One time in high school, we were assigned into teams to debate a hypothetical scenario. The scenario was whether or not a hypothetical high school student should drop out of school and get a job as a waitress, and I was assigned to Team Yes.
My teammates and I managed to piece together a decent enough argument, but the leader of Team No really dropped the ball for his team.
The entire crux of his personal argument rested on this fictional high school student somehow *losing the ability to read and write* after dropping out.

I got the opposite experience the "Oh shit we're fucked". It was a Medicaid case where we were fighting to get our client the device he needed. Our key witness was his doctor. She was doing great then all of a sudden she says that our client never tried any of the other devices she said he did in earlier documents, she was just using language the company selling the device told her to use. She never told me or my partner that. After that the rest of the case was pointless as she had to try other devices and dismiss them. Didn't matter that he still needed the device. Didn't matter that the other devices were just as expensive. We were fucked and we knew it.

A favorite story that I read on this subject is the plaintiff was claiming permanent disability from an accident. He was suing his insurance company who disputed the permanence. The insurance company hired an investigator who got pictures of the plaintiff doing roof work on his house. Climbing up and down the ladder, lugging hefty tools, moving around on the roof, etc. His lawyer didn’t object to the photos being submitted as evidence and the guy looked super smug. His idiotic explanation was that as he was not a licensed contractor his work on the roof should not be counted as work. Yeah the judge wasn’t buying it.

I have a story for this. One time, as a paralegal, we were in court regarding ownership of a house and representing the Plaintiff. During the cross-examination of the Plaintiff, I realized that I accidentally also included the deed and deed history of another property that our client owned, but was not related to the case, in the trial brief. When the Defendant was being cross-examined, she said that the reason she fully owned the property was because she traded her partial ownership of the other property, which she had never said before. I pulled the deed history of the other property, to keep up and realized she was never on the deed. I quickly signed my boss to come over and saw his eyes immediately light up when he saw the deed history. They settled pretty quickly in court after that

My dad’s custody case was sort of the opposite of a “Got You” thing and more like a nightmare for everybody that’s involved. He was poor because he was basically taking care of the big needs for my siblings by himself. She didn’t take them to dentists, doctors, or anything, and he needed to raise three kids by himself, so he had resorted to researching and representing himself in court. Luckily for him, she lied to her lawyers and constantly cycled them out so she wouldn’t need to pay any major fees. Every new guy that came in was ready with a “solid case” and the judge would immediately tell the lawyer “Your arguments have been given already. We are just here to talk about some custody concerns.” She was uncooperative, annoying and none of the kids liked her. As much as the courts wanted to keep the kids with their mother, my dad remarried within the time these custody battles were happening and it was apparent that it was best for the kids to go with my dad.
She wasn’t happy, but there wasn’t a single person in that court room that didn’t think Justice was served.

Confidentiality is between clients and their attorneys. Exchanges and events elsewhere(such as court) are not covered. Also, there are some instances where you are okay if you do not identify a client by name.

Your generally fine if you keep identifiable information such as the name of client or case. Better though, Reddit let’s you basically be completely anonymous, so they would need to be able to prove that they broke confidentiality which is basically impossible.

As long as it stay anonymous, its okay. Moreover court records are accessible to the public. So anything that happen during court or any event in between that not require confidentiality from the party involved is not a break of confidentiality. Its like when you go to the dentist and your dentist recalling their past cases without mentioning any names, perfectly legal.

Fathers win in a few instances:
      - They are extremely smart and resourceful with a lot of evidence
      - The mother is just that awful
      - They get lucky on where their case is being held
Or a mixture of each. But it's a well known fact that the court system is bias against fathers due to the laws being made when people still thought men were only worth what they could earn and women were only worth being homemakers. Laws are quick to be made but slow to be changed. Hoping your outcome was a positive one

I once got off a charge when a public defender had a got ya moment on the Chicago police. This was almost 20yrs ago, keep in mind NO ONE is the same person they were 20yrs ago, you just hope to be better. I'll start with a friend of mine that was killed infront of me when we were hanging out at a park playing Basketball when I was 20yrs old. It's a long horrible story on it's own but to keep it short, it left me traumatized with ZERO faith the police will keep me safe. Fast foward 2yrs and me and a friend are walking down the street near the neighborhood my late friend was killed, and im carrying my own gun. Of course I did have a permit, but I was set on not be victimized ever again. The Chicago police stopped us and immediately started frisking us even though we weren't causing problems or being loud or doing ANYTHING WRONG. However I knew I was busted anyway and didn't fight them or resist or try to run. Fast foward to my very first court date, and I'm infront of a public defender and he's asking me why I had the gun. I explained to him about my late friend and he just silently stared me in the eyes for a long moment. He then said ok, and walked away. Now im infront of the judge with the police officer that arrested me. It was a probable cause hearing (I don't know what they actually call it, but thats the best way to describe it) and the judge is going over the evidence with the PD and the cop. The cop wrote in his statement that he was sitting at a red light traveling north, as I was J walking going south and that's why he stopped me, and fun my gun. When it was my PD's turn to ask the cop about his evidence, it was glorious lol. He asked the cop, "so, if you were sitting at a red light traveling north, and he's traveling south...how could he be J walking when he had the walk signal? You violated his rights". The cop tried to say something about a call over a shooting that was literally over ten blocks away from where he saw me. Before the cop even stopped talking the judge said "no probable cause" and banged her gavel. The cop threw his hands in the air out of disbelief, but probable cause is a constitutional thing...sooo...lol. It happened so quickly, I had no idea what happened and thought I heard the judge wrong. So I asked the bailiff wtf just happened and he told me I beat the case. I let out a big "YEAH BOY!" And he quickly reminded me im not free until I'm processed out, and I stfu. Lol never been in trouble since dgaf if you dont believe me.

My apartments has attached garages on the opposite side of the building as our front door so in order to do anything with our vehicle we have to park in front of our single car garage because we have too much stuff and big dogs for our truck to fit inside the garage. I will park in front of it every now and then for an hour or 2, but because it's a fire lane my neighbors have called to have my truck towed 3 different times. Nobody comes and knocks on the door or tries to say anything and the first 2 times ok whatever yea I was parked out there a little long annoying but I get why they did it it's a fire lane and I was parked there for over an hour with my garage closed, but this last time it was only out there for 30 minutes with our garage open, but because it was only half way open they still towed it and it was only out there because I left to go to my doctors appointment but I had to get sick before I got out of the parking lot so I just parked in front of the garage so I could go get sick in the bathroom before I left. Was in the bathroom 30 minutes before I was ready to leave and truck is gone. We have always figured out how to come up with the money that day even though we are poor AF and can't even keep up with our bills but we have had to pay $561 every single time it's been towed even though it doesn't even sit in the lot for 24 hours. I hate people everyone is so fake.

Me not as a lawyer in small claims, I filed lawsuit against a guy who sold me a RV that was not suited for living. When I filed a lawsuit I turned in all my evidence made copies of evidence and mailed him the copy the moron, then proceeds to mail me the one piece of evidence I was missing the title, the guy thought he would send the title after the period in which the court would allow anybody to turn in evidence. The court date comes the judge says I’m only gonna reward you $300. I respectfully object I asked the judge can I turn in this title that was sent to me by the defendant the judge asks why I didn’t turn it in before I explain the con in which the defendant is trying to pull the judge then says OK Ivan look back at my complaint form in which the defendant submitted find in one of the paragraphs. The defendant says the title is clean. I pointed out to the judge. I said your honor if you would please look at page, blank sentence, blank. The defendant states, the title is clean, but according to state law a clean title, does not have the words salvage across it in red lettering, therefore the defendant perjured himself in front of this court. The judge immediately rewarded me $1800 plus court cost and as a FU to the defendant they put it on his credit for 12 years.

That won't stop them from doing a he-said-she-said. They just have to say he had his key. But if he wants, he can attach a strong magnet to his key and stick it to the underside of the car. What he could really do though is just record himself walking to his car explaining his intent and keep recording until he's inside the car.

Love to see landlords eat shit. My family went broke because our landlord sued us for "trashing the place..." and used it to buy the house a hot tub and repaint the entire thing. She evicted us to give the house to her daughter as a sweet sixteen. When my mom mentioned moving soon because we were struggling, she let us skip rent a couple times because "you're all just so sweet." Turned out, she wanted to make sure we didn't leave before she was ready to pull this stunt, and let us keep the house tidy until it was time.

I should just try to be a lawyer. . . Hold on worst place to go for future advice but which one would be a better job. Lawyer or Surgeon?

    • @cc_snipergirl
      @cc_snipergirl 8 месяцев назад

Depends on your personality. Both need extreme attention to detail and good information parsing. Also both come with wildly different specialties you can get into, like different parts of law or the body.
Lawyers do better if they have good people skills but can distance themselves from emotional situations. You cannot take anything personally. You need to be very quick-witted, well-spoken, and organized. You will be the master of paperwork and obtaining random obscure knowledge. Always learning. You'll be dealing with the public just like you do in a service industry job, except your job is to instruct them on legal matters. Also, you will be broke for a handful of years after graduating. Think Daredevil but without the superhero bits.
Surgeons work with their hands, but also need to be good at communicating as well as being level-headed. You need to be kind and compassionate, as you aren't only interacting with patients when they are on your table. You should have good hand-eye coordination, be adaptable, and have high stamina as things can change in an instant and surgeries can take a long time. Surgeons need to be good leaders to be able to lead everyone on their team. Pressure is very high, as is the risk of hurting someone or being sued. But it can be very rewarding as you help people heal.
