This could be used very maliciously.... call the cops on a person that you know may have a few drinks after they get home from work, for example. As a minimum, they are out tens of thousands if somehow they can prove in court they were drinking after they got home. Also, the immediate suspension, and vehicle impound is on their record - even if found innocent. Worst case they are convicted.
