The first judge dropped out because he and his family were getting death threats now the new judge won't let hardly any evidence in that helps him, she is very very against the defense. It's sickening the way she's treating him!

Then him telling them he did it, and telling his wife that he did it while in a psychotic state of mind. The nurse at the prison was a true crime junkie and telling the outside world about her sessions with Allen. She was fired from her job, but they still used the videos.

Initially said he left work and then went to service some ATM machines before going home which would put him on the access road near the end of the bridge where the girls were kidnapped much later and outside the relevant time frame. Apparently he drives a “white van”. After Richard Allen was put in the frame, he changed his testimony to say he came home straight after work and would have been on the access road to his house in that 2:30 time frame. The prosecution says this shows guilty knowledge, Because in one of Allen’s ‘confessions’ he says he was spooked by a white van and took the girls from a hidden spot below the road to cross the creek and go to the area they were found where he unaliver them. There are several issues with this scenario, one being that the bottom of the hill from the bridge is about 60 feet and to the road from the bridge is about 30 feet- Libby’s phone recorded only a 2 story drop in altitude which might be enough to get them to the road, but not the very bottom of the hill. Were the girls taken somewhere before being brought back to where they were found? 100% I do not believe Richard Allen did this- too many issues with the prosecution’s theory- and the fact Allen had all the case discovery which mentions vans in several places means this is not info “only the culprit would know”. Also, it doesn’t make sense that in his confession he would say it was a ‘white van’ that spooked him as he wouldn’t be able to see it from where they supposedly were- I think if that story were true he would have simply said he heard a vehicle…

It happened. The state opened the door, but the judge ruled against the defense anyway. The defense also dealt with changing testimonies of witnesses from previous depositions. The rules for properly impeaching a witness were constantly changing so that the judge continued to rule that the witness was not impeached and therefore the defense could not introduce proof of the lie. In particular, one of the themes of the state’s case was that Rick Allen knew something “only the killer would know” (existence of a white van). A witness for the state lied about white van info. The defense had ready an FBI agent who deposed the witness previously and could offer proof that the witness lied. State would not consent to zoom testimony from the FBI agent. This info never made it to the jury.
This witness was explosive and angry the first time on the stand. Also, I think it was this witness that said they didn’t know why the police called them back in to interview and that they reviewed texts to have that info for when they went back into the police to talk to them. “How did you know what texts to review if you didn’t know why they were bringing you in?” Huge moment. I think the testimony you're referencing needing to change is Brad Weber. It's known he said he left work and went right home but during an interview with the FBI he said he went to work on ATMs. His property is right next to where the girls were found and his gun couldn't be excluded as the potential one that ejected the bullet found at the crime scene.
Just a thought : maybe Richard is guilty, but he didn't work alone. He wants to mention the other players, but he knows that would put his family in danger.
