Thanks. Towards the end of the presentation you seem to suggest something about common law as we know it today. What do you mean by this? Presumably common law stands over against the system we have now, especially that most courts deal with civil cases. This is not common law.
Common law is presumably, in England, the foundation of all law (the academic literature suggests so), but this is at odds with the creation of the many statutes pushed through by the government. This creates a paradox. Presumably common law is the more important. Something has gone wrong and there’s a hunger in many people to claim common law rights. After all, governments get it wrong at times, and we need protection. Common law is for the people, isn’t it?
