Vivek is a breath of fresh air for us in the US. It’d be nice to have a president who is hardworking, intelligent, promotes moving forward, has plans to actually accomplish that and never gives negative feelings, but hope. And to have a President who isn’t an embarrassment in the least.

I am an old Australian bloke, grew up in the 1950s. Rita has that accent I remember my Mum and her friends speaking in the 1950s. Down to earth, expressive, open and honest. Rita was born of Iranian parents, and spent some time as a child in Iran. She is a lovely woman.
The indictments in Georgia were published before the Grand Jury made a decision. Two excuses were provided. First the clerk hit send went she meant to hit save. The next day the excuse was it was just a draft.
Here's what happened in Georgia. Trump wanted a full forensic audit of the election in Fulton County, by independent auditors. Unlike in nearly all the other lawsuits, this judge did not dismiss the case at the outset on some legal technicality. He ordered the county to hand over everything. All the ballots, envelopes, machines and hard drives. The county appealed the court order. While the appeal was pending, they began systematically wiping all the hard drives. To prepare for the runoffs that were 6 weeks away, you see. Nothing nefarious going on at all. Shame on anyone for even thinking such a thing! The judge granted an emergency injunction, but oops. Too late. The data's gone. Our bad. The county kept appealing and then, BOOM. On November 20, the state certified the election. At which point, the judge said, "well, even if you prove your case, I'm not going to decertify an election, so the entire case is moot. Dismissed." Anyway, the Georgia indictment uses RICO to turn non-crimes into predicate and overt acts of criminal conspiracy. The acts are not criminal per se, but become criminal due to corrupt intent. The entire case depends on TWO elements. _Actus reus,_ and _mens rea._ The guilty act and the guilty mind. He's being accused of knowing and wilful misrepresentation. _Mens rea:_ Trump made false statements knowing they were false when he made them. _Actus reus:_ the statements Trump made were, in fact, false. Most of the legal experts who've commented who claim the case is weak sauce have focussed on his _mens rea_ defence. The prosecution has to prove Trump genuinely KNEW he lost fair and square when he did all these things. It's not going to be easy to prove that to an unbiased jury. It doesn't matter whether his belief that he didn't lose was reasonable, only that it was genuine. And he doesn't have to prove he believed he didn't lose. He only has to prove he believed it was _plausible_ that he didn't lose. The prosecution has to prove that he KNEW he lost. Is that a stretch, given what Fulton County pulled? Shouting into the phone over the sound of machinery: "You're wrong. You lost fair and square." "If I'm wrong, let me see the evidence for myself." "I'm afraid we can't do that. You'll just have to take our word for it." "Are those paper shredders I hear?" "Yes. We're just doing some spring cleaning!" "In November?!" I exaggerate, but you get my point. Anyway. Trump has a _mens rea_ defence that's pretty robust, but still open to inference and interpretation. Mind-reading. But he ALSO has an _actus reus_ defence. Everyone is just assuming the statements Trump made, about Fulton County in particular, were factually false. That question has never been tested in a court of law. And it's no longer moot. A possibly innocent man is facing years in prison. And truth is considered an absolute defence against any claim of misrepresentation. He's effectively being accused of fraud, and fraud cannot be predicated on true statements. The paper ballots and envelopes still exist. An audit is still possible. And this is no longer a matter of who gets to be president and who doesn't. It's a matter of whether a possibly innocent man goes to prison. If they give him an audit and he's proven right, it's going to be a MASSIVE win for him. If they give him an audit and he's proven wrong, he can use the fact that he tried to prove himself right to bolster is _mens rea_ defence. If he didn't genuinely believe he was right, why would he ask for an audit that COULD prove him wrong? And if they try to block his access to the absolute defence of truth? Think of how that will look. If even THEY'RE worried he'll prove the election was dirty, how can they argue that he KNEW all along that it was clean? Trump's lawyers can always argue that it's in the public interest to let Trump try. First, it's never in the public interest to condemn an innocent man. If the prosecution is right, which they have asserted as a truism, he'll fail and it will restore public faith in the electoral process. No more "insurrections" based on wild allegations. And in the court of public opinion, how's it going to look if they don't let him at least try? Everyone--Democrat, Republican and Independent--knows the true objective of all these indictments is not to punish a criminal, but to kill Trump's political aspirations and keep him out of the White House. WHEN (not if, remember, because this entire case is predicated on him having lost fair and square) Trump fails to prove the Georgia election is suspect, his base will feel disillusioned and betrayed. Think of all the people in prison because they believed him! Wouldn't they want to see Trump hoist with his own petard? They've painted themselves into a corner here. All Trump has to do is demand the right to pursue his strongest affirmative defence. Truth. I'm willing to bet my reputation that if he demands an audit of Fulton County (or the entire state) as part of his defence, they'll fight him tooth and nail. If they don't let him pursue that defence, they'll prove him not guilty on _mens rea_ grounds because even THEY are worried he'll prove he was right. If they do let him, no matter what turns out to be the case, he proves himself not guilty on _mens rea_ grounds, because why would he demand a chance to prove it if he didn't believe it? If Trump demands the right to pursue the absolute defence of truth, whether it's granted or not, there is no legitimate path to conviction. The ONLY possible outcomes are it turns out Trump was right all along, or it turns out he was wrong. Even though Trump proving himself wrong will kill his political career and solve ALL the Democrats' problems, including the erosion of public faith in elections, they will do everything in their power to not allow him the chance. This RICO prosecution was a monumentally stupid move in a purple state where Biden's official margin of victory was 11,780, 0.24% of all the votes cast.

The indictments in Georgia were published before the Grand Jury made a decision. Two excuses were provided. First the clerk hit send went she meant to hit save. The next day the excuse was it was just a draft.
Vivek tapped danced like a pro! And it was all perfectly true! Hard to stop truthful logic! Keep it up!
Here's what happened in Georgia.
Trump wanted a full forensic audit of the election in Fulton County, by independent auditors. Unlike in nearly all the other lawsuits, this judge did not dismiss the case at the outset on some legal technicality. He ordered the county to hand over everything. All the ballots, envelopes, machines and hard drives.
The county appealed the court order. While the appeal was pending, they began systematically wiping all the hard drives. To prepare for the runoffs that were 6 weeks away, you see. Nothing nefarious going on at all. Shame on anyone for even thinking such a thing!
The judge granted an emergency injunction, but oops. Too late. The data's gone. Our bad.
The county kept appealing and then, BOOM. On November 20, the state certified the election. At which point, the judge said, "well, even if you prove your case, I'm not going to decertify an election, so the entire case is moot. Dismissed."
Anyway, the Georgia indictment uses RICO to turn non-crimes into predicate and overt acts of criminal conspiracy. The acts are not criminal per se, but become criminal due to corrupt intent.
The entire case depends on TWO elements. _Actus reus,_ and _mens rea._ The guilty act and the guilty mind. He's being accused of knowing and wilful misrepresentation.
_Mens rea:_ Trump made false statements knowing they were false when he made them.
_Actus reus:_ the statements Trump made were, in fact, false.
Most of the legal experts who've commented who claim the case is weak sauce have focussed on his _mens rea_ defence. The prosecution has to prove Trump genuinely KNEW he lost fair and square when he did all these things. It's not going to be easy to prove that to an unbiased jury.
It doesn't matter whether his belief that he didn't lose was reasonable, only that it was genuine. And he doesn't have to prove he believed he didn't lose. He only has to prove he believed it was _plausible_ that he didn't lose. The prosecution has to prove that he KNEW he lost.
Is that a stretch, given what Fulton County pulled?
Shouting into the phone over the sound of machinery: "You're wrong. You lost fair and square."
"If I'm wrong, let me see the evidence for myself."
"I'm afraid we can't do that. You'll just have to take our word for it."
"Are those paper shredders I hear?"
"Yes. We're just doing some spring cleaning!"
"In November?!"
I exaggerate, but you get my point. Anyway.
Trump has a _mens rea_ defence that's pretty robust, but still open to inference and interpretation. Mind-reading.
But he ALSO has an _actus reus_ defence. Everyone is just assuming the statements Trump made, about Fulton County in particular, were factually false. That question has never been tested in a court of law. And it's no longer moot. A possibly innocent man is facing years in prison. And truth is considered an absolute defence against any claim of misrepresentation.
He's effectively being accused of fraud, and fraud cannot be predicated on true statements.
The paper ballots and envelopes still exist. An audit is still possible. And this is no longer a matter of who gets to be president and who doesn't. It's a matter of whether a possibly innocent man goes to prison.
If they give him an audit and he's proven right, it's going to be a MASSIVE win for him.
If they give him an audit and he's proven wrong, he can use the fact that he tried to prove himself right to bolster is _mens rea_ defence. If he didn't genuinely believe he was right, why would he ask for an audit that COULD prove him wrong?
And if they try to block his access to the absolute defence of truth? Think of how that will look. If even THEY'RE worried he'll prove the election was dirty, how can they argue that he KNEW all along that it was clean?
Trump's lawyers can always argue that it's in the public interest to let Trump try. First, it's never in the public interest to condemn an innocent man. If the prosecution is right, which they have asserted as a truism, he'll fail and it will restore public faith in the electoral process. No more "insurrections" based on wild allegations.
And in the court of public opinion, how's it going to look if they don't let him at least try?
Everyone--Democrat, Republican and Independent--knows the true objective of all these indictments is not to punish a criminal, but to kill Trump's political aspirations and keep him out of the White House.
WHEN (not if, remember, because this entire case is predicated on him having lost fair and square) Trump fails to prove the Georgia election is suspect, his base will feel disillusioned and betrayed. Think of all the people in prison because they believed him!
Wouldn't they want to see Trump hoist with his own petard?
They've painted themselves into a corner here. All Trump has to do is demand the right to pursue his strongest affirmative defence. Truth.
I'm willing to bet my reputation that if he demands an audit of Fulton County (or the entire state) as part of his defence, they'll fight him tooth and nail.
If they don't let him pursue that defence, they'll prove him not guilty on _mens rea_ grounds because even THEY are worried he'll prove he was right. If they do let him, no matter what turns out to be the case, he proves himself not guilty on _mens rea_ grounds, because why would he demand a chance to prove it if he didn't believe it?
If Trump demands the right to pursue the absolute defence of truth, whether it's granted or not, there is no legitimate path to conviction. The ONLY possible outcomes are it turns out Trump was right all along, or it turns out he was wrong.
Even though Trump proving himself wrong will kill his political career and solve ALL the Democrats' problems, including the erosion of public faith in elections, they will do everything in their power to not allow him the chance.
This RICO prosecution was a monumentally stupid move in a purple state where Biden's official margin of victory was 11,780, 0.24% of all the votes cast.
