually request that they withdraw the order entirely? Thanks!

    I'm a little confused because some rationales say we are supposed to contact our own lawyers first then contact the client.

      Hey, Alyssa. The only time the social worker would contact their own lawyer is if the subpoena was for the actual social worker to appear in court. If that were the case, the social worker would want to seek legal counsel for themselves.

      Update - You're able to inform the client first.
      1.07 Privacy and Confidentiality
      (d) If social workers plan to disclose confidential information, they should (when feasible and to the extent possible) inform clients about the disclosure and the potential consequences prior to disclosing the information. This applies whether social workers disclose confidential information on the basis of a legal requirement or client consent.
      (e) Social workers should discuss with clients and other interested parties the nature of confidentiality and limitations of clients’ right to confidentiality. Social workers should review with clients circumstances where confidential information may be requested and where disclosure of confidential information may be legally required. This discussion should occur as soon as possible in the social worker-client relationship and as needed throughout the course of the relationship.
