Arkansas police chief arrested by State Police in his own backyard

  • HOWARD COUNTY, ARKANSAS - As of the 2010 census, Dierks, Arkansas boasted a population of 1,133 people, down from 1,230 ten years prior. The small municipality had an equally cozy police force, consisting of three full time and two part-time officers.
    In early-June 2018, the entire Dierks Police Department was temporarily suspended after the Arkansas Commission on Law Enforcement Standards notified the city that their law enforcement agency of five had not met required range standards, nor completed a required racial profiling class. At the time, Chief James Brian White - who goes by his middle name - stated "We took a couple of days to do some in house training that we let ourselves get behind on, but it's been taken care of."
    Less than two years later, Dierks Chief of Police Brian White resigned from his position after the Arkansas State Police arrested him in his own backyard.
    On April 4, 2021 at 10:02 a.m., Arkansas State Police Trooper Darren Henley was requested by Howard County Sheriff’s Department to respond to a single vehicle collision at the
    intersection of Green Plains Road and US-278. Henley was told
    that the driver of the accident vehicle was the Chief of the Dierks Police Department, James White. While en route, Henley received an update: White had left the scene, driving the vehicle that was previously involved in the collision. Also known as his patrol vehicle.
    Multiple police units followed White back to his house, where White drove behind his house and into the woods. Shortly thereafter, dispatch advised Trooper Henley that a "Deputy Quick" had the chief of police detained.
    White's preliminary breath test sample returned a healthy .24% BAC, otherwise known as three times the per se limit. And Dierks Chief of Police James White was arrested for driving while intoxicated. At the Howard County Detention Facility, White
    submitted to additional requested testing. His final BAC result was .21%. Earlier today we called the Howard County Sheriff's Office seeking additional information and White's booking photo. If you are reading this, we are waiting for a return call. (Notably, White's booking photo is a public record, and our Arkansas business license provides us with a right to access it. Still waiting.)
    While we are on the subject of DUI arrests, let's circle back to Keith Ingersoll, of "Drunk Driving the Rolls Royce" fame. When we left off, the question we posed was how a politically-connected multimillionaire was accepted into a diversion program that he was likely ineligible for.
    First, some background: it may come as a surprise to learn that government agencies are generally not required to answer questions or produce information. The only thing agencies have to produce is nonexempt public records, in response to a request and the payment of any fees due.
    And on the records front, it's unfortunately still early. Pretrial diversion put Ingersoll's prosecution on pause, which means that his 2020 DUI case is still open. Consequently, records that could explain Ingersoll's acceptance into diversion remain exempt.
    But I did manage to confirm my suspicion. There is no way that he was eligible.
    "In order to be eligible for either tier the defendant must meet the following general criteria: * * * #4. The defendant must not have been involved in a crash in the instant case."
    If you are thinking "Maybe the State Attorney's Office defines "crash" in a weird way," you nailed it. They interpret the term more expansively than usual. They have also defined the term in relation to diversion eligibility.
    Verbatim: A "crash" certainly includes... (c). Hitting someone else's vehicle.
    I have a copy of the crash report associated with Ingersoll's arrest. Ingersoll was charged with one count DUI With Property Damage. There was definitely a crash.
    It took some nagging, but SAO spokesperson Keisha Mulfort eventually told me that she would "reach out to the assigned ASA" and get back to me.
    That was five weeks ago. Their silence is loud.
    State Attorney Worrell:
    Keith Ingersoll is a politically-connected multimillionaire who spent much of his DUI arrest informing officers that they were going to regret arresting him. The crash report associated with Ingersoll's arrest reflects thousands of dollars in property damage. Why was Keith Ingersoll accepted into a diversion program that he is ineligible for?
    Not holding my breath.
    But once the records are no longer exempt, they're mine. And they're yours.

    “I got 34 years, please don’t screw this up”, no you screwed this up, not the state police. If he accepts that he screwed it up then maybe he can start figuring out why he is drunk at this time in the morning. It is refreshing to see the professionalism of these state troopers. They are polite and professional while upholding the law no matter who you are.

      Even LEOs drink. And King Alcohol does not care what your job is. The rooms of AA are full of people of all professions, all races, all income brackets. Alcohol does not discriminate.

      @@dylanlevy2107 true. He could have gotten away with the whole thing. I had one DUI once. Then I got another and another. I lost three careers, marriages and the resulting homes and all. Each time. I pray this man finds the way out I finally found once I payed a hard enough price. Luckily I never killed anyone else and it was not my doing that I survived. I pray that he is humbled enough to get help.

      I agree but i think most of them are probably fit when they join.. likely in their twenties but after long years spent mostly sitting in a car day in and day out putting on extra weight isnt surprising. Plus im assuming that theres not much time for meals on duty so they probably eat fast food often

      Yeah these aren’t rookie cops looking like this. They’ve been around a while and you aren’t staying in shape into your 40s unless you’re working out every day. A work day and shitty shifts for police doesn’t make it so easy to be able to do that

    Man I love these cops. Them saying he needs to be held to a higher standard and that he needs to be treated the same way as everyone else just restored a tiny amount of faith back into some cops. Good job guys.

      I'm not suggesting that every cop acted the same way, when encountering another cop.
      I would have been more likely to agree with his statement, if he said 40 years ago. But that was before DUI was taken seriously and cops especially in small towns were the cop was more likely to follow you home, than arrest you and issue a ticket.
      By the 90's, regardless of who you were, you were more likely to get arrested and ticketed for DUI.

    My brother and I slept together as children, usually hugging each other because he was a afraid of the dark. As an adult, he held my hand as we'd walk. He was a kind, sweet brother. Alcoholism killed him. Get help before it's too late.

      My heart goes out to you. My heart dropped when I read your comment. I quit drinking over two years ago. I didn’t think I had a problem but I did. No one ever thinks they have a issue with alcohol until it’s too late. I had my first and last DUI and quit cold turkey. Scared the hell out of me the consequences one takes just to cover up your pain. My condolences to you. So sorry your brother passed away. I can feel the love you had for him in your comment. Truly sorry.

      I have 11 years sober, via God’s grace, one day at a time. I’ve bounced in and out of treatment facilities for 20?years before I finally stopped tryn to be sober the way I wanted to and the way it worked. I’ve never seen anyone stay clean and sober without A.A. It’s crazy how many ppl talk shit about recovery and blame failure on the program, all the way to jail or death. I’m sorry about your brother, at least he tried. If he tried he admitted he had a problem, that’s part of tne solution.

      That test is a damn agility test I couldn’t pass it on my birthday I guarantee if I took it every day for 30 days I would fail 31 of them and I don’t drink or take anything smoke cigarettes and eat red meat is all I do and work every day

      Wish there was a way to let that States Attorney or whoever know that the world is both watching and waiting to find out why they are giving this Keith guy special privileges? We of course know it's because he is rich and entitled but I think that this department giving him the privileges is what is contributing to the public having distrust of the police and the attorney. Perhaps if the media were shown the footage and documents? Thank you for giving us the update!

      my brother got a dui. he wrecked into someone and hurt the person. They are ok now, it wasnt a serious injury. My brother often talks about suicide, because he feels so terrible. My other brother actually did take his life after our 3rd tour in iraq. So its hard to hear my other one talk of it. i guess i dont even know where im going with this now. Anyway, im really sorry that happened to your brother, and im sorry for your loss ma'am

    I must give this Trooper a hats off to him for being the person he is! I'm so glad he stuck by his morals, and being on camera sure helps things today! But it is still a tough job for anyone and I hope to see more officers like this guy! I pray this chief gets the help he needs also!

      The driving factor in all of these cases is body cams. Without them, a lot of this stuff would be swept under the rug.. There's no doubt in my mind about that. Time and Time again . "this isn't like the old days, and all of this is being recorded" seems to be spoken at least once during every one of these videos. When I was a kid, I had a couple of cops beat the shit out of me while i was in a police station. There were at least 10 cops watching the action. I took the cops to court and they all denied doing anything to me., and none admitted to what they had witnessed. It would have been a different story if there was a supporting video.

    He says 34 years, on his ride to jail. Doesn't even contemplate how many people lost everything, without crashing their vehicle! Personally, I think they all need to be made to remember that they shouldn't even consider getting behind the wheel buzzed. And they should come down like lightning on people like this. He not only knew better, but betrayed the community. No excuse for driving drunk!

    Considering the terrible and sometimes tragic results of drunk driving that cops have seen on the job, for them to drive impaired themselves is ridiculous. Not to mention it shows a complete disrespect and disregard for the same people they have sworn to serve and protect. For a few, I guess that ends when they clock out at the end of the day. It is utter arrogance to assume they can drink and then drive because they think they can handle it better because they are cops. It’s called impaired judgment for a reason.

      I totally agree but also wonder if they hit the bottle because of things they themselves have seen on the job. Not an excuse at all though, perhaps a reason. Older guys in particular often hold things in because they were bought up to think that is what men do and to talk about your feelings makes you a wimp. Again, no excuse for drink driving at all.

      A girl in my grad class (she was 21) was killed a few months ago from a drunk driver. I don’t have much empathy for those people. You can drink all you want, but don’t fucking drive

      Actually, a sworn in officer is technically on duty 24/7. Though most anymore are done when they clock out.
      I have no respect for LEOs that do not respect their position and authority, not to mention the good folks they are hired to serve.

    It always amazes me how these chiefs and just officers who get out on the road drunk always ask for forgiveness and to be let off cause of their job yet how many others did they pull over same situation and they chastised and gave no remorse and lectured about drunk driving.       I think the same thing when I see people upset with officers trying to get other officers to go easy on them. Firstly, their judgment is already trashed enough for them to drive drunk. Secondly, all these people complaining about it would be wishing to God they had something to tell the officer stopping them for a DWI to make the officer feel bad about it. All of the people stopped for DWI try their best to whip up something to get the cop to let them off. At least the cops that get pulled over are generally respectful to the officer stopping them and don't act threateningly. I'm sure there is a stop on video somewhere where a cop getting a DWI completely loses his shit, but these are generally some of the calmest DWI arrests.
      Getting pissed at the cops for saying that stuff is like getting pissed at celebrities for taking free shit from events and sponsors. Everyone complaining about the behavior would be doing the same exact thing if it was an option to them.

      I think most cops would agree with you, despite anticop opinion. Most cops I work with or have worked with get extra pissed when cops do bad things and further mess up public trust. Yes, they are quick to empathize and try to rationalize most incidents they see because they understand how complicated things can be, but when someone clearly did something bad ive seen cops seething.

      The issue is there should be no shame in telling the truth. If you have an issue, that should not be judged by anybody around you. Whether you're a police officer or a correctional officer, or whatever your law and order occupation is. You're under the same risks. Therefore, if you feel like you're falling in that trap of whatever, reach out. The ones that work around you want you to be happy and healthy. They don't want to see you fall down the same path...

    What this officer did took some real doing. I think he identified with what that chief was going through, yet he told him plainly that there is an oath he knew about when he signed up.

    I've watched a few of these and something bothers me; These cops are being respectful and sensitive to the situation, but only when it's one of their own. Every person should be treated this way and not just who they select for special treatment.

      I've had a few interactions with cops during my life, as have my wife and family. All but one of these situations involved polite, businesslike and at times even friendly officers. The only exception was an experience I had in Japan.
      There are absolutely some bad cops - just as there are bad dentists and teachers. The vast majority of police though are just normal folks doing a crappy job for not enough money.

      Right on the dot. That's what's missing from all of these cop/cop arrest vids - the only thing that seems to matter is that their careers are over. Are we supposed to think that the potential damage from them driving drunk isn't even an issue, or will their position in our culture act as a magical force field that will keep them from killing someone on the way home from the bar, so we shouldn't be concerned?

      Only certain officers are trained and have the certification to give sobriety tests. It's most likely something he has never done especially since he became chief.

      @@laramie371 most officers are trained to do field sobriety tests these days. That way, they can perform them themselves and don't have to take another officers out of service. But, you're right, there are a few departments that don't. Either way, had he not been 3 times the legal limit, he more than likely have known what the tests were and how to do them. Even though he's a chief, he still had to start at the bottom.

      Larry Blankenship..... I have no point of reference, I haven't ever been arrested. At age 72 I certainly hope it remains that way. I was a flight attendant for over 51yrs. Alcohol = termination. No discussion. No favoritism. Homeland Security accepted no excuses. I felt I worked in a much safer environment due to the random alcohol and drug testing.

    I used to be a very heavy drinker and I think drove drunk damn near as much as I drove sober! And just sitting here watching this video, I just came to remember that driving drunk was really always a conscious decision. Thinking back, I remember that getting in the car and starting it were always accompanied by the thought, “shit I better not get caught driving drunk”. Not, I hope I don’t kill somebody. I hope I don’t get caught! But I started the car and went anyway. Now I have not had a drink in over 31years and by the grace of God, I never did hit or hurt anyone or anything else. But the point is, that I actually thought about repercussions before I did it. Not the right ones, but regardless, had the conscious thought. And so does every other driver in these videos! They all thought about it for a second and then turned the key!

      I think it’s more like doctors and nurses who take smoke despite preaching against it. Drinking and driving is unfortunately really common, obviously. People who drink and drive dont intent to kill people and have no intention of hurting others. But they are selfish and decide to make life altering decisions thinking they will be fine and no one will get hurt. Ptsd, depression etc can all also influence cops just like any human being, but is more common among professions like this due to their experiences. That being said he has to face his demons now and pay for not getting help earlier, and doesn’t deserve special treatment. He needs to understand he 1. Easily could have killed someone and 2. Violated public trust, so it’s doubly bad. I think he should step down from his profession or be forced out. Im all for officers, nurses, soldiers etc getting early diversion programs, but not if they have already been caught messing up or it’s on the job. Too much trust.

      I wouldn't exactly say no discrimination I would be willing to bet it was his first time taking someone to jail and not cuffing them. If he is breaking the law he should have been cuffed . He knows better then the general public of all the crimes he was committing and just thought he was above the law.

    I feel that this man made a big error in judgement. He could not have had a better person take care of this for him. I pray that he will be able to retire, get some counseling, and start over. He has so much to live for, and his family loves him, and Weill be there for him. God is good, and these officers probably saved his life, as well as others. This seems awful, but it couldn’t have been handlers any better.

    I can't stand when at some point they blame the cop for their predicament, beg for special treatment, completely ignoring, in this case, the fact that he was driving drunk, in an accident and left the scene of the accident, knows he has an alcohol problem but never attempted to get help? how many times had he driven drunk (even on duty) before he got caught? I'll bet hundreds.

      It often takes something very detrimental to happen for someone to seek help for themselves. Without consequences, there not much incentive to quit for most alcoholics. Very few will have the intuition to get help before they suffer any negative consequences. This incidence may very well save his life.

    I've watched a lot of videos involving the Arkansas State Troopers and Police and consistently throughout I've been impressed with how professional they all are. In several, as in this one, they have unfortunately been tasked with arresting their peers and/or superiors and in every instance I've seen so far, they apply the law accordingly. They are all about doing their job, doing it with dignity, and treat law-breakers equally. We all have to remind ourselves that these law enforcement officers are human beings first and just as vulnerable to life's pitfalls as the next person. Hopefully this Police Chief received whatever help he may have needed.

    When a man of his age after 34 years on the police force does something this stupid, it makes me think he subconsciously knows it’s time to hang up his badge and retire. I see someone else commented that he resigned a couple of days after this.
    Edited to add, what we see of that little town is real pretty with all the beautiful trees and old farm houses.

      I use to live in Dierks. For a long time. Dierks is very pretty, but it is being absolutely ruined by logging. And has been for a hot minute. This police chief use to be massively morbidly obese and was times he would make people walk over to his car instead of going to theirs 😂 Tis true. But that town is rife with bad politics and small town favoritism. I'm half way surprised he was arrested because of how bad the small town politics are there. The town population was and still probably is 1,230. Still lots of good people there. But I'm half surprised this wasn't swept under the rug.

      No I think it's probably just addiction. You continue to make horrible choices and you know you're doing it but don't care until you lose major things. This should be a turning point for this guy and if he doesn't choose to get sober after this then he probably won't ever do it in his life.

      A sheriff close to us was arrested twice for DUI, once in his patrol car. He was removed as sheriff after the 2nd time, and eventually became a town cop in the same county. A few years later, he hit a pedestrian, while drunk in his patrol car and was arrested and fired again.. Im not sure where he is now.. But he been a cop in this area for over 30 years

    I sincerely hope the Police Chief gets the help he needs - 34 years of a very stressful job and being responsible for the lives of others has got to wear you down mentally and emotionally- makes me wonder if the Police has debriefing and counselling services freely available and at hand when and if needed.

    This is exactly something that would happen in the foothills of Alabama. It’s just remarkable how similar they are. Dinner On The Ground after church, big fish fries with the best food you’ve ever eaten, sittin’ at the crossroads @ the General Store having an ice cold RC Cola, with Willie Nelson on the radio, home grown tomatoes ripening in the shade on sheets of plywood over sawhorses, catch ponds full of Catfish on every property and the very salt of the Earth kind and generous folk……..Ahhhhhhhhhhhhhh 😊 Summer in the Deep South.

    I’m not far into the video, but so far he seems like a decent enough guy with a really bad problem. Alcohol tends to bring out the worst in people, especially when you’re in a situation like this. The pressure is on and you can feel life as you know it slipping through your fingertips, but (so far) he’s stayed very calm, relatively honest, and respectful.
    I hate that we have to learn the hard way how important it is to address and treat the underlying causes of substance abuse issues, but the alcoholism rate in law enforcement REALLY needs to be addressed.
    Maybe now that incidents won’t be able to just be swept under the rug or “handled internally” so much anymore, we can start to work on real prevention and treatment options

      Not sure, but okay. I’m standing firm on the substance abuse issues, though. How many DUIs has he had now? How relatively well is functioning at that level? Right.

    Hearing that trooper say there’s a oath I signed up for was music to my ears. This officer has the integrity that all officers should have, especially a cheif. Job well done, sir.
    To the cheif, the surgery did not cause your problems. Choosing to drink caused them. I know the potential risks of drinking, so like a grown man, I decided many years ago to just not drink.

      Totally agree with you. Body cams and police car cameras are a Godsend to everyone; it forces law enforcement to follow the law, no matter who it is. It would be sad thing if the sheriff lost his pension after getting arrested for DUI but you know what? He is the one who threw away his 34 year career down the drain and I would be willing to bet, this is not the first time drinking while behind the wheel. He is the one who chose to drink and drive. We have to live by our choices and as the sheriff said, he knew better.....he is not ignorant of the law! My 2 cents worth.

      NO THANKS! I’ve lived my whole life in a very small town in the South and never have any of our residents had any major issues with our Sheriffs or our Deputies. We all like our Officers and we do go by the “good ole boy system”, and we like it that way. We pay the taxes here and most of us like just how our little town is, so we don’t need nor would we ever allow some outsider to come in and look over our Shoulders!

      You bet. Here in Corrales NM they allow Police Chief to refuse to investigate thefts, protect thieves. Must be paying him something, under color of law. Admin. same thing to let Chief stay w significant failure to protect community. Instead Chief gets witesses, even victims who can identify thiefs, labeled MI and admitted to psych units w/ help of county courts, ex parte orders. Kidnaps witnesses.
      Closes investigation day after report. Refuses to interview perps seen leaving property.
      60 thefts in 7 month period w witnessrs and fingerprints not investigated!! Even former Administrator reported to have been found w burglar tools amd $2500 stolen prop in car. Several felonies.
      Organized crime in Village on edge of Albuquerque. Branded as safest city in state, cause he does not investigate nor prosecute his friends.
      Italian mafia? Tjey started this area historically.
      My neighbors still come in house to steal and take food, clothes, pots and pan clothes, money, even my silverware. Eating off plastic. I have no police protection as police will tell judge, as he did 10 yeats ago, that, "she imagines her 40K gold and silver coins were stolen) and needs psych eval." Fifth Amendment folks. Never agree to psych eval, repprt goes tp judge and DA so you are testifying against yourself! And they send you to their favorite comying for business "professional", no standarda in their education and no standardized testing.
      Pig under color of law needs a mors evaluation.
      Police refuse to yake written request for investigation. All agemcies cover for one another. Tight criminal network in local gvmt and outside that is continued to other police depts in state. Even owner local newspaper a pal of the gang. Lots to tell. We need a big Audit!!. No open gvmt. Refuse to yield info under FOIA act and their procedure.
