Good information Owami. However can I clarify this lawyer feee thing? Normally the court orders fees against the person who lost (not always the case). These fees do not exempt the parties from settling their own lawyer fees agreed upon with their lawyers. This means the party against whom the fees have been awarded will only reimburse the party which won “only fees incurred for administration of justice” this excludes disbursements or costs unnecessarily incurred. Please note that majority of the time the fees are subject to a courts tariff unless ordered to pay on Party and own client costs which is rare or does not happen so often. Hence Unathi Nkayi spent R750k but could only recover R20k for example

For a successful claim of defamation you need the ffg:
•statement to be considered slanderous,
•the statement must be false,
•damaging the subject's reputation
•it must be communicated to a third party.
•the responsible party must act negligently or with malicious intent
•proove bring defamed.
