    • @rumblefish9
      @rumblefish9 3 месяца назад +101

      Not really. I don't think you understand why this was a massive mistake on his lawyer and a fundamental one. The text were sent to the opposing counsel during discovery. Firstly, his lawyers never did a search to look through all the text if they had mentions of Sandy Hook (and there were plenty). We're talking a simple keyword search and they didn't do that.
      And secondly, they entered it as evidence without a thorough search and did not object. If they had searched it and they found it, they would have objected and allowed to clawback the text as evidence. They did none of that. Legal Eagle does an in-depth explanation why this was a massive failure. His lawyers basically helped the opposing side prove his guilt while being completely oblivious to the fact.

    • @Allukoo

      @@bennetla10nope, that's not what happened. The defence lied and said these records didn't exist. Then they accidentally sent an email to the plaintiffs containing a link to ALL of their work on this case, which included this evidence that they had failed to turn over during discovery. The plaintiffs emailed them back to let them know what they had done, and at that point all Jones' lawyers had to do is reply and say "we didn't mean to send that to you, it was a mistake, and it's privileged" and that would have been the end of it. But they didn't do that, so after 12 days, the plaintiffs gained the right to use that evidence in the trial, and they used it to prove Jones had committed perjury.
      Again, Jones' lawyers did not do this on purpose, they lied, they f'd up, and they got caught. To call them incompetent is a massive understatement.

    Evidentiary disclosures are mandated by the court. If the text messages were not considered private/privileged, then his attorneys must share it. If it was a true “accident” and was privileged, the opposing attorney knew it was an “accident” that should not be shared, then he would have to return it and not be able to use it. If he truly used “accidentally disclosed privileged evidence” he would be disbarred. What he likely means is that he subpoena’d the text messages (makes sense since he said they’ve discussed it before and are likely not privileged here), and that his attorneys gave it without a fuss, which a moral attorney should and would do but a good attorney would’ve fought it and ultimately lost that evidentiary battle anyways. Notice, he said “didn’t you say you searched your phone and did not find anything mentioning Sandy hook”, well that can be true and it can also be true that there is messages mentioning Sandy hook. He did not perjure himself, not yet at least. This attorney also did not say whether they did in fact find text messages mentioning Sandy Hook. Without more info, this attorney appears to be fishing hoping Alex messes up on the stand, but he hasn’t… fair tactic though!
