  • A Kentwood woman is facing charges for violating a man's civil rights, after she refused to allow his service dog to sit in the dining room at the Don Julios on 28th street.

    People leave their service dog at the door? Who the hell does she think she's kidding. There's a reason why people who have service dogs need their dogs by their side at ALL times.

      Me service dog keeps me upright and helps to keep me from tripping over stuff. Because of some issues I have my balance and sense of balance sucks and she helps me.

      kat bleu medical alert dogs that alert to syncopy (passing out) and seizures. Psychiatric service dogs like mine alert to anxiety extreme mood swings etc. Performs different forms of therapy. Mine also does mobility work picking up things I drop grabbing pain meds helping me keep my balance. There are autistic service dogs. Dogs who help people who are amputees. They help people in wheelchairs. People with life threatening allergies. Diabetes. I was going manic due to my borderline personality disorder and my dog alerted. I sat down he did deep pressure therapy and calmed me down bringing me from the edge of mania. I can go into a full blown rage depression panic attack in milliseconds for no reason. That's why I need him with me while I eat.

      kat bleu in most cases a service dog stays on the floor, eliminating problems with dander. They are also well groomed and properly fed, eliminating noxious smells. They are also chosen for temperament and very very well trained. If a dog is dirty, on the table, noisy, aggressive, mooching, begging for attention, or doing anything to bring attention to itself, it is not a service animal. Also, do not confuse it with an emotional support animal. Those are rarely trained if ever and are not covered under disability acts. Those can be legally removed from establiments.
      If you have sever allergies, you should carry treatments on yourself instead of demanding the world cater to you. Also, it should be perfectly fine to request new seating arrangemets for you if the dog makes you very uncomfortable.
      P.S. there are service horses too. Training grooming, and behavior are the same. Only small breeds are considered.
      P.S.S. I am researching a service dog for my autistic child. I am sure you would rather he had aid to avoid his melt downs rather than him start screaming at the table next to you.

      there is also PTSD and a dog helps those with PTSD to remain calm and avoid flashbacks that sometimes trigger violent behavior. also it is very easy to tell the difference between a properly trained service dog and a fake, as the real ones just lay on the floor and only pay attention to there handler.

    Ignorance to the law is not a valid defense. She has access to the laws and should have apologized. I completely support prosecution in a case where the business refuses to make reasonable accommodations or modifications.

      ADA is a well publicized law. I find it hard to believe she doesn't know about service animals because handicap accessibility is an important factor for a business. I tend to believe that she is afraid of dogs. She also thinks that because she was able to get other customers to leave their animals outside she was entitled to force it on everyone.

    I don't believe that she EVER had a service dog remain in the foyer while their handler went and ate a meal. My dog would NOT stand for that. While she is a very well behaved dog, she would lay down and stay where I put her for a few minutes, but if she had her vest on she would seek me out. So they would have to tie her down to keep her put, and she would put up a fuss if she was not being allowed to do her job. They would rather have my dog quietly laying under my table than a dog tugging at her leash whining and crying at the front entrance. Plus, can you IMAGINE the liability of having a dog, unattended, at the front entrance where customers are coming in? Kids are poking at it, trying to ride it, pulling at it's tail? The dog could bite someone, THEN what?

      Then the dog would be euthanized for biting someone which SUCKS. I bite someone, I get arrested. But if a dog bites someone, it's the death penalty.

    Those people who left the dogs upfront most likely had fake service dogs. Any real service dog would not be allowed to be so far from their owner.

    “Leave the dog outside”?!?!?????
    I live in constant 100+ degree weather. Even at 70 degrees, pavement reaches upwards of 200 degrees. If I left my dog outside for an hour to enjoy a meal I would be brought up on negligence and animal cruelty charges! My dog would literally roast! She would die! Not to mention the facts that A) I require my dog to be able to function in general, and B) if she was left outside just tied to a post so many other awful things could happen to her like passersby hitting her, other dogs attacking her without a way for her to escape, someone could steal her. And I would not know until after I came out. And if my dog did manage to survive she would be so traumatized by the experience that she would no longer be able to work, not to mention vet bills or the fact I still would get an animal cruelty charge. This is so stupid!

      alpha 1997 a business owner may only deny a service dog if the dog is misbehaved or poses a health or safety risk. The ADA specifically mentions restaurants in this area and states that the dog merely existing in areas where food is prepared or served is not a reasonable health or safety risk. A reasonable risk would be an off-lead dog running into the kitchen itself, or a dog that is lunging at people or growling or biting at people. But since normal customers are not allowed in the kitchen, that means service dog handlers are not either. We don’t get any special treatment, we are just entitled to existing with our medical equipment the same as anyone else. Legally, a service dog equates to a wheelchair or oxygen tank. You can’t deny a person using a wheelchair because they MIGHT run over somebody’s foot or someone else might be allergic to the metals used in the chair. You can’t deny a person using an oxygen tank because a gun MIGHT be fired at it and cause an explosion. Service dogs literally keep their handlers alive and safe just like other medical equipment. Just because someone MIGHT have an allergy or phobia is specifically legislated as a completely invalid reason to deny a team access. Reasonable accommodation must be afforded or the business owner will be charged with the proper level of punishment. It is not within a business’s right to have a legitimate service dog denied or removed. We may use something on a daily basis that you don’t, but that doesn’t make us any less human or give us any less of a right to exist.

    Its illegal to seperate a Service dog from their handler. Especially if the handler has some sort of disorder, like Epilepsy or Autism. I mean, if you seperated a Seizure Response Dog from its owner, and the owner had a massive Grand Mal in the restaurant.. Who's fault would that be?

      It's illegal to separate them no matter what their disability. No "especially" because to have a service dog you must have a disability that interferes with your life. You take a service dog no matter what task it's trained to do you're putting the handlers life at risk.
      Laylas law is in a few states now making it an arrest-able offense to even talk to a service dog. So taking the dog away would defiantly be illegal.

    Civil, what about criminal? It is the LAW to allow service animals into any establishment. So why aren't these individuals who are breaking the law, being criminally charged? I see this happen far too often. People should be held accountable for their actions. It is demeaning, insulting and a breach of disabled person's rights to be refused entry or service in any establishment.

      It was criminal... misdemeanor civil right violation... that is a criminal misdemeanor charge based upon civil rights law. "civil" is connected to "rigths" not that the act was a civil infraction, it was a criminal infraction of someone elses civil rights.

    Actually this DOES happen a lot. There are videos all over RUclips illustrating this, and these are just the incidents the public is made aware of which tells you there are WAY more that never get any press. Oh yeah, this happens A LOT...

    its a federal crime for public business to refuse someone who has a service dog. I have a service animal and if someone were to deny me access to a restaurant, store or hotel I would be mad too. its sad to hear this stuff because its injustice

      +Jamie Murphy (Aura Silvermist) On another video (with comments disabled) a person explained that (a) no vest or other visible ID on a service dog is required, and (b) all that is necessary is that the owner/handler say "this is a service animal" and no public access establishment can refuse entry. Is that true? Because there are enough jerks in the world that some would happily waltz into a grocery store or restaurant with their stinky hound in tow, claim it to be a service dog, and let it pee on the floor and bite a kid with impunity. That would do no one any good, especially service dog users.
      As someone who knows the regulations, can you tell us if that's really the law?

      +carmium the requirements for service animals has been turned upside down for years because people pose their pet as a "service" dog and its not behaved. in the US there is no registration for a service dog, it doesn't have to have a vest or ID card. for my service dog I have a vest and a ID card so I don't get harrassed by businesses and it avoids conflicts and law suits. there are assholes who fake their dog as a service animal wanting the same rights as a disabled person, but its not behaved. if it's peeing on floors, nipping at people, etc it's not a service dog. you can train your dog or get it trained by an organization that meets your disability. to sum it all up for you, its hard to say because its upside down.

    when word gets out to these business owners about service dogs and see this store and that woman is being prosecuted for violation of someone's rights Maybe they will learn more about the Disability Act and have more respect for service animals

    I want to thank you for standing up for the rights of people with disabilities and their service Animals. I would like to share my story, if you will allow. I purchased bulkhead window seating 3 months prior to what you see in the video. Please search Disabled Veteran and his service dog kicked off USAir and or Man removed off plane over service dog dispute. On the 4th and final trip home USAir gave my seat to another USAir employee and moved me to the location you see me. The floor was to small and the bars under the seat in front of Bear was absolutely dangerous. I was protecting my dog. USAir had me arrested. The Arizona Judge DISMISSED the charges, I committed no crime. Would you please Comment to me and share your thoughts' Thank You.

    I had the same thing happen at a dollar general store here in South Carolina. The manager even when given the ada business breif said I DONT CARE GET THAT DOG OUT OF HERE. I then walked out while my mother got all the info to report it to the home office. I was picked on by other customers who heard what happened. I called the home office and said if he makes an apology I'll be ok with it. They refused. So I reported it to the DOJ and hired an lawyer.

    According to the ADA it doesn't matter that you serve food:
    "Establishments that sell or prepare food must allow service animals in public areas even if state or local health codes prohibit animals on the premises."
    Also, being asked to leave the dog in the doorway is not ok:
    "People with disabilities who use service animals cannot be isolated from other patrons, treated less favorably than other patrons, or charged fees that are not charged to other patrons without animals. "

    *Update March 8th, 2012* " Kent County Prosecutor William Forsyth announced that Bucio’s case will be sent to the diversion program for first-time, non-violent offenders. If she lives up to the terms imposed by the program - including community service with the Grand Rapids Home for Veterans and Paws With A Cause, her charges will be dismissed and she will have no criminal record."

    Unbelievable the insane stuff that's been written here about Service Dogs! I survived spinal cord & traumatic brain injuries that left me partially paralyzed and severely physically disabled. My Service Dog, Thunder, was donated to me because I couldn't afford $65,000 to buy him. He is a large Standard Poodle(no shedding, little dander, least allergenic K-9). He mitigates my disabilities and makes it easier for me to live. If anyone wants to board a plane 1st all they need is a folding cane,

    Even if you leave a service dog by the door in a down/Stay some will walk off with it Was she going to replace it with a new service dog? She probably couldn't afford it Hope she learned her lesson on how to treat people with disabilities.

    I have a service dog, Nelson, 127lb Rott/Shepherd mix. trained by Kentucky dept of corrections, some one in Chilli's refuse me service, I stayed calm and told the manager, federal law allows this and protects me and the dog, call a cop, I'll leave I just want a police report, with your name on it, I plan on filing a Paupers claim and sue the owner of the restaurant. cops came made a report, I filed suit. I got a call from the owner, he asked if we can make this go away, I told him, talk to your manager, this Going to be a federal civil rights suit before i'm done, there is also the possibility of me working to close you down!!!!! how can we make it go away, I told him "FIRE" the manager, They did, I called the manager and told him, your about to be fired, needless to say he was very mad. that evening I went back, he was there, he wanted to fight, I warned him that to would end very badly for him, he swung, I had a witness filming the incident, I broke his arm, I have a black belt in Kung fu. he went to the hospital, Nelson and I drank beer and ate a hamburger, the police saw the film, talked to witnesses he swung first it was ruled self defense, damn fired and his ass kicked. and Nelson just cooled out on the floor. Stand up for your self!!!!!

    This was absolutely the correct course of action. This is an example to all people that violate this law. You can, and will, be held accountable by a court of law. This little girl clearly didn't think that she would ever be held accountable and now she is learning that she doesn't get to make the rules, she is required to follow them like everybody else.

    I wish this happened more often - I don't understand why law enforcement, security, first responders and business owners aren't required to have training on this topic. They all have to have CEUs to keep their jobs or license..it should be a no brainer imo.

    How could someone as non-compliant as the then ENTITLED 21 YEAR OLD rise up to be the “manager”? To add insult to ACTUAL injury, she didn’t even THANK HIM FOR HIS SERVICE! She needed more than just community service, like handcuffed to a chair watching artillery blowing up in her face!

    I have trained service dogs to either work with children with autism and veterans with PTSD- and this is one of the main problems we face; restaurants. I can understand why the lady said what she did, as it is part of the 'laws' restaurants have to follow that now to allow animals near food to avoid contamination. However, it is not like the dog will be where the food is being kept and cooked, so what she did is not right either.

    It doesnt matter how the manager feels.... Service Dogs have the SAME rights as the owner does. Problem is with so many foreigners owning businesses in the USA and not knowing or understanding our laws.... POINT BLANK..... if you cant understand our laws DONT open a business in our country

    But you're allowed to have service dogs in restaurants , the health department can't do anything about it to any food service shops, and even the hospital has to allow service dogs into the hospital, and inside of the patient hospital room aswell, and they will have someone take care of the bathroom breaks for the service dog aswell. People have to understand its a medical device, not emotional support animals, but service dogs are protected by federal and state laws. And anyone who assault service dogs or prevent them from doing their jobs can be charged criminal and civil lawsuits aswell

    The American with Disabilities Act clearly states that service animals are allowed in all places of businesses even if it conflicts with state health and safety laws. Meaning the federal law supersedes any state law prohibiting service animals, even in restaurants. Good for the District Attorney for following through, but the owners and employee of the restaurant will still be held to account for violation of the man's civil rights.

    Isn't the majority of the food they serve made up of animals? Seriously though, it amazes me that anyone would even desire to confront anyone with a service animal. Who in the USA is not aware of the Federal Law? It is posted for anyone who can read on 90% of public buildings for heavens sake.

      +avaorchid Their used to be a Federal Law that allowed slavery. By your standards everyone who refused to own a slave should have been charged with a Federal crime. You must be a liberal. If a person wants to eat with animals why not just open their own Dog Pound Cafe. Just think, fleas, ticks, hookworms, heart worms, the smell of feces and urine. I don't think it would catch on with most people though. It amazes me that you didn't know that state health departments don't think that animals in public restaurants is sanitary or healthy. They are charged with protecting public health not catering to some special interest groups. Why are you not bothered by animals being used slaves to "service" humans? Talk about a sick puppy.

      +456swagger Why are you just making stuff up? It seem that you do not even know what service dogs REALLY are.
      I would rather have a nice, well trained service doge near me, than many of the human children (who can come in very dirty), or some of the adults who come in and smell (and don't seem to care about it). THEY make dining unpleasant.

      Wrong! I live in the U.S.. That woman in question was arrested based on comments that she made in an interview. The wienie prosecutor admitted it to the press. She followed the law that regulates establishments that serve food to the public. If the offended person thought that they had been wronged why didn't he seek relief through the court system as provided for in the law and a judge could settle the matter very quickly. But no the prosecutor ignored the law and used his power to be cop, judge and jury. He should be striped of his qualified immunity and jailed in the same manner as Michael B. Nifong. Turning a possible civil suit into a criminal prosecution out of sheer petulance

      456swagger n Friday, deputies announced they had arrested a 21-year-old Kentwood woman on charges of "refusing accommodations to persons with disabilities lead by dogs." If found guilty of the misdemeanor, the woman could face up to 90-days in jail.

    Carry the business card with the short version. Plus I keep a copy of the DOJ/ADA law with the letterhead on it both in my car and in my Service Animals pouch. Do NOT carry a copy from a service animal site!!! Also make sure to get the 2010 updated version.

    I have never asked for any "preferred service" for me and my SD, but we often receive it. I guess the goodness comes out when they see a disabled Veteran that needs a SD plus all the Meds to make it out into public.

    I used to work in a restaurant so I understand that you're worried about food but you still can't deny a service animal entry into a restaurant because their handlers are very dependent on them to alert to life threatening issues.

    Um, ADA does, in fact, "outrank" local health codes. "Establishments that sell or prepare food must allow service animals in public areas even if state or local health codes prohibit animals on the premises." Your average pet owner sheds more fur and dander off of their clothing than a well groomed service animal sheds. Your personal preference doesn't matter, this is the law.

    "That is what I am there for." Not everyone who owns a service dog has someone like you. Most of us need our service dogs with us where ever we go so saying you see no point in animals being in restaurants is completely contrary to saying, "I see why some see fit to take their animal." Either it's pointless or it's simply something you choose not to do but certainly NECESSARY for many of us.

    Unfortunately, there are a lot of people who either do not know the law when it comes to assistance animals or who have chosen to discriminate against those with disabilities that require an assistance animal. Imagine a disabled American veteran walking into an establishment and being forced to leave because an employee does not like dogs or does not like veterans. This should serve as a lesson to employers- make sure your employees know the law and do not discriminate.

    I agree Service dog or not, I have a problem with seeing one inside of a restaurant or any other place that serves food. It's a fine line there because it has to be a health code violation as well, which is also against the law.

      Service dogs are exempt from health codes (to an extent). Thet are allowed anywhere that the general public is allowed, under the ADA.

    remarkable how many dumb people are out there
    if you are afraid of a little animal dander then stay home and eat
    people don't want to be around YOU it isn't the dog that turns them off
    these dogs are well behaved and wouldn't be getting all over to cause a problem with sanitary concerns. Clear stupidity in these cases.

    Someone answer this for me. What would happen if a business owner was severely allergic to dogs and simply could not be around dogs, therefore they can not have them inside their establishment? Do private business owners have any rights left???

      It doesn't matter if someone is allergic. They simply have to make sure the dog stays away from them. Service dogs are groomed very well and are pest (such as fleas) free. Just because someone is allergic does not give them legal right to deny entrance of the service animal. By Federal Law all service animals are allowed wherever the public is allowed. The only exemption to this are churches because they do not necessarily service the public on a regular basis and sterilized areas of the hospital like a surgical room unless the dog could be used to alert a medical problem with the owner during surgery.

      Jason A. The same thing it came to when the mentally ill stopped being kept in attics, along with people who suffered from handicaps and deformities. The nation is coming to tolerance, and it's sad that people like you find that sad.
      To someone who has a service dog, being denied entry to public locations is the same as a prison sentence in their own home. Private business owners DO have rights. They have the right to NOT own a host-type business (such as restaurants and hotels), and to work from home or even to be out of work altogether as many people in this nation currently are. They have the right to have non-allergic staff members take care of the customers in their stead.
      They also have the right to allergy medication.

      They shouldn't have to do that inside their own place of business should they choose not to. What ever happened to freedom? What if that business owner can't afford staff members? Obamacare anyone? The ADA is unfair to business owners and should be repealed, but that will never happen. There has to be some avenue for a private business owner to fight this oppressive set of government regulations. What happenned to life, Liberty, and the Pursuit of Happiness for all?

    i have a border collie who works as a therapy dog with children who are terminally ill . he goes into hospitals and hospices . he is better behaved . cleaner and intelligent than most of these people. he does more to help people than these idiots in their entire lives . just pathetic .

    James you are so right.Both my parents and grandparents on both sides and several other family members have it.I developed type 2 diabetes at age 50.My dad was a skinny lean man who developed type 2 at age 60.I am now trying get my weight under control and exercising more eating right,but the doctor says not to be surprised even if I lose the weight that I still might be type 2.My mom was type 1.It just means you have the higher risks with known family history of diabetes.

    Handicap parking, boarding early, electric wheelchairs are not privileges that the disable want, they are necessities for us to have mobility and a reason way to try and live our lives normally. Keep in mind, anyone can go from being an Able Bodied Person (ABP) to a Person With Disabilities(PWD) in a nano-second, it happened to me, it can happen to you. So the next time you see a PWD using a cane, service dog or wheelchair, think there but for the grace of god goes you! My SD makes my life whole

    If she isn't allowed to make people leave wheelchairs, crutches or other adaptive equipment at the front desk, she is certainly not allowed to make them leave their service animals.

    Good for th DA. Service dogs are just that. For Service. There are laws & people just need to be educated. I recently saw a rather young woman in my local grocery store with service dog. Nobody stopped her or asked for proof.
