  • A jury found armorer Hannah Gutierrez-Reed guilty of involuntary manslaughter and not guilty of evidence tampering in the fatal shooting of cinematographer Halyna Hutchins on the set of the film “Rust.” Hutchins was killed, and director Joel Souza injured, by what was thought to be a prop gun during an Oct. 21, 2021 rehearsal in New Mexico. NewsNation legal contributor Jesse Weber, "True Sunlight" podcast Liz Farrell and "To Catch a Predator" host Chris Hansen join "Dan Abrams Live" to discuss.

Yes that is the law and noone else can relieve you of the legal duties that goes with it. That is why the government does not call them props even in stage use. If it is able to fire a round it is a gun. There are props of various materials the look real but lacks the means to fire any round. They even make blank only guns that have an only partly bored barrel and vents added at slight angles to permit gasses to pass for smoke. They often will have a stepped chamber to preven a real bullet from being introduced also. Still has some risk in the revolver styles fireing blanks as there is a gap that can cause the holder to be hurt with an improper grip resting past the cylinder.

The safe handling of a firearm is not a "job" . It is an individual legal requirement set forth in state and federal law. Handling of a firearm with a willful disregard for the safety of others is considered criminal negligence. If a person dies due to that criminal negligence, then it is involuntary manslaughter.
There is LOTS of case law on this. After all, Baldwin isn't the first person unintentionally shooting someone. It happens about 500 times a year nationwide. The most uttered sentence after an unintentional shooting is: “I thought it was unloaded”. It never works in court.

The woman doesn't grasp the concept that more than one person can be culpable for the same crime. Just because Halls and Hannah G were convicted for their roles it doesn't absolve Baldwin from his responsibility in the tragedy. He was in possession of a deadly weapon. He knew it was a deadly weapon and failed to exercise due care and circumspection. He failed to personally verify that the firearm was safe by inspecting it. Secondly, he acted recklessly by pointing a firearm at another human being (a firearm that he knew was capable of lethal force and that he had not personally verified to be safe). Thirdly, he pulled the trigger. regardless of what Halls or Hannah G did, his responsibility existed discreetly, and he will be on trial for involuntary manslaughter with a very strong legal case against him. He won't be able to offload his responsibility for gun safety onto anyone else regardless of what they have been charged and convicted of. Special rules regaridng gun safety don't apply because you are on a movie set. One size fit's all.

The should not have been both the prop girl and kinny are suspect but as defense pointed out the evidence was thown away and as they had a walk out over safety the day before, tampering is posible too. Many reported they would do target practice between takes as well, if true that is troubling indeed. It is rare any live rounds should be used on any normal set but there are a couple exceptions.
Documentry or testing shows that film how guns and ammo perform, sometimes against various items. Some reenactments or range shoots in a limited way with a gun range condition. Also with reenactments actors often spend weeks to train before filming. TNT's Rough Riders had some good bts bits if interested. Also some civil war reenactors can give detail. Glory had a couple live shots I believe with the load faster bit as they show the whole loading process.

Alec Baldwin is not the only additional person that should face a trial - the others mentioned below should also be in the dock!
Only having just watched most of this trial, the evidence given by Seth Kenny seems that is has been over rehearsed with the Prosecutor beforehand!
It is twisted and confusing in order to baffle the jury!
The Defense didn’t intervene to insist that his gobbledegook be clarified for the benefit of them!
Why was Seth Kenny not fully investigated?
Why was Sarah Zachary given a deal by the Prosecutor?
Why was David Hall, the first assistant director and safety coordinator, allowed to get off with a 6 months weird charge after claiming that he was “negligent" and should have checked the firearm.
What actually qualified Hannah Gutierrez-Reed to be given the job of Armourer in the first place?
Who actually gave her the job of being an Armorer on the “Rust” set - how did they assess her capabilities and experience to do the job correctly?
What paperwork was signed and how was she paid and by whom?
If this was presented as evidence then it wasn’t apparent to me in what I was watching.
Hannah has more of an appearance of an adolescent teenager and not that of someone capable of being in control as is expected of an Armorer!
David Hall was the first assistant director and safety coordinator on the set of the movie “Rust” with Alec Baldwin. Hall took the stand to say he had no concerns regarding armorer Hannah Gutierrez and her performance on the job.
Someone supplied or brought live rounds onto the set but they can’t prove who that was.
Hannah has been found guilty of involuntary manslaughter.
Yes, she warrants blame but all of the others do so too!
She should not have been in the dock alone and to me this appears as a miscarriage of justice.
I did find it really strange that at one point whilst giving his evidence, Seth Kenny actually took out his mobile phone on the stand to “look at something” and no body intervened!

Baldwin said in his famous tv interview that he was asked to point the gun towards the camera by Hutchins. That is what we believed since her death. In the trial, the director clearly says he was only to pull the gun out sideways to figure out the scene, never to point it at the camera. That is going to bite Baldwin big time. Doesn't matter whether he checked the gun or not, he willfully pointed it at a person when he wasn't supposed to, and accidentally pulled the trigger.

So in my book Hanna is responsible for not doing her job. If she did not know where the amo was coming from who did?
