If I demand a temporary rent reduction (due to covid) and threaten to move out of a commercial space can they put a chain on my door?
So anticipatory breach is not the same thing as repudiation then?
There's no such thing as an anticipatory breach. If the time for performance is due than it is a breach. If the time of performance isn't due there can't be a breach since the seller or buyer can technically still perform and thus there wouldn't be a breach. So because it's unfair to force an aggreived party to wait until performance is due when it is clear the other party will not perform' courts allow you to seek damages for an anticipatory repudiation (which would be a breach if performance was due).
That's why it matters that you be absolutely sure that it is an anticipatory repudiation and ask for assurances of performance. Otherwise you could be in breach if the seller delivers you the goods in the contract prior to the performance date and you refuse to take delivery.
Or even starting a cause of action to terminate a contract could be seen aa your repudiation of the contract

Depends on if you want to terminate the contract or not. Any lawyer would seek both. Or you can sue to make the other party perform
