      Section 3 of the 14th amendment to the constitution Trump wants to get rid of says exactly that. Maybe that is why he wants to get rid of our constitution.
      In fact, when he first said he wants to be rid of the constitution he disqualified himself that second from ever holding office as that is a treasonous statement that shows he's obviously no fan of our democracy or the rule of law our constitution represents. So, Trump is already disqualified & his name should be removed from every ballot. Now, if only we had a sec of state with the balls to follow the constitution.

      It is NOT a "punishment". Requires ZERO Indictment or conviction. It is a matter of Qualifications: Are you 35+? Are you a Natural Born Citizen? Have you lived lived in the USA for 14 years? Have you ever taken an Oath of Office? If yes, did you subsequently engage in an Insurrection or rebellion against the USA/Constitutional Democracy? Or did your give Aid or Comfort to those who committed these acts. Rump is just as DISQUALIFIED under these provisions as he would be if he were a Natural Born Citizen of Russia, or age 34. In each of these Questions, the proof is on the CANDIDATE! Prove your age. Prove your Birthplace. Prove your Residency. Prove that, having taken an Oath of Office, that you did NOT raise an insurrection or Aid or Comfort those who did. If you state you are a natural born citizen, for example, and a Registered Voter in that State, like me, believes that you are not, I can CHALLENGE your qualifications. That is exactly what is happening in every State right now. Registered Voters are challenging Rump to prove that he did NOT, for example, give aid and comfort to the Insurrectionists. Period.

      A secretary of state can certainly decide if a person is qualified to run for office. But it is also an elected office, and they want to be sure the action they take can be backed up by the courts. If their state constitution or laws cover this subject, they can follow it and be sure. But if not, a court decision is a good idea.

    • @JimHolder-pk2kk
      @JimHolder-pk2kk Год назад

      @@OriginalPiMan "alleged" and crimes are surprisingly not relevant. Guilt and innocence are irrelevant to this part of the Constitution. "Insurrection" can be a crime but in this case it is simply a behavior, just like giving aid or comfort. Being proven guilty is also irrelevant because Amendment 14 Section 3 is a technical qualification for jobs in government, not something that results in prison time. Section 3 says "That guy is not qualified to be President." in a factual and Constitutional sense.
      When @redjacemory4404 said: You can call his crimes "alleged", but he did them right in front of all of us.
      The only thing he got a little wrong from the perspective of 14.3 was using the word crime instead of the word behavior.
      Back in the day candidates were disqualified from jobs in government under 14.3 because of supporting the Confederacy during that insurrection but there weren't trials over it or jail time, they just couldn't be in government. Serving in government is not a protected right.
      More recently, Couy Griffin was removed from his government job as county commissioner under 14.3 because of supporting a more recent insurrection. Although Griffin was convicted of trespassing on 1/6 the reason he was removed from office was his behavior, not his minor criminal conviction that made him disqualified from serving. This does not involve a lot of due process or any presumption of innocence because no right was being taken away.
      It is a lot like a boss finding you with money from the cash register in your pocket. You are fired right away but if you give the money back, they probably won't call the cops. There is no presumption of innocence or any loss of your rights yet, you just are clearly disqualified from your job in a position of trust at the cash register. Amendment 14 Section 3 is about being qualified for certain jobs. It is not about crimes or punishments or about criminal justice procedures. It's about protecting our democracy (or republic if you like that word better) from from insurrectionists and from those who help insurrection along.

After four years of trump, there was an opportunity to remove him, as he was unable to govern. In each of these Questions, the Burden of Proof is on the CANDIDATE! Oh yes, and if you look on the Insurrection Index on PublicWise, you will see the names of the other Insurrectionists that are also DISQUALIFIED under 14(3). Call, e-mail, write a letter or sign a petition to get rid of these TRAITORS as well. Let your Secty of State or Board of Elections know that you are challenging the Qualification of these people. Join the Movement to take back our Constitutional Democracy from these Seditious Traitors! Your Voice Counts! Even Repukelicans in these positions cannot ignore the large numbers of Citizens who are challenging these people. Attorneys and Citizen Groups are standing by to champion ordinary Voters. Be a part of the Movement! . .
