    This is two different cases and need to be processed as such. if the commissioner is in fact the person pepper spraying homeless people , then he needs to be prosecuted as such.

The judge is going to ask him if he sprayed those people and will probably show video or other eyewitness reports of him going back to his house after he did it. I'm sure they got that fat fuk cold. If this happens, then the homeless guy who beat him with a pipe was justified in his action. The fat guy will spend some time in jail and probably lose his house.

    Can someone tell the lady to keep the pepper spray in her pocket, preferably clipped to it? Keeping it in the bag is not a good place. When she needs it, it may be too difficult to access under stress!

    I am a 6'4" very able-bodied male in San Francisco, and I carry the same pepper spray every day in this city that the lady in the video carries. If any criminal, drug addict, homeless, or mentally-ill person threatens me physically or comes at me to harm me, I am using that pepper spray on them period! But I am not just going to spray them down because they are homeless or simply sleeping on the sidewalk, that's just simply wrong!

You realize that if you use pepper spray, wind is a factor and may spray YOU instead of the assailant. Let's not even talk about whether you can deploy it quickly enough for an attack or even spray the face where this shit does the most good. BTW...some people don't react to capsicum. They just keep attacking. There's a good chance one of those guys will be the guy you attempt to spray and he will impale you with it. Do us a favour. Stay home and watch TV for joy. The cops don't want to deal with a milquetoast like you.

      Not in San Francisco. I'm scared even having to use deadly force claiming self defense when an intruder or an illegal breaking and entering into my home. Too many rights are given to the criminals, the insane, and the homeless while the books get thrown at the law abiding citizens. Really hard to prove "Castle doctrine" in San Francisco. SF residents will never ever feel safe again unless all the current politicians get voted out.

      Two separate incidents and even the DA doesn't know for sure if he was the one with the mace. He was attacked up and down the street with a metal pipe and can barely talk.

      Prove the case against who? Carmagnani is on multiple videos attacking sleeping vagrants with chemicals. They have file upon files of video and witness testimony of unsolved violent acts against vagrants. He did not show it court to file charges because he is afraid of evidence against him. The defense attorney is smart. She went to the files at the police station and picked out Carmagnani attacking others with pepper spray.

Building Public housing and getting people into safe and dignified living situations and not trying to correct behavior issues on the sidewalk as a pre-requisite is the safest and most cost effective way to end homelessness.Some of us remember when the City didn't have this problem so we know it was never a issue created by so called leftist policy or government.

The best way to stop drug use is to force some one out of their current situation. Giving them a place to do drugs with no consequences is simply enabling. I know from my own family experience and being around these homeless people all my life. The state policies are directly what makes it easy to be homeless and/or on drugs.

      I hate that. Animals are treated far better and more rationally. Retired pets, zoo animals, etc are given refuges to live out their lives. We need refuges where homeless can go and live out their bum lives - their native food is junk/fast food so McDonald's and Burger King and so on will be onboard. And their chosen way of life isn't swimming all day like hippos, or swinging from things like some monkeys, nope it's sitting around taking drugs. So these refuges should have free drugs. It will be far cheaper overall and the homeless can live their kind of life and we workers can get back to living our working way of life.

      & the fire commissioner is right. I lived in & around SF since 2000. I was almost stabbed by a crazy homeless woman near the Tenderloin, was accosted by an aggressive naked homeless man while in the park with my mother & infant son. Had my car window smashed 3 times, & my car knifed by a violent drug addicted prostitute that I later found out was arrested & released over 20 times. The cops told me she attacked 2 people with a knife 12hrs earlier, was held for 4 hours & let go, so no point in arresting her twice in 1 day.

    What's to stop this homeless bum from going back to his house and finishing the job. Reckless move on their part. Should have keeped him locked up Until he could heal from the Injuries he sustained from the attack. He can't defend himself in his current state. The city should have given him the time he needed. If something happens to him, i'm going to blame the city and the people responsible for letting that guy out too soon.

    If you drop trash on the street, it's trash and it's going get picked up and thrown away so do the same for the tents and belongings. As soon as you get rid of their belongings, they will need to leave and as soon as you stop giving free everything from housing to needles, they will move on and get out of the city.

    Homeless people have the right to squat on public property. It's actually not illegal any more for them to squat on *private* property. If they attack you, take your beating like a man (or woman) and if they catch the attacker, rest assured he'll be compassionately dealt with, then released with no charges.
    This is long past stupid. People who own property have fewer rights than their attackers, and are criminally prosecuted if they defend themselves. Yeah, spraying people with whatever spray is illegal. So, weirdly, is hitting someone over the head with a pipe. We all know which one's going to be prosecuted, and which one won't.

    There need to be places on the planet, in every country, where it's not illegal to occupy a body-sized plot for laying down & somewhere legal to empty bowels, bladder, and change sanitary products without breaking indecent exposure laws, and access to water for drinking and washing. Minimum!

      There is, but look at the interviews of the homeless. They want a free 1 bedroom apartment. They won't live in shelters, because it's not good enough for them. They say they would rather live on the street, because they can do drugs, which they can't do in the shelters. At some point, enforce the laws which make it illegal to loiter or sleep on the sidewalks. If they don't want help, use the law. Compassion should be the first option, but lettign them stay on the streets is NOT compassionate, or fair to the tax paying public.

    Migration out of SF will lead to better policies.. perhaps... once the revenues decrease.. city might begin to in large scale find housing by actually building sites for homeless.. but it's going to have to get way worse before it happens.

      Housing isn't the problem it's drug addiction and mental health. Otherwise we'd have less homeless after the pandemic as they all got free hotels and had plenty of time to get their affairs in order to improve themselves. As we all that happened was millions in damages to the hotel's that took these folks in. Costing the city more tax dollars they don't have.

    The more help people help the homeless lures more homeless to the area! If I see homeless I would call 311 to help the homeless. It is not my job to help them. It is my job to get help for them. What happens to all the money that goes to the non profit organization to assist homeless. Has the money being trash elsewhere?

    This is BS! You can’t claim self defense when you chase the person around for blocks! As soon as your “attacker” retreats or you have the ability to get away and you don’t, it’s no longer self defense! That’s literally the law!! But sf doesn’t care about the law or it’s citizens. So the homeless guy is given the benefit of the doubt with this self defense BS, but the contributing member of society isn’t even afforded the right of “innocent until proven guilty.” Sf keeps telling ppl who they value and who they don’t. Sure they want working and contributing members of society here, but only to pay taxes. The homeless and the criminals are who they value and care for.       Better yet, give them homes, then they wouldn't be homeless. There's 100,000 empty dwellings these people could live in and the city is ready to fuking buy them for this purpose. BTW...I just found out the empty buildings downtown that used to have employees CANNOT BE CONVERTED FOR HABITATION. The will have to spend a shit tonne of money to renovate it before it can be rezoned as apartments/condos. This bit of regulation was done on purpose because businesses thought they would be full of people forever.

    1) How can u balance the rights between homeless people and business owners? Simple... businesses are "property" homeless people are human beings...last I checked, using lethal force or weapons producing GBI in the defense of property was a very clear violation of the law -- a serious felony. Doing so to defend life -- either your own or that of another person -- is a much different matter.
    2) I'm homeless for going on 10 yrs now...I've noticed encounters on both side have excalated on avg -- often to include violence. Ive seen instances where both homeless and housed citizens are guilty of that. But what is more alarming to me, is how often the story and facts are skewed or downright ignored --- and I'm sure u can guess how and whom that bias favors. If not, maybe this will help -- Im constantly in fear of residents around here, both for what they've done (and gotten away with) and for what they're capable of. I stopped calling the cops years ago -- they're no friend to the unhoused where I'm from -- I instead rely on my own ability to defend myself....for that, I carry a .38 snub nose...that's where we are at folks...let's hope assholes with bear mace take notice
