My aunt was able to get her PUA disqualification overturned without the need of going through the appeal process even though she had already sent in the appeal form to them. It was the EDD that actually reached out. My aunt called back and they reactivated the link to upload her 2019 and 2020 Tax Returns which showed proof of self employment. The EDD employee remained on the phone with us the whole time. She walked my aunt through it, checked the documents we had just uploaded and reversed the disqualification to approved right there on the spot. Again, thank you so much for your help.

My husband didn’t notify his work he was on disability and they sent in his form to SDJ stating he was working during his disability period. He was not in any form. How the hell can they send these letters out and then just not have an actual person to talk too??
I just found my overpayment letter today, and they’re trying to get me for months I was 1000% unemployed for. I didn’t even receive the first few notices. These attorney’s I’m sure are great but I’m now working a Job where I literally am not scheduled for weeks (looking for another job) and they want 1000 to help you. This is a nightmare and it’s happening at the worst possible time.
I’m terrified to get an overpayment notice! Hi Ginny I know your busy. But I wanted to say. That I did not send any tax forms only my 1099s, 2 invoices, 2 paycheck stubs, a letter from a company I was an independent contractor for, an old business card. And s business plan that was just handwritten staying how I was going to expand my business and they sent me a letter saying that I meet legal requirements no further action at this time. Thank God! They disqualified me at first cause I uploaded only my 1099s nothing else. I sent in other docs and I'm good to go!!! Thanks for your help

Just got off the phone, not much of a consultation I received no information. I thought no charge until the case was won, but was told the affordable fee was $1500 dollars and needed to be paid in full before the case date. Hello Anthony, you will need to appeal them each separately within 30 days of the date of mailing. Depending on how far apart they are, it is possible the EDD will consolidate them into one hearing.

Hi yes was employed and furlough March 2020 and applied for UI same month yet it was pending for 4 months and decided to Work for myself and did online e-commerce business after waiting I received the unemployment and didn’t put the wages. Tho I paid taxes for my business and 1099G the end of the year . March 2021 my benefit ended and I didn’t continue to claim any unemployment or certify. As my business is giving me enough income to survive. Fast forward Dec 27 2021 I received a call from EDD asking my last employer and the next day I received a payment from EDD that I am confused of . I immediately call EDD that I didn’t those payments and want to return the funds aswell I tackle them what I have done last year of not reporting wages, I spoke to a gentleman earlier today who’s very knowledgeable ask me some questions and put me on interview list and he said I have to gather all the statements I’ve earn every month last year and saying I might end up paying them back . I know it’s gonna be a lot and a headache I just don’t what to go tho this again I hope this helps

HELP! What do I do if I accidentally reported my net instead of my gross and now they are hitting me with an overpayment/false statement? I got a overpayment for missing a couple of weeks for having Covid symptoms. My family also came down with Covid. And I had to take care of them. EDD still have me an overpayment.

I applied for CA Unemployment benefits from (EDD) I was delayed benefits 6 months until I involved a local assembly representative. Then my claim was approved briefly after the assembly representatives assistance. 8 months later EDD in CA sent me a OVERPAYMENT BILL for $1829. out of the blue. Anyhow to further I research the more i uncover that this has been happening to many EDD claims. I am unsure how to proceed to correct this.
Well I guess we can forget about the idea of the EDD being willing to sign off on whatever we can give them and making this part of the process as easy as possible for everyone. 🙄

Now its loan sharking.Appeals require an attorney becuase the employers have them along with HR dept and office personell and the EDD department has a dog in the fight.Claimants are set up to fail.No phone representives can change the amount owed it has to go to court. Changing the law after the fact now that things have recovered is wrong .

Could you have applied for PUA starting at an earlier date such that your wages were too small to qualify for regular UI, so u were then PUA eligible? When did you find out you should have gotten PUA and did you discover it, or did EDD? Did you apply for backdating? From about what date to about what date, and when did you request it? Did you get an approval in writing? I'm asking bc I have a close friend in similar circumstances. If you qualified for PUA, you will be paid retroactively for every week you were PUA eligible. Do you have anything in writing? I'm hoping w more details I can provide some answers or resources.

I would call against nand speak with a different tier two unfortunately people do report sometimes a second does help help. After that I would contact your assembly member for help and then appeal

I'm so sorry to hear about your dad. There are two different timeframes for submitting based on when you filed your claim - if it was before this rule was passed or after. If your deadline has passed, you will likely see disqualified and have to undergo the appeal process but then should easily have the decision fixed since you have proper documentation and qualify. BUT, I would try calling EDD asap to see if you can provide this documentation right away just in case they can accept it.

Make sure you submit an affidavit from the family(s) you worked for in addition to one from you. You will want to submit a letter from them as well.
Just sending your proof that's what I did cuz I get SSI too and they approved that everything was cool...

What do I do if I accidentally reported my net instead of my gross and now they are hitting me with an overpayment/false statement?
I’ve been on partial EDD for years now but rarely ever collect and when I do it’s very small amounts.
I don’t mind paying it back but I’m not trying to get a false statement for something that was a mistake.
Hearing on Monday for appeal. Have literally $0.00 in my account right now.
I got a overpayment for missing a couple of weeks for having Covid symptoms. My family also came down with Covid. And I had to take care of them. EDD still have me an overpayment.

I got a letter and a call for approximately $1800. I'm a disability caregiver and I make 18k per year with 2 senior parents I have to care for. Why don't they go after Jeff Bezos for all his unpaid taxes instead of the little guy trying to survive through a pandemic!!
What's the best way to get a hold of a tier 2 employee directly when calling EDD?
You would as the rep answering the phone to please transfer you to a tier 2 representative - it will be a lengthy hold unfortunately.

I received my letter they approved my 2019 taxes God🙏 meet legal requirements. and no further action.
But what about the people who qualifies for the pua and we still haven't received it are they going to back pay that still I have 56 weeks still left... And about $10,000 that they still owe me and they sent me a letter and said that my paperwork was sufficient so what am I waiting for now, can anybody answer that question thank you, 👍
I applied for CA Unemployment benefits from (EDD) I was delayed benefits 6 months until I involved a local assembly representative. Then my claim was approved briefly after the assembly representatives assistance. 8 months later EDD in CA sent me a OVERPAYMENT BILL for $1829. out of the blue. Anyhow to further I research the more i uncover that this has been happening to many EDD claims. I am unsure how to proceed to correct this.

I received a determination notice, after submitting my self-employment verification documents / tax return /, I called EDD the next day and the EDD worker told me it was a mistake and she fixed over the phone, next week I got Approval notification, but when I log in to my account in the payment history the disqualification is still displayed, how long it`s take to turn paid again? Now its loan sharking.Appeals require an attorney becuase the employers have them along with HR dept and office personell and the EDD department has a dog in the fight.Claimants are set up to fail.No phone representives can change the amount owed it has to go to court.
Changing the law after the fact now that things have recovered is wrong .
Jenny, thanks a lot for your help I'm a first-time person commenting here I file my 2020 state taxes everything was perfect I got all my federal money Federal stimulus money you know but I never got the the second stimulus or first I I contacted the governor's office Newsom they stated they cannot help me with my own personal case I guess if you had no income you do not qualify what does State stimulus I did not work in 2020 at all that was something new to me I thought you were allowed zero income right to qualify for the second please let me know if I'm ride or I do not qualify for it but I did contact the governor and his staff of course he's a busy man thanks for reading this and for your hard work

Jenny what I did do I did bring the attention to the governor I the fact that all the all of us would not work do not get anything from the state you know I'm a single male with no dependents so it's hard as it is but at least I tried to bring attention to the governor about listening to the 12 did not work the millions of us who did not work in 2020

I got disqualified for all payments, I just got my letter in the mail and it says I didn't send anything in or it wasn't enough. That's it. Doesn't say how much I would owe, or anything else.
What did you send in for them to just disqualify all your payments

Did you got disqualified from dec 27 2020 to your benefits end date only?

Hello Ginny , 2 weeks after I had already uploaded my 2019 documents I got paid my back date payment .... what should I do if I received disqualification on only my back date payments ?
I'm really curious had you been getting your EDD before you sent in the 2019 documents because I was getting paid and then they asked me to send in the documents because actually I should have been getting pua and I wasn't I was just getting regular unemployment and I still have 56 hours left for my pua they said last month so does that mean that they're still going to pay me the back pua payments do you know if you can answer that for me I would really appreciate it thank you...
@@TheDetroitblack Can you explain how u found out u should have been getting PUA? Were you self-employed? Could you have applied for PUA starting at an earlier date such that your wages were too small to qualify for regular UI, so u were then PUA eligible? When did you find out you should have gotten PUA and did you discover it, or did EDD? Did you apply for backdating? From about what date to about what date, and when did you request it? Did you get an approval in writing? I'm asking bc I have a close friend in similar circumstances. If you qualified for PUA, you will be paid retroactively for every week you were PUA eligible. Do you have anything in writing? I'm hoping w more details I can provide some answers or resources.

I sent my ein number and sellers permit. And I received a letter that I didn’t qualify for pua. ,I called tier 2 this morning, and said it was a mistake in the system . But she said she couldn’t do anything about it. She said I have to appeal.
I would call against nand speak with a different tier two unfortunately people do report sometimes a second does help help. After that I would contact your assembly member for help and then appeal

How long does it take to be notified if you were eligible for extension? Also still had issues with eligibility, I never received a call from them to fix. They kept giving me conditional payments.now it's at a 0. This would be my 1st extension.
There are no extensions - all ended in September.

What are some of the legal actions you can get yourself into if you don't pay for the overpayment from edd?
Lien, garnishment of wages, seizure of tax returns, etc.

Edd never answer call when I call since 3 months they keep saying my account is disqualified

I'm so sorry to hear about your dad. There are two different timeframes for submitting based on when you filed your claim - if it was before this rule was passed or after. If your deadline has passed, you will likely see disqualified and have to undergo the appeal process but then should easily have the decision fixed since you have proper documentation and qualify. BUT, I would try calling EDD asap to see if you can provide this documentation right away just in case they can accept it.

Hey I got a unemployment question, I just open a new claim on December, my 1st and 2nd weekly was on dec 11 and 19 but payment are still pending, need help
