      it's 300 yards away lmao. and the guy was using a 9 iron that hoes 120 yards max. theres nothing disrespectful about it. the guy never came close to his property let alone his solar panels.

    I love my solar panels. Haven't had a bill since they've been installed. During winter am almost at 100% self sufficient. In the summer, we run the a/c that dips into the credits earned because it feeds into the grid.
    On the plus side, when the texas grid goes down, I still have power.

      Are they installed on top of your roof, or at some other location on your property? I am seriously considering solar panels, but a lot of my property is wooded, so it doesn’t get sun, and I’m not sure if my roof gets enough sun for it to be worth the expense. 😕

      @@NubianP6 they're on my roof. It was a newer housing development and so the trees are only like 20 something years old. And none of the huge ones like my childhood. We technically lease them, so if they're ever damaged, short of us intentionally damaging them, the company replaces/repairs them. We also have a battery.

      @@stormy6454 yes. But by leasing them, I'm not responsible for maintenance costs. The bill is cheaper than purchasing them, and lower than the electric bill that can vary depending on the season.

      True story I was walking by a golf resort on my way to work one day and enjoying my daily excersize, smelling the grass and fresh air/nature and I kid you not this golf ball went flying past me as I heard this wooosh wind sound and saw it out of my peripheral view come so close to my nose and then out into the street then bounced into this person's yard! I went to get it from where it landed as a souivener bcuz that was crazy it was so close to hitting me if I was walking any faster God knows what would happen so I thank my lucky stars and your right they prolly could since that golf ball I got was pretty beat up but now everytime I look at it in my potpourri jar I am reminded that God is watching over me😝

    Both are very well off, they have money, so why is it so difficult to install a big net (it’s easy to find them on Amazon)?! One to protect his solar panels and the other to keep his golf balls into his property. Each would buy his own ‘golf net’ to protect their property.

    Also check the make and type of balls found. Usually they are the same if a single person is striking them.
    If they are throw away balls (as these seem to be) then they will be bought in bulk and there will be a stash of them at the origin of the source

    The total distance of a golf ball shall not be greater than 317 yards, with a tolerance of 3 yards. So, basically, the maximum distance a golf ball can go is 320 yards. There are also standards about initial velocity at impact.Mar 13, 2018

    The bottom line is that you cannot just say "it's highly likely he did it your honor"! you have to have solid proof. It's amazing that an older man, likely educated, couldn't see that. Kids walking could've picked up these balls and flinged them - who knows? These people are well off, so fix the panels and erect netting around the units or put up cameras.

Once judges allow a person to be fined because he/she was the most likely to have done it, lawsuits will be abound in record numbers. Got a dent in your fender? "Oh, its my neighbor - he's dinged doors before in the parking lot". So easy it will be.

    The defendant is so obviously the one who is hitting the solar panels. He hit the first one, but not the second one? The question is, is he doing it on purpose? Also, why is it that the Judge will normally say that the Plaintiff just needs to show that it is more likely than not that the defendant did the thing, then suddenly she needs absolute proof. I think the Judge blew it on this one.

    So he cut the check on the 30th, but the 2nd panel broke on the 22nd. He said once he wrote the check his wife made him stop over there but that wasn't till the 30th. He broke both. The judge was played because she heard his wife made him stop, but didn't connect it wasn't till the 30th. His own testimony proved he was still hitting balls there till at least the 29th.

      I doubt he broke either of them. he'd be #1 in a long drive tournament doing that with a 9 iron. hell thats impressive with a driver to hit 300 yards over trees. if you played golf you'd understand.

      ​@@janesmith9006 I play golf. I use multiple clubs. hitting a driver over a tree line is next to impossible, let alone also driving the ball 300 yards at the same time. the loft on a driver is like 12 degrees. a 9 iron is 40. it's not a thing. again. if you played golf you would understand.

      ​@@janesmith9006 irons are meant for height. drivers are meant for low flight long distance. he would need to be really far back from the trees to get the ball up and over them. and then factor that in to adding to the distance of over 300 yards the guy would be a PGA tour professional at that point.

Where he claimed he was hitting he would risk breaking on of his own windows. Also the angle that the glass broke you can tell. Let's agree to disagree.

    well time will tell, if the defendant no longer hits balls in his yard and another panel gets hit then its someone else and may not of been him at all
    but if no balls are discovered in the plaitiffs yard anymore then its likely is was the defendant

    WHAT? Sometimes the judge is really dumb, although the defendant said he had stopped, he didn't stop until AFTER the second panel had been damaged. Even the defendant said he hits the balls into the forest, which is part of the plaintiff's land, so he could be hit in the head by a golf ball at any time, this all seems highly reckless...

      There is no certainty that the defendant hit the panels in EITHER case. The plaintiff was lucky that he got the first check which seemed to be a gift for piece/kind neighborly gesture. It could have been either of the other neighbors. There's enough doubt to not rule in the plaintiff's favor.

    Generally, I agree with this judge, but this time I think she was totally wrong. The guy broke it the first time, admitted that he did it, acknowledged there was nobody else in the area who could’ve done it, and another gets broken a short time later. The plaintiff is older and may not have even noticed the second panel until later. It’s far more likely than not the defendant did it, especially considering that the incidents happened in such a short time as each other. The Defendant seems like a total douchebag. The panels only cost $400, and based on these palatial homes they both seem to have, it doesn’t seem either is hurting for money. He could’ve just paid the debts, put in a ball catching net LIKE ANY RESPONSIBLE, CIVIL, RESPECTFUL NEIGHBOR AND HUMAN BEING WOULD, and had the whole issue done with. Instead, he weaseled his way out. Gross. Totally disagree with the judge on this one and it’s sad the plaintiff the judgment in his favor that he deserved.

      @@C3yl0 It’s actually called “more likely than not” in a civil case, which doesn’t require evidence beyond and to the exclusion of all reasonable doubt. For these kinds of cases, one simply has to prove that it’s more likely than not. In this instance, the judge allowed the Defendant’s frankly weak defense to stand, when, based on the facts of the case, it would seem it’s more likely than not that the Defendant caused the issue.

    Bit confused about that question at the end. It didn't seem to apply to Paul McCartney since Heather Mills managed to get a lot more than equity and she only provided outside charity work.
