I Haven't been paid my weekly benefits in 8 months. We filed an appeal, but that's likely 4 - 6 months out. Can I takeout a litigation loan ? I won't be cleared to go back to work for at least 4 more months. What are my options ? I'm about to be evicted.

I am sorry to hear that you are going through this. It can be frustrating with how long it takes to get to court about a workers' compensation case. It sounds like you have an attorney, so I would recommend that you speak with an attorney to find out what your options are. Different states have different rules about the ability to takeout a litigation loan.

Thank you for your question. Each state has different rules about workers' compensation payments. If you are dealing with a New York workers' compensation case, I would recommend reaching out to an attorney who handles New York workers' compensation cases to find out about the rules regarding those payments. If you need help getting in touch with one, please reach out to our office at 770-214-8885.

Once reaching mmi and impairment rating does workmans comp insurance have a option to not pay ppd at all after ttd benefits end? My lawyer is telling me I have a total of 300 weeks of benefits. I've used 52 weeks(ttd) I was given a impairment rating but workmans comp refuses to start(pay) my ppd benefits. They offered me a settlement but I refused it. They are trying to stall me out so I can accept a low offer out of desperation. My lawyer gives me excuses why they don't owe me weekly ppd checks. Has he been compromised?

Thank you for your question. If this is a Georgia workers' compensation claim, then the insurance company would not have to start paying your PPD benefits until you stop getting TTD benefits. Georgia law says that you do not receive PPD benefits as long as your are receiving TTD benefits. If your workers compensation claim is in another state other than Georgia, the rules could be different.

@@GeorgiaWorkersCompLawyer the state is alabama. They are telling me that they don't owe me ppd payments after my ttd benefits ended. I'm at MMI and have a 10% impairment rating. I've argued my ppd payments should of started after my ttd benefits was terminated. Are they lying?

I cant find anything about what happens when put on MMI with restrictions, but have been fired/let go and have no job to return to.

Thank you for your question. The answer will depend on what state your claim is being handled in. If it is a Georgia workers' compensation claim, being placed at MMI with restrictions does not necessarily mean that your benefits will stop or that your case will end. Being fired or let go can affect whether you continue to be entitled to weekly benefits after you are placed at MMI, but it depends on the timing of you being fired. If you are dealing with a Georgia workers' compensation claim, I would be happy to discuss with you. Just call our office at (770) 214-8885 to set up a time for a free consultation.

Hi Jason Can workers comp stop my benefits because they are saying why i rescheduled my doctors appointment which is the first time and oddly i would always go at same time, date, month and location and they all got changed to different day time and location, which was hard to get a ride there so i ask for reschedule which they did but now saying that's the reason?
    thank you for the feedback

Thanks for your question. There are some situations under the Georgia workers’ compensation law where the insurance company can try to suspend your benefits for failing to attend doctor’s appointments. However, they have to get an order from a workers’ compensation judge to do that, so they would need to file a motion or request a hearing. They should not be stopping your benefits for rescheduling an appointment. If you have more questions, please feel free to reach out to me at (770) 214-8885.

@@GeorgiaWorkersCompLawyer Thank you so much for your response Mr.Perkins, they told me your not getting paid for the week you rescheduled up to your new appointment date which is 2 weeks so they said no check for that time period. How is that possible sir?
