It’s absurd this issue is still an issue after more than 50 years. However, part of the reason it has taken so long is the counterculture did not make good arguments and the legalization of pot was often tied to legalization of other drugs or even all drugs. It is really ironic to think that the Supreme Court at the time was so very liberal yet the counterculture failed miserably at advancing any real change in our society.
If you were a member of the establishment and reasonable people were out there starting to think that there were some reasonable changes that ought to be made, and you didn't like them, it would be in your best interest to make sure those reasonable ideas are represented by absurd caricatures. I think Rubin was a true believer and understand why he thought his tactics would get exposure, but when you push too hard it just becomes contrived and people turn off. However unlike maryjane, alcohol is also made in our digestive system, by the same process that is used to make it in cooking vessels. Alcohol, in the form which people consume as wine, liquor, or beer is a manufactured product using natural ingredients. Marijuana can literally be picked from a plant in it's natural state in the environment, and be consumed by people. So there goes your absurd little diatribe in two sentences.

For example fruit that is very ripe, including grapes, actually any sugary substance such as sugar cane, can start becoming fermented, after it drops on the ground, or while still on the vine. It becomes fermented. the same way grapes are fermented on purpose at home or in a manufacturing facility. Historically people have eaten such fruits. You can pick such fruit and get alcohol into your blood. I would say that perhaps whiskey or vodka is manufactured, in a very simple heat distillation process, but alcohol itself can be picked from the vine, the tree, or the ground, the same way as cannabis. By the way the same thing goes for opium poppies. You can pluck the fruits from wild poppy plants (Papaver somniferum) and eat the fruits, and get morphine into your system. At certain times during development of the plant there is also some morphine in the leaves and stem.
