Did you know that these types of buildings have been found by the courts to be non-public buildings? This means that administrators can determine what restrictions are applicable or not in order to service the building's purpose. If you don't follow these restrictions, they can trespass you from the government building. Would you like me to cite the cases that prove me correct?

They can have certain hours where they are "open to the public" - sean was there during those hours. They can also have areas that are "restricted access" where the public may not enter - sean was not in any of those areas. If a person is in an area that is publicly accessible they cannot be trespassed. You seem to be confused. You think that because they are allowed to make certain restrictions, that NONE of it is publicly accessible. This is just ignorance

Actually, that goes back to French justice, including Napoleonic Code. When Louisiana was under the French it was still that way: guilty until proven innocent. (Joan of Arc knew about that mentality.)

The first cop is very unprofessional and immature, simply unable to identify, it took way too long, shameful for a man of that age. The security guard was actually much more professional than the first cop. I hope somebody learned something this day!

Signs without legal backing should say things like, “Our preference is no filming”.

We pay for these records, the building these records are housed, the security and police that are used to protect these records from the people that pay for everything and incarceration and processing of the law abiding citizen that checks up on our spending. He said that it was not a law but a policy and since it is a constitutional right to photograph in public and public places and the room houses public documents then Sean has a right to be there and the sign is wrong. That is dangerous the officer saying the policy can supersede the constitution. I would say it's probably unconstitutional to be denied access to view public records (14th Amendment most likely), but they can charge a reasonable fee for copies. Viewing and/or photographing them yourself should cost nothing.

We don't decide whether something is unconstitutional or not by whether it is literally in the Constitution, we use the courts to interpret what is or isn't in line with the Constitution.
They can charge for the cost of producing copies, which in the recent pre-digital age was a measurable cost for blue prints and plans on large format paper. The *You Cannot Take Pictures* makes no sense what so ever though.

These public workers weren't wrong, though. Courts have found that just about all government buildings are non-public buildings subject to restrictions on recording.

People who want to become citizens of this country have to be tested I'm sure. To have to study for knowledge about history, laws, conduct and so on. I always find it creepy when the workers approach Sean and ask "Can I help you?" The question is always in the same, creepy tone. Always. And they never mean it, either. They never mean to offer help, they just use it to ask their follow up "Are you recording?" I cringe every time I hear it.
The tone and approach is not 'creepy' - it's actually dominance, cloaked as a question of phony helpfulness. It's underhanded. Think of it as 'the iron fist in the velvet glove'.

I've come to rely on it. It astounds me when they are cordial and uphold our rights.
The officers were entirely correct. This building is a non-public forum which means the administrators can restrict recording. Failure to follow this policy (yes it's just a policy) can result in trespass charges if they ask you to leave and you refuse.
The criminals in charge don't like smart cops.

I had a similar experience at my local court house. I was trying to find my title deed in the public records department and was told that they would be glad to give me copies of whatever I found. I told them that I would just take a picture of the screen if I needed a copy. The clerk pointed to the "sign" that said no photos or video allowed and told me not to take a picture of the screen. I said that I would if I wanted to. The supervisor came out and told me it was against the law to take pictures in the record room. I asked for the statue since it was not on the "sign". We got into a small argument about our rights and it ended with the supervisor leaving me alone. She had never had anyone do this she said. That is the problem. We have become sheep and have let our hired hands rule over us. Great job as always Shawn!

It is despicable that taxpayers have to fund creating the documents then are charged money again to get the documents. I am so sick and tired of all the policies, ordinances, permits, and laws that are made when it is clearly against the Constitution.

Most jurisdictions charge a small fee for copies of records that doesn't exceed the actual cost to make them, which is pretty reasonable especially as a holdover from the pre-digital era. Three foot wide plans cost money to photocopy, and having done it the costs of only a few dollars are not unreasonable.
Banning cameras to charge people those couple dollars though is not just illegal and immoral, but also stupid.

They have a budget and if they don't spend the money then they will spend money on what ever to get more the next year. All city, counties, and states do this. These guy were so easily confused. They don't even know the policy nor have they ever seen the policy but they're trying to enforce it.
That's because it usually works against people who don't know their rights thus they are unable to stand up for their rights. The public schools certainly aren't going to educate the public on which constitutionally protected activities they may engage in while inside a government building since one corrupt greased palm washes the other.

Thumps up to these officers! It is fine to be skeptical until they figure something out correctly. The Recorder of Deeds likely doesn't realize that their security recordings can be viewed by anyone after a FOIA request. Recording isn't "creepy". They already know they are being recorded much of the time. Privacy is increasingly becoming a civil rights issue, especially after smart phones, and more folks should learn that there is no expectation of privacy in public.

The problem is, they THOUGHT they knew what they can and can not do. They were willing to escalate on their own, even after you asked for a supervisor. They did not care about the law at all! They would have kidnapped you if they did not take your advice and contact someone to find out the REAL law. Sad state of affairs!!

The country is so messed up that government workers think they have a right to privacy in public, and even put signs up stating that. Thanks again Sean for educating people about our rights. I wish i had a camera a few years ago when two cops beat the heck out of me when they were looking for someone else. They came to my house and attacked me for nothing. That happens a lot in the country. Cops always get away with it too.
