- A video case brief of Texas v. Johnson, 491 U.S. 397 (1989). Check out the full-text brief here: www.quimbee.com/cases/texas-v...
After publicly burning an American flag as a means of political protest, Gregory Lee Johnson (defendant) was convicted by the State of Texas (plaintiff) for desecrating a flag in violation of Texas law. Johnson challenged his conviction in state court on the grounds that the law violated his First Amendment right to freedom of speech. The Texas Court of Criminal Appeals reversed the conviction, and the United States Supreme Court granted certiorari.
The Supreme Court was dead wrong on this one! I’m going to burn an American flag to show my disapproval.
funny
The Constitution protects even those who hold it in contempt.
I have a quiz over this in less than an hour. This was a great summary and will definitely help me get a good grade!
How did it go
Did u get a good grade?
He got caught for plagiarism and was sentenced to life in Detention

Concise information. One problem. In your last picture, you showed the hanging of the US Flag with the blue field and stars on the right. To properly display a flag hung vertically, the blue field and stars go on the upper left.
let's watch as everyone fights in the comments
...hand unit??
I was wondering if anyone else noticed XD
is that Andy Field-
going by that logic something that symbolise the American freedom can be burnt down
I'm a conservative. I find flag burning pretty despicable. I was interested to hear that O'connor and especially Stevens (big ol' liberal) dissented. I do think though that Free Speech > Concerns about flag and think the court reached the right decision. Never knew about the attempt to amend in 2006. Will have to look into it.
A true patriot.
Handunit is that you?!
Okay im still confused because my teacher said no to burn the flag in public only at home so is it illegal?
Its not illegal, but i think your teacher wanted to protect you since some people would not be kind if they saw another person burning a flag
@@maverick5640I can use my 2nd amendment to defend my actions of my first amendment in that case.
Exotic butters i mean exotic lessons
I'm so glad someone else noticed. xD
Me too 😂😂😂
IM NOT ALONE :D
I finally get I'm just an amendment.
ANDY FIELD??
IM JUST TRYING TO REVIEW AND I FIND HAND UNIT???
Ironic that the country whom he hates so much upheld his rights when he could have easily been punished. I hope that was not lost on him.
Him burning a flag doesn't mean he hates the country. It's not like he was burning a fellow countryman and getting away with it
@@ddll6709 but it does though that's the reason he was burning it it's said in the video lol
@@lapris7380 I must have missed the part of the video that explained what was he protesting. Not the other protesters, just Johnson. Can you tell me the time stamp where this was discussed on the video
I got a 50 question English test tomorrow. Send help 😂
I can send dudes
So is burning the flag illegal or not because this video is saying it's when your protesting but you still can when your not protesting. If someone can explain this it would be a big help
Yes burning the flag is ilegal
It is not illegal to burn the flag. Any statute attempting to criminalize flag burning will be found to be unconstitutional. You may burn the flag as a way to convey a message of disapproval or disagreement.
Edward is correct.
@@EdwardTapiaJr thanks bro I was trying to clear that up Bec I had a project about this specific Supreme Court case.
Not illegal, so long as the flag is your property, or the owner of the flag gives the consent to anyone to burn their flag.
When you sound like a fnaf character 😐😐😐
-_-
Bro is this handunit
Thus you have blue line flags, even though they directly violate the US Flag Code. (Yes, that is a thing.)
I’ve also seen us flags with other things on them (lately a lot of political stuff) I mention flag desecration and they’ll go, no it isn’t. Yet they will throw a fit if someone “disrespects” the flag. If they rubbed two brain cells together, they would still be a few cells short of a thought.
like me if you're cheating on a quiz with this. XD
This is like the Colin kapernick kneeling while the national anthem except the burning the flag
except Colin Kapernick is not being prosecuted under state law
He may be making an ass of himself, but he is well within his right to do so.
@@joshglover2370 I know right, damn athletes protesting constant police violence against blacks. He should just be quiet and take his paycheck instead of using his platform to advocate for social change to save lives. What an ass.
Skaroosh I love the sarcasm of this comment lol
Frank H Peterson anyone?
haha love it i was there in 1989
AMERICA , Love it or leave it ,,,, there's the door .
I'm sure you hate that it doesn't work like that. One can hate it and get all the benefits of being American. Also, cowards leave. Leaders acknowledge the problems and present possible solutions. Only sheep believe everything is fine and that there are no issues.
How about not. I have a right to free speech even if it pisses you off. You have your freedom of speech even if I disagree with you. I’m sick of the nationalism movement lately. We are literally following the path of The Soviet Union and Nazi germany (just no camps).
Wrong decision. The flag should be considered a registered trademark of the government subject to its' conditions of use.
That literally would make it just an object (which it is)rather than a symbol. I’ll defend anyone’s right to burn the flag or pledge to it. That’s called freedom.
I have No Respect for anyone that Burns🔥🇺🇸👎🏼

I agree. Flag burning is evil and disgusting, but nonetheless something Americans should be free to do.
