As someone that's actually been the victim of fraud and had an opportunity to sue the individuals, this is not how a fraud case would go, over a certain amount it's a criminal case and the DA, the loaner (Bank), and the FTC will be involved. Also any debt would be wiped from his account once the judge makes the ruling, as it'll be considered fraudulent under law meaning the victim did not accure the debt.

You would be surprised how many people have 125,000 college loans and only spent $60,000 to $90,000 in actual college debt
