Telling the guy how long you've been there and asking him how long he's going to be there are not the same as telling him exactly what the problem is and exactly what to do to solve it while also leaving out NON-violations - like leaving money in view - which just clouds the issue and increases the tensions because of his criticism. Is there a reason why the officer didn't instruct him to simply turn off his vehicle and pocket the keys? I'm fairly certain this could've been handled in a VERY different way by both the officer and the man. Crazy.
Once the cop saw the unattended running vehicle it was probable cause for a contact. Once the driver came out and admitted to being the (negligent) driver, the scene became an investigation (a "stop"). Really it's on the cop for letting the scene get out of control from this point on. There's important Supreme Court Of The United States (SCOTUS) case-law that covers most of this (Whren v. US, Illinois v. Wardlow, Pennsylvania v. Mimms, Maryland v. Wilson, Bredlin v. California, Chimel v. California, Terry v. Ohio, Graham v. Connor) Here's the train of shame of errors by both parties: 1) The Driver acted (and may have believed, despite the explanation from the cop) as if he hadn't done anything wrong - this ain't the 1960s, they ain't just "looking for browns". 2) The Cop let the driver aproach a running vehicle without identifying him or verifying ownership first - basically a setup for a suspect fleeing in a vehicle. 3) The Cop let the driver enter the vehicle without detaining him, and then doing a quick threat search first - basically a setup for a suspect pulling out a weapon he didn't see with his quick visual peek inside the vehicle. 4) The Driver, unaware of the legal requirement for a stop, though he had an opinion that overrode the Cop's - and refused to listen to lawful instructions. 5) The Cop didn't de-escalate by explaining that he just wanted to verify he is the owner of the vehicle, check to make sure nothing ELSE is wrong - write him a ticket and be on both of their ways. 6) The Driver initiated a phone call to "someone" inside the building "asking for help" - this is super dangerous for the Cop, he has no idea who is coming out and with what intentions or potential weapons. That innocent/naive "asking for help", is actually an escallation to the Cop (you might not like reading that, but the above SCOTUS caselaw of Graham v. Connor - says we must look as an objectively reasonable person from the Cop's perspective). 7) The Driver continuing to not listen to instructions was now not listening to instructions about his belated detention (resisting the officer). 8) The Driver upon hearing the officer calling for backup, batters the officer to break free, and then flees (fleeing and eluding) 9) The Cop and his backup now have to search a large area becasue the Cop wasn't in shape to keep up with the suspect. 10) The Driver hid in a nearby location and then hoped he wouldn't get found, but dogs are better than that. 11) The Driver hit the police dog once he was found (assaulting an K9) 12) The Driver continued to refuse to follow commands, prolonging the dog-bite until he eventually was dragged out. 13) The Driver got arrested for now what is a long list of crap that didn't need to happen. 14) The Driver continued being mouthy in holding, rather than shutting the heck up and letting that 5th Amendemnt work for him - too busy still believing hie was only a victim and did nothing wrong despite obvious signs around him that he should have doubts (typically the jail cell slamming home does it though). Once a situation has presented itself so that a cop has to make contact for the event - there are certain minimum things that must be done: Identity, warrant check. If the police stopped a person for something and then didn't do those two things, you could have a case where if that person was wanted for an ongoing crime spree - their department might be potentially civilly liable for anything that that suspect did until they were eventually aprehended. If the ID comes back as a match, there are no warrants or extensive history of criminal behavior, and the story checks out - it's the cop's leeway (based on department policy) whether or not he writes the ticket for the unattended running vehicle. It's at this descision point that the officer's interpretation of the interaction weighs on the descision - not 5 minutes of begging, downplaying, and then fighting and running before he even gets through the other stuff. We have this culture of presumption that cops want to f-up your day, in the last 10-20 or so years, there is almost no way that can happen anymore WITHOUT consequences, more so even in the last 5 years. FAFO works both ways pretty reliably now, so we need to be teaching kids "take your licks" (own your actions and their consequences) - if you feel like you were given more licks than you deserved, TALK TO A LAWYER FIRST, then deal with it in the courts. You don't file an excessive force or harassment complaint on the streets... They have a form for that online now. I say, give a Cop a chance to show you they are looking out for you and everyone else, and let them surprise you with kindness - don't presume malicious intent, it darkens your soul. Like Yoda said: "...Fear is the path to the dark side. Fear leads to anger. Anger leads to hate. Hate leads to suffering..."
It's absolutely crazy how things escalate within minutes. Within the first 2 minutes of their interaction, it goes from just checking in with the person who left their car on to possibly giving them a warning, but then to actually detaining the person.
If he had a really good lawyer and just sat down after the first case, he probably could have gotten the original charges dropped. The fact that he got in trouble again and even flipped his Jeep to try and avoid consequences just proves he is crazy and a danger to his community…
If he would have just shut his damn mouth and not acted stupid, this was an easy one. He was on private property and police do not have the authority to issue traffic citations like this on private property (trust me, I looked up the law in Florida). Yeah, the cop had no authority in that instance, but it's not something you argue there... you take it to court.
@@johndeeregreen4592 - Five seconds of Google searching suggests that they actually DO have the authority to issue traffic citations on private property in two specific scenarios: ------ 1. If the landowner has a written agreement with law enforcement (unsure whether or not that was the case here, but it's certainly possible that any large apartment complex like this one might choose to do so): "Florida Statute 316.006(3)(b), which states that an officer “may exercise jurisdiction over any private road…if the county and party…owning or controlling such road or roads provide, by written agreement…for county traffic control jurisdiction over the road.” Basically, if a land owner (apartment, condo, shopping center, etc) has a written agreement with law enforcement, then the cops may issue traffic citations on their private property". 2. If the public may travel by motor vehicle on that property (while the entire apartment complex is presumably private property, the public are presumably not restricted from entering the roads and carparks of this private property, such as when visiting residents etc.): "This office has stated that the provisions in Chapter 316, Florida Statutes, are enforceable on private property only if the public may travel by motor vehicle on such property.[3] This conclusion is based on section 316.640, Florida Statutes, which provides, in part, that municipalities must enforce state traffic laws on all municipal streets and highways "wherever the public has the right to travel by motor vehicle." It’s easy to judge someone when you aren’t in that situation at the moment. When someone is under stress, the brain doesn’t function well. Stress hormones (cortisol) impairs memory. Under threat, circulation goes right to the lungs and heart to help a person prepare to fight or flee. Adrenaline kicks in for the same reason. This is why people make poor decisions like this. That’s why officers are trained military style- that way muscle memory kicks in when a situation escalates. Same with ER doctors/nurses- you have to re-certify for CPR training every two years, because in stressful situations, your brain might need time to get its bearings, but muscle memory will kick in right away. If he was an experienced officer, he would have recognized the signs of stress response from the dude and tried to de-escalate it, but his own adrenaline got in the way of clear thinking and he just reacted (again, this is the military-type training kicking in) to the dude resisting and perceived it as a threat. @elianimationgames1327 buddy you must have not watched the beginning of the whole interaction. Cop was talking to the guy like he was scolding a child and the dude was apologetic and not raising his voice at all.
I really think this time I’m going to defend the owner. He was being polite up till the 3:00 min mark. He was being harassed and the cop should have handled something this minor a little differently. He made the guy angry when all this was no big deal really
Polite does not equal cooperative/responsive. There was probable cause for the contact, and the Driver did nothing to help the officer satisfy his investigation other than the initial "Yeah it's my vehicle". Also helps if the DL and insurance you promissing to provide is valid, which it wasn't if you listen to the charges at the end... Driver likely knew this and that's why he looked like he wanted to rabbit (body language, showed he wanted that interaction over NOW, knowing that the longer it went on the more likely the Cop was going to discover big problems).
I lived in Florida for 52 years and I had no idea this was a thing. I can’t imagine how many times me and my friends left our cars running. Actually, one time we all met at a 7-Eleven. We all got in one car and drove to a sporting event. we were gone for over four hours. When we got back, one of our friends noticed that he left his car running the entire time. 😂
what if a drunk got in the car and drove it into a crowd of people? what if kids too the car for a joy ride and into a light pole at high speeds, etc.?
That was one excellent and stealthy K9. I don't think I heard one bark out of him - his handler made more noise than Cash did. And he was quick - once he caught the back-tracked scent, Cash went right to the guy and held him without a growl that I could tell. Great work by the officer and his K9. A year - that sounds like a good start (since previous criminal history was not cited) for this guy's life of crime.

He seems to think rules do not apply to him. He parks in residents parking spaces instead of the visitors lot. Got towed once for doing that and so he tried to game the system instead of just following the parking rules on that property. Thought by leaving it running with flashers on his jeep would not get towed a 2nd time...only this time his unattended running jeep was reported to the cops - didn't think he had to do what cops told him to do either...so do you think that after spending a year in jail he will park in the visitors lot next time he visits his sister? Right?! As a non-American what usually surprises me most about these videos from the US is the comment sections that are most of the times siding with the cops. First of all: NOBODY likes a lecture by a stranger about their own property and how to handle it. Yes, he is a cop, but he's also a human and a stranger, too. So don't act all superior just because you're a cop - it comes off as power-trippy instead of honest concern. He could have just asked him NICELY to turn off the vehicle without all the unnecessary lectures. SECOND: How insane is it to expect someone getting attacked by a dog to not try and fend off the animal - I love dogs and respect K9s, but if a police dog came after me my priority concern is not my previous wrong doing, it is not getting hurt. That's just human instinct. I'm sure the dog can take it, this man had no weapon on him to seriously hurt the dog. Fun fact: On average, US officers spend around 21 weeks training before they are qualified to go on patrol. WITH FIREARMS! As a German this to me is absolutely bonkers. Especially in a country where not only cops carry firearms but almost half of the civilian population also does. This short training time and in many cases poor training leads to escalations like this. I'm not trying to bash the US or anything, but I honestly wouldn't want to live there. I'd feel so unsafe, it's mental. We have police violence in Germany, too, unfortunately - but nowhere near as bad!
If you watched to the end, it was a charge--that doesn't necessarily mean guilt, He had a court date where he could have easily protested the charge against the dog. What we see is very blurred, but if the judge sees unedited footage and agrees with his protest about said charge, that one charge would have been dropped. However, he not only skipped his court date a month after the initial arrest, but when officers went to arrest him for skipping court, he took off in his jeep leading to a high speed chase resulting in a nasty crash. THAT'S where his real heavy charges stuck him in prison for a year. Oh and ultimately that dog charge was dropped in the end anyways. Side note, what a good dog! Always impressed with how well they can track a suspect down.
@@kaoskartoffel6572 I'm not a big fan of cops, but the reason that he is acting superior is that, at that moment, he is. This entire huckabuck could have been avoided if dude just showed ID. There is NEVER a time that wrestling a cop, or running from one, is going to be a great idea.

I don't think he had valid licence or insurance. So he couldn't show his licence as he didn't have one. I think if he'd just been a bit more astute about his demeanour, the cop would have just given him a warning about leaving his car running unattended. I don't think the guy is particularly bad but he was operating the vehicle illegally. His instinct to run caused the situation to escalate. His failure to appear compounded the issue. His instinct to run a second time just made it worse. He was rather silly.
The officer was provocative. The guy was already walking out the door . All the cop had to do was give him a verbal warning & remind him of the laws. The guy was calm and apologised. There was no need for this. Just a cop wanting some action
I live in a state where this is the law as well. It exists because people in high theft areas leave their vehicles wide open to theft and the police/government are tired of expending resources on what could be an easily preventable crime. It's a law against idiots practically giving away their cars to thieves and then raising Cain about it. Somewhere along the line we lost common sense so we had to make dumb laws in some crazy attempt to make people realize the obvious. I think the officer should reflect on how he handled this, but ultimately the suspect could have de-escalated as well by complying.

He made it worse but the cop was making a mountain out of a mole hill. He was lecturing him on leaving a car running for a couple minutes which isn't a big deal. In northern states almost everyone does this in winter. The law is stupid. If it gets stolen that's on him. It's a victimless crime. It's more akin to the work a hall monitor would do than an actual cop. But I wouldn't have escalated and would have gotten the encounter over with so I could go about my day. IMO that law reflects poorly on the police department and shows low faith in them on the state and local level. The perp's sister wasn't trying to hide evidence, she was only turning off her brother's running car and getting the keys because it was running there outside her house and they took off. Look into an education perhaps. Your comprehension is horrible. 😂
Connor)
Here's the train of shame of errors by both parties:
1) The Driver acted (and may have believed, despite the explanation from the cop) as if he hadn't done anything wrong - this ain't the 1960s, they ain't just "looking for browns".
8) The Driver upon hearing the officer calling for backup, batters the officer to break free, and then flees (fleeing and eluding)
9) The Cop and his backup now have to search a large area becasue the Cop wasn't in shape to keep up with the suspect.
10) The Driver hid in a nearby location and then hoped he wouldn't get found, but dogs are better than that.
11) The Driver hit the police dog once he was found (assaulting an K9)
12) The Driver continued to refuse to follow commands, prolonging the dog-bite until he eventually was dragged out.

@@vdub7090 - Did you not listen to the voiceover at the end?
@@johndeeregreen4592 - Five seconds of Google searching suggests that they actually DO have the authority to issue traffic citations on private property in two specific scenarios:
------
1. If the landowner has a written agreement with law enforcement (unsure whether or not that was the case here, but it's certainly possible that any large apartment complex like this one might choose to do so):
"Florida Statute 316.006(3)(b), which states that an officer “may exercise jurisdiction over any private road…if the county and party…owning or controlling such road or roads provide, by written agreement…for county traffic control jurisdiction over the road.”
Basically, if a land owner (apartment, condo, shopping center, etc) has a written agreement with law enforcement, then the cops may issue traffic citations on their private property".
2. If the public may travel by motor vehicle on that property (while the entire apartment complex is presumably private property, the public are presumably not restricted from entering the roads and carparks of this private property, such as when visiting residents etc.):
"This office has stated that the provisions in Chapter 316, Florida Statutes, are enforceable on private property only if the public may travel by motor vehicle on such property.[3] This conclusion is based on section 316.640, Florida Statutes, which provides, in part, that municipalities must enforce state traffic laws on all municipal streets and highways "wherever the public has the right to travel by motor vehicle."

dont be so sue. in a situation like this where a cop tries to trigger you after a long stressful days. i doubt ur brain could handle that crap
It’s easy to judge someone when you aren’t in that situation at the moment.
And honestly, rightly so, because plenty of people try and buy time so then can formulate a plan quickly and run or draw a gun.

@@alextv8975 I watched the video in its entirety. As a retired K9 officer, I can say there was no reason to even give chase. His vehicle was clearly not going anywhere & a simple run of the plates would’ve revealed his identity. If not, the cooperation of his sister would have. This is a case of horrible police work, period.
@@novanero7847 . Bottom line is you do not interfere with a police investigation. She clearly saw her brother fight the cop. A reasonable person would conclude that the vehicle should not be touched until the police are done with it. We're not talking about whether the officer handled it correctly. We're talking about a bystander stepping into the investigation.
37yo and he's wearing his cap backwards? What a prize
That police officer was having a bad day and decided to take it out on him.
Trying to arrest the guys sister was retaliation at its pettiest
She, being someone who was known to the suspect, tampered with an active crime scene - who knows what else she pulled out of the car. Probably innocent/naive, but she basically just gave them probable cause to search her whole apartment. Cops didn't know who is in that apartment other than was was said (a statement isn't proof, it's a statement that needs to be verified).
Funny. I never seen the sister in handcuffs or being put in the back of a car. She tampered with evidence and he could of arrested her. He allowed her to explain her actions once he determined she was not a physical threat. Unfortunately families are known to get involved and commit crimes for there family members every day. She responded to the officer in a civil manner and was briefly detained and then allowed to continue her evening shortly there after.
@@puffybobs What crime did she commit?
@@corriblehunt4554That has been answered twice already. What you see as "petty" is a crime none the less. As a habit people need to not insert themselves into crime scenes or ongoing police action unless specifically requested or instructed by Law Enforcment - and ethically, family (though it REALLY EMOTIONALLY HARD) needs to not get involved.
@@Real_Tim_S He was being arrested for leaving his vehicle running. All she did was try to turn the engine off, after the suspect and officer had already left the scene. You're making a bigger deal of her actions than is necessary. Just like the cop did, at first. Before he realised how dumb he'd look . He couldn't catch the real criminal, so he went after his relative for a few seconds. The officer came to his senses. Odd that you haven't
Something tells me that this guy is going to have more issues with the police. He just doesn't seem to learn. Glad the dog was alright.
Yeah I expect he makes bad decisions in other areas of life too.
He SHOULD have "issues" after this stupid, ill trained moronic cop turned a friendly traffic caution into several 'crimes', a year in jail, and the rest of his life ruined.....
He had no record prior. Back the blue until it happens to you. Any cop can ruin your life for any reason. If he just don't like the way you look, he will find a crime or escalate to violence then charge you with resisting. I've seen cops do it just cause the cop seen a guy with a hot girl and he wanted to bully the guy Infront of her, I've seen cops threatened driver to see how much it would take to make the driver cry. Most cops a sycophants
It was ruff... but he made it through.
Something tells me this officer has had just as many complaints about his ego and inability to de escalate these situations. What an unnecessary mess he allowed when it could have been solo much easier. Not saying man attitude helped by any means.
I love how people think the more times they say something, it's going to change anything.
Seriously hasn't this cop got better things to do with himself
Dude turned a maximum of a small fine into an entire year in jail, and honestly considering those charges and the state this happened in that is incredibly lenient.
Cop probably wouldn't have written a ticket anyways if he knew how to respect authority. Maybe he'll learn now.
Luckily this wasn't in Wisconsin or he'd probably had all the charges dropped & the court would have given him a free breakfast at I-Hop!
Let’s hope the other convicts enjoy him regularly!!
Yes it was lenient. I live in Md. he could have been facing up to ten years' imprisonment and up to a5000.00 fine. Just for the battery on a LEO
@@LeKapitaine i think you meant a nazi/ukranian dude. Their soldiers are covered head to toe in nahtzee tattoos
You could tell the cop took this personally, once he threw the dudes keys at the car (you can hear them slide off) it was clear. Officer is nothing more than a little boy that can't control his emotions. Its crazy but I honestly believe a good amount of officers forget its their job, maybe they should work in fast food for a month to humble them and their "power"
Yeah a lot of them are psychopaths. He’s even cheering the dog on for biting the guy. All of this over an idling car. This is why most people have no respect for them anymore.
LOL the irony of you calling him a little boy that cant control his emotions while at the same time being insulting and calling people names in multiple peoples comments because they dont share your opinion..... adorable.

@SOREN_ it's literally a state law to not have your vehicle idling I don't know wtf you mean state power your just a little kid
