Salient Parts of the Supreme Court Decision in XXX vs. People:
“Psychological violence is an element of violation of Section 5(i) just like the mental or emotional anguish caused on the victim. Psychological violence is the means employed by the perpetrator, while mental or emotional anguish is the effect caused to or the damage sustained by the offended party. To establish psychological violence as an element of the crime, it is necessary to show proof of commission of any of the acts enumerated in Section 5(i) or similar such acts. And to establish mental or emotional anguish, it is necessary to present the testimony of the victim as such experiences are personal to this party.”
“Marital infidelity is one of the forms of psychological violence. The prosecution in this case was able to satisfactorily establish petitioner’s marital infidelity, his cohabitation with CCC who even bore him a child, and his abandonment of AAA. BBB’s psychological trauma was evident when she wept in open court upon being asked to narrate petitioner’s infidelity. In particular, BBB explained that she was deeply hurt because her father had another family and loved another woman other than her mother, AAA.”

I understand divorce is against the Catholic teachings but abusing your spouse or children is against God's word. Nobody should be trapped in an abusive relationship. Mental or physical abuse doesn't provide a healthy family environment for anyone. Often, children will grow up repeating the cycle. I'm not advocating divorce over every disagreement but, violence, neglect and abuse are at a level of exception. Marriage is a serious commitment between two people. Infidelity breaks the holy bond of matrimony.

Physiological po at physical injury po ang case.almost 9 mos na po since na nag PI po kami wala Pa rin po sa pagfollow up ko po laging for approval ang sagot.di po kya natatabunan na ung papel ko ?tnx po sa pagsagot

i felt unfair sa ba+as na i2, kc my father suffered psychological and emotional abuse sa pangangaliwa ng nanay ko. tpos dahil ako na ang 2mayong support ng tatay ko, i worked abroad nagsikap ayusin ang bahay nmin, wala nmn kami nakuha suporta sa nanay ko. ngyon sinisigaw nia conjugal rights nia. feeling ko parang lahat ng pagod ko nabalewala kc parang wala na ako mapapala sa pinaghirapan ko. eh wala nmn ang nanay ko nung mga panahon na need ko xa at ng tatay ko. 78 si papa nung iniwan xa. 46 si mama. ngyon kasma nmin bagong kabit ng nanay ko. ang saklap.

required po ako undergo ng treatment sa psychologist and psychiatrist medjo matagal nga skedyol wait matapos hanggang magkaroon na ng findings ang mga doctors na sumuri yon ang isa sa gagamiting grounds bukod sa mga other evidence ako diagnosed my findings is emotional distress ongoing ang vawc namin sa april 24 meron kami court hearing anyway sa PAO pala ako lumapit kaya wala akong charged sa lawyers fee service

Atty may tanong lang po ako tungkol sa RA 9262 nakasuhan po ako Ng RA 9262 year 2010 pero na desmisses na po yung 9262 na kaso ko on 02/14/2012 date and sign by:my atty:my ex wife atty and the judge..pro ang tanong ko po syu atty ay Bkit po ako kinasuhan ulit Ng RA 9262 Ng ex wife ko this year 2023 nakatira po ako dto sa u.s atty at american citizen po ako.
