Sirji, धन्यवाद, बहुत अच्छी जानकारी प्राप्त हो गई। हमारा एक बंगला है जो हमारे दादाजी ने खरीदा था। और वो second owner थे। बंगला खरीदी किए तभी उसी बंगले के २ रूम्स मे एक किरायदार रेहेता था। पहले owner ने उस किरायदार से कोई एग्रीमेंट नही किया था, बाद मे उस किरायदार से दादाजी ने और दादाजी के बाद दादी के नाम पर बंगला दादाजी के will से दादी के नाम हो गया । तभी हम उस किरायदार से भाड़ा लेते थे । अब दादीजी ने will कर के भाई के नाम बंगला कर दिया। दादी का देहांत २०१० मै हो गया। भाई ने अपना नाम दर्ज किया नहीं । किरायदार ने दुसरा मकान आपने बेटी के नाम खरीदा , और इस बंगले वाले मकान को ताला लगाके ६_ ७ वर्ष से निकल गया। अब हमारी फैमिली बढ़ गई है। और मकान की आवश्यकता है। तो हमे ये २ रूम्स वापस चाहिए । किरायदार अब रूम देने से इंकार कर है । या बहोत ज्यादा पैसों कि मांग है । कोर्ट केस के लिए कृपा हमेशा ही देर लगती है । कृपया advise दे । धन्यवाद।

What will be the criminal liability in case the tenant does not vacate nor pays the rent. Without criminal liability act is toothless as all previous Acts. For this reasons landlord still does not want to give his property on rent. Another issue is all security deposit where two months or six months deposit is too meagre for your property is valued in lakhs and when dispute arises it is of no use. Security deposit should be higher so as to compensate the landlord in case of damages to his property.
6 months security deposit is too high . Max 1 month of rent as deposit is sufficient . What about those landlords who upsurp the deposit citing damages which do not even happen. Landlords are greedy and demand unrealistic rents.

Their is one point that does not get favour for Landlord and Tennant. Tennant do minor changes on wall such as Nail instead of screw by drilling. Nails destroy the walls. It is not desired to submit rent agreement copy to rent authority. Agreement copies should be kept with landlord and tenant and submitted to rent authority to only resolve disputes or for eviction.
In case of any dispute on the rent of properties either commercial or residential if fail the resolve the dispute of any reason, tenent should vacate the rented permieses without ifs and buts at once in order to safeguard the fundamental and legal right of landlord.
There should be some restrictions on the rent increase part, owners think it's their property so they can increase the rent 100% on next year...this is happening everywhere....and there should be a law for Agents too..who takes brokerage of two months in some cases just to show the flat and repeats that again after completion of 11 months contract with owner. I had my house in rent after signing written agreement. The agreement expired in oct 22. The tenant is not vaccating my house in spite of written and verbal noticed. He has filed a civil case and the police says that we can not it vaccated as the case is pending in court. The tenant has filed the case just to avoid eviction of my home. He knows that the case will be in court for a long time and he need not vaccate house. He is not paying rent as electricity bills. He is simply taking advantage of loop holes in law. Hello Sir, please explain the agreement type. I mean can it be a Notarised Agreement or it has to be a Registered agreement only. If I prefer a Notarised Agreement of 11 months , would it be sufficient to favour both parties? Second, what is the meaning of Leave and License Agreement in which the word “Tenant” is never to be mentioned anywhere because putting the word tenant may go unfavourable to the Landlord in case of any dispute. In Gujarat, Kolkata mostly tenants are chosen by solid reference who by rare probability would default. It is to proposed that any kind of dispute between land lord and tenent if not soloved with mutual understanding due to any reason tenant must be vacated the permisies without any ifs and buts otherwise it would be deemed to diprived the legal and fundamental rights of landlord. If tenent do not vacated the rented permisies is liable to be penalised by competent authorities to safeguard the interest of landlord as his fundamental and legal right. Moreover, the maximum period of time limit for rent agreement must be decided by law. After expiry of time limit, it can be extended by making new rent agreement by mutual understanding between landlord and tenent. If there is no such provision in the law, question would be arised in the court for unnecessary latigation for killing the fundamental legal interest and right of landlord. The landlord can be considered before the tenent as begger for natural justice at any circumstances. Otherwise all is null and void for solving the problem of landlord.

Very well explained the rent act for Leave & License, but what about those who are on Pagdi System? It still prevails in Mumbai and tenants are tortured by the landlords most of the time. All the tenants are not goons who are capable of facing such atrocities. Most of the time the landlords do not allow you to sell the apartment even by giving them their legal share or even more. The tenants are stuck to face the landlords' atrocities, Is there any protection under the law. Item 2 j of this act mentions - "but shall not include any person against whom any order or decree for eviction has been made". We are fighting one case in which the court decree has been made for eviction by lower court, but the tenant has filed a challenge in High court? Can we file a case to this tenant under the new law?

I own a property that i rented out, also i myself live in a rented flat. I've experienced both being owner and tenant. The problem is that- indian law is subjective and not objective in nature, law has a bias. The law needs to be objective and clear. In my view laws are unfair towards tenant, due to following 1. There needs to be a law on rent control, because inflation hits tenant the most and tenant has to pay everyone and everything (broker, packer and movers, deposit, lawyer and government, interior, house repairs, maintenance and charges) land lord has unrealistic expectations from tenant 2. Deposit-It should only be one month deposit OR no deposit, that shoud be permissible and tenant should be protected by a guarantee, because in most cases deposit is not returned back to the tenant. Owner just makes false claim and accusations to do soo. 3. Whimsical and egotistical behaviour of landlord and property administration and neighbours-should be penalised under law. for harrassing and creating nuisance for tenant, it should stop restrictions, exploitation and abuse of the tenant. In many cases society and apartments administration make rules for tenant specifically and restrict access to amenities (terrace, gym, swimming pool, entry to premise within specific hours, guests, parking, lift etc) and extracts money from tenant for the same amenities 4. Legal scrutiny and expenditure-generally tenant has to go through it and has to pay cost involved. 5. Dignity & Integrity of tenant is questioned and compromised at every point. Indian law has to accept tenant as part of society and citizen of indian. Tenant needs to be empowered in the right way.

What if tenant is asbsconding... after locking the premises. And without paying rent is there any provision to recover the amount due with intrest and legal charges from tenant.. हमारा एक बंगला है जो हमारे दादाजी ने खरीदा था। और वो second owner थे। बंगला खरीदी किए तभी उसी बंगले के २ रूम्स मे एक किरायदार रेहेता था। पहले owner ने उस किरायदार से कोई एग्रीमेंट नही किया था, बाद मे उस किरायदार से दादाजी ने और दादाजी के बाद दादी के नाम पर बंगला दादाजी के will से दादी के नाम हो गया । तभी हम उस किरायदार से भाड़ा लेते थे । अब दादीजी ने will कर के भाई के नाम बंगला कर दिया। दादी का देहांत २०१० मै हो गया। भाई ने अपना नाम दर्ज किया नहीं । किरायदार ने दुसरा मकान आपने बेटी के नाम खरीदा , और इस बंगले वाले मकान को ताला लगाके ६_ ७ वर्ष से निकल गया। अब हमारी फैमिली बढ़ गई है। और मकान की आवश्यकता है। तो हमे ये २ रूम्स वापस चाहिए । किरायदार अब रूम देने से इंकार कर है । या बहोत ज्यादा पैसों कि मांग है । कोर्ट केस के लिए कृपा हमेशा ही देर लगती है । कृपया advise दे ।

What will be the criminal liability in case the tenant does not vacate nor pays the rent. Without criminal liability act is toothless as all previous Acts. For this reasons landlord still does not want to give his property on rent. Another issue is all security deposit where two months or six months deposit is too meagre for your property is valued in lakhs and when dispute arises it is of no use. Security deposit should be higher so as to compensate the landlord in case of damages to his property.
6 months security deposit is too high . Max 1 month of rent as deposit is sufficient . What about those landlords who upsurp the deposit citing damages which do not even happen. Landlords are greedy and demand unrealistic rents.

Their is one point that does not get favour for Landlord and Tennant. Tennant do minor changes on wall such as Nail instead of screw by drilling. Nails destroy the walls. I had my house in rent after signing written agreement. The agreement expired in oct 22. The tenant is not vaccating my house in spite of written and verbal noticed. He has filed a civil case and the police says that we can not it vaccated as the case is pending in court. The tenant has filed the case just to avoid eviction of my home. He knows that the case will be in court for a long time and he need not vaccate house. He is not paying rent as electricity bills. He is simply taking advantage of loop holes in law. When agreement hax expired he gas no right to remain in house till court decides the case. What I should do in this situation to get the house vaccated? Should I get itvaccated using muscle powrt?

In Gujarat, Kolkata mostly tenants are chosen by solid reference who by rare probability would default. It is to proposed that any kind of dispute between land lord and tenent if not soloved with mutual understanding due to any reason tenant must be vacated the permisies without any ifs and buts otherwise it would be deemed to diprived the legal and fundamental rights of landlord. If tenent do not vacated the rented permisies is liable to be penalised by competent authorities to safeguard the interest of landlord as his fundamental and legal right. Moreover, the maximum period of time limit for rent agreement must be decided by law. After expiry of time limit, it can be extended by making new rent agreement by mutual understanding between landlord and tenent. If there is no such provision in the law, question would be arised in the court for unnecessary latigation for killing the fundamental legal interest and right of landlord. The landlord can be considered before the tenent as begger for natural justice at any circumstances. Otherwise all is null and void for solving the problem of landlord.

Very well explained the rent act for Leave & License, but what about those who are on Pagdi System? It still prevails in Mumbai and tenants are tortured by the landlords most of the time. All the tenants are not goons who are capable of facing such atrocities. Most of the time the landlords do not allow you to sell the apartment even by giving them their legal share or even more. The tenants are stuck to face the landlords' atrocities, Is there any protection under the law. I own a property that i rented out, also i myself live in a rented flat. I've experienced both being owner and tenant. The problem is that- indian law is subjective and not objective in nature, law has a bias. The law needs to be objective and clear. In my view laws are unfair towards tenant, due to following 1. There needs to be a law on rent control, because inflation hits tenant the most and tenant has to pay everyone and everything (broker, packer and movers, deposit, lawyer and government, interior, house repairs, maintenance and charges) land lord has unrealistic expectations from tenant 2. Deposit-It should only be one month deposit OR no deposit, that shoud be permissible and tenant should be protected by a guarantee, because in most cases deposit is not returned back to the tenant. Owner just makes false claim and accusations to do soo. 3. Whimsical and egotistical behaviour of landlord and property administration and neighbours-should be penalised under law. for harrassing and creating nuisance for tenant, it should stop restrictions, exploitation and abuse of the tenant. In many cases society and apartments administration make rules for tenant specifically and restrict access to amenities (terrace, gym, swimming pool, entry to premise within specific hours, guests, parking, lift etc) and extracts money from tenant for the same amenities 4. Legal scrutiny and expenditure-generally tenant has to go through it and has to pay cost involved. 5. Dignity & Integrity of tenant is questioned and compromised at every point. Indian law has to accept tenant as part of society and citizen of indian. Tenant needs to be empowered in the right way.

My mother is 75 year old, sevior artherritis patient is suffering from mental and physical torture since last 5 year by his elder son . 5 month ago he and his wife captured at bitting time in my mobile. After that she apply to S D O and DM office for eviction. But no result till now, when we visit to ADM last TUESDAY( 25/7/23). The ADM of Bankua said us he can not do anything. We have to go civil court. Where should we move now. My mother is very ill became depressed after that. Unable to move. Property is in my mother's name. We suspect my elder brother have good connection with local administration.
How and where should we move for eviction suit.
Every year how much rent can be increased legally ? 10 % ?

Namste, kya ye kanun Uttarakhand State me bhi lagu ho gya hai. Yadi lagu ho gya hai to ek makan malik ko kis tarah se Rent Àggerimant me kin kin bato ko likhana chahiye. Vistar se likha kar bataye.
Agar 11 months rent pe Flat deto ho toh Notary karna sufficient honga. Registration ki jarurat haiye kya

But sir pls tell that how much time approx. will it take for court order in 'tenant eviction suit'? Or if I am getting very late rent after 3-4 months, then is it better to wait for almost 2 years for the expiry of registered lease aggreement..

Minimum 3 to 4 years.. Till the time the court permits the tenant to stay without pay and make the owner's life hell. My personal experience

What if tenant is asbsconding... after locking the premises. And without paying rent is there any provision to recover the amount due with intrest and legal charges from tenant..
Kyunki jo lock kar aur kiraya le kar bhag jata hai wo samman yo chod kar nahi jata... aur agar agreement nahi hai to kya kiryedaar per kiraya lekar bhagne ka adhikar hai..
Light bill becomes a big problem. Landlords take rs 8/rs 10 per unit whereas government rate is. 4.41 per unit upto 100 units. My landlord constructed his half done property on 2nd floor, used light for tiles cutting work, fabrication & fitting doors. Now he's not ready to give share in the increased lightbill. Current month bill is of rs 3000 wheras my consumption of light is approximately rs 800.
4.41 +16%+16%+fix charges applicable check light carefully that 8 per unit till 100 unit , after 10 the. 14 per unit+ taxes too much pressure in owner.. think that side also...
सरकार को सिर्फ यही नही देखना चाहिए की किराये दार और मकान मालीक, हर स्क्वेअर फिट पर दाम और छत पतरे एसपटोस और सिमट की छत के अनुसार भी कानुन लाना चाहिए |मकान मालिक तो बस कमान जानता है |अभी देश पुरी तरह डेवलप नही हुआ है शहर को देख कंडम से कंडम मकान के पैसे शहरी मकान की तरह लिए जाते है, वहां एगरीमेंट नही दादागिरी चलती है |
