On Sept. 22, 2023, Watts, at 22 weeks into her pregnancy, told Warren Police detective Nick Carney that she, “felt the baby come out and there was a big splash,” while using the restroom that morning. Warren Assistant Prosecutor Lewis Guarnieri said the police investigation found that Watts miscarried the baby while using the restroom and tried to plunge and flush the remains down the toilet, where it got stuck in the pipes. Hours after being admitted to the hospital, Warren police removed the toilet from Watts’ home and took it to the Trumbull County Coroner’s Office, who then had to chisel away at the pipes to remove the fetal remains, according to Guarnieri.
During an early November court hearing, the court heard from forensic pathologist Dr. George Sterbenz, whose testimony concluded that Watts’ water had broken early and the fetus was “nonviable,” because the baby was too young to be delivered. Sterbenz testified that no injuries had been committed to the fetus, further stating that the fetus had died naturally before passing through the birth canal.
At 21 weeks, Watts’ attorney, Traci Timko, said her client went to her physician who told Watts that her pregnancy, “could not survive, and she would miscarry,” which she wrote on the GoFundMe page. “When the bleeding and the pain from the impending miscarriage got severe, she did the same thing that many women who miscarry at home do. Brittany went into her bathroom, miscarried into her toilet and flushed.”
A nurse from St. Joseph Warren Hospital called 911 after Watts came there suffering “life-threatening hemorrhaging,” later leading to police investigating and charging Watts, who had no previous criminal history, with a felony offense. Guarnieri argued in favor of having the case move forward in court, saying that the state did not have to prove fetal viability, citing a portion of Ohio Revised Code that reads, “no person, except as authorized by law, shall treat a human corpse in a way that would outrage reasonable community sensibilities.”
Warren Municipal Court Judge Terry Ivanchak agreed, determining there was probable cause for the case to be bound over to the grand jury. The judge stated during the hearing, “There are better scholars than I am to determine the exact legal status of this fetus, corpse, body, birthing tissue, whatever it is.” Timko previously said that no law requires a mother suffering from a miscarriage of a nonviable fetus to bury or cremate the remains.
“Women miscarry into toilets everyday. If the state of Ohio expects these women to fish those remains from the toilet and deliver them to a hospital, funeral home or crematorium, the laws need changed,” Timko said, adding that “we aren’t there yet.” She further stated, “Regardless of politics or religion, this matter hinges on the law. It is a travesty that Brittany (Watts) was charged and we will continue to fight.” Her client’s fate now rests in the hands of a grand jury that will determine whether to indict Watts on felony charges, which would take case to the next step of being presented to a Trumbull County Common Pleas court judge.
Over the past few months, Watts has seen one of most private, intimate moments of her life become the center of a national debate over the criminalization of pregnancy, but also has been met with thousands of people showing support. “The outpouring of love and support has been humbling, healing and empowering. Thank you to each and every person that reached out. There are no words to convey my gratitude or express how much it means to me,” Watts said.
The story reached the eyes of civil rights attorney Ben Crump, who retweeted Watts’ story to his more than 600,000 followers on the social media platform X and it received more than 40 millions views, with people voicing their outrage. Many women also shared similar stories of having miscarried into a toilet, wondering out loud on the social media platform whether they too could’ve been prosecuted for their miscarriage. “The global response to Brittany’s situation has been extraordinary, marked by an overwhelming influx of emails from women who have experienced similar circumstances. These women, who have endured the heartache of miscarriages leading to outcomes akin to Brittany’s, have found a resonance in her story,” Timko said.
Watts’ attorney shared some of the stories from women who have identified with Watts. A New York woman told Timko via text message that at 12 weeks, she had gone to a Syracuse hospital with her miscarried baby wrapped in toilet paper. When a nurse refused to handle the remains, the woman said she also tried flushing them down the toilet, an experience she told Timko has left her suffering from PTSD.
In another text message, a Warren County woman told the attorney that in 2021, she miscarried at between 12 and 14 weeks. Having bled out over a toilet, she felt her baby pass through and grieved it, she told the attorney, “I had no idea how to proceed and proceeded with disposal through the toilet and then was rushed to the hospital for an emergency D&C to stem the bleeding,” she wrote.
“The establishment of a GoFundMe campaign will enable Brittany to leverage her story as a powerful tool for advocacy. This initiative aims to foster legal reforms and enhance educational efforts, with the ultimate goal of ensuring that women in the future are spared from enduring similar experiences,” Timko said.

As a mother of 4, I personally could never terminate a pregnancy. I was told to with my first child by a doctor when I was pregnant with her because she was diagnosed with hypoplastic left heart syndrome. Grateful to say she’s 18 years old today. HOWEVER- I would never ever ever ever ever ever EVER judge a person in this woman’s position!!! How dare they block her!!! The layers of TRAUMA are horrifying to think about! Heartbreaking!

The case of Kate Cox is EXACTLY what we were concerned about when this law in Texas (and other states) passed. And what did the pro-lifers say to us then. They said “miscarriage care is not the same as abortion. No one will be denied life saving care.. they are the exceptions.” Then explain why women are suing in Texas and need to go before a judge to get life saving medical care for their pregnancies..?
And then a politician files an appeal with the state supreme court to overturn a lower court's decision granting life-saving medical care.

My story. I’m a former CCU nurse . Before I discovered I was pregnant I discovered I had cardiac problems . Both my OB (a missionary) and my cardiac doctors strongly suggested to abort. My baby was safe. I was told I could deliver, but I would probably die soon afterwards and leave my newborn and other 2 boys without a mother. Obviously I survived, but now dealing with major cardiac problems. I strongly believe I had the right along with my doctors to make an informed decision. Medicine isn’t 100% accurate, but usually 95% accurate

I’m Canadian and in the 70s the Liberal government legalized all abortion but made a very clear point to legalize it as a HEALTH procedure not as a moral question that needed to be answered. And that’s why the anti-choice parties here have continually failed to repeal or adjust the law.

There is somenting called the "act of double effect". It means that because of the care, lets say she has cancer and she gets quimio, and because of the quimio she has a miscarriage, she did not had an abortion, the baby died because of an unwanted consequence of the quimio.
But you can´t do directly an abortion, even to save a life.

The Catholic Church doesn´t authorize any act that has the direct consequence of the abortion of the baby.
The reason is those people believe it’s murder. If you want to be pro life and not allow abortion, you need proper policy showing the life of the mother is safeguarded, which this Texas case is proving it clearly isnt

They also believe that if she endangers her life by following the Texas Supreme Court's orders to not terminate the pregnancy then it's "God's will".
The term is literally only used when it comes to abortions, not school shootings or war crimes or the death penalty.

Do you know how many times doctors get it wrong? There are so many stories of women who were told by their doctor that their baby wouldn't make it, or had birth defects, etc. And then they were born perfectly healthy. This has happened to me.

For a country that only has 6 weeks of after delivery care for the mother - you should really look in the mirror. Most DECENT countries have 6 months to a year NOT 6 weeks. BUT yet you have lots to say about whether a woman can have a baby or not. Take care of the children that are alive and being shot in schools before you have an opinion on a woman who's baby will not survive - she may not and if she does she may not be able to conceive again. The ruling calls into question whether the decision could deter women in similar situations from seeking a court-authorized abortion. Cox’s lawsuit is believed to be one of the first attempts in the country by a person seeking a court-ordered abortion since the Supreme Court overturned Roe v. Wade last year, according to the New York Times.
While the center did not disclose more details of Cox’s plans, she had received “offers to help her access abortion elsewhere, from Kansas to Colorado to Canada,” its statement said.
On Thursday, a state district court judge sided with Cox and granted a temporary restraining order against the state so she could legally have an abortion under the state’s “medical emergency” exception. Texas has a near-complete abortion ban with narrow exceptions.
Texas Attorney General Ken Paxton, a Republican, quickly threatened criminal prosecution against doctors or hospitals who would help facilitate the abortion, saying they could face charges even after the 14-day temporary restraining order. CNN has reached out to Paxton’s office for comment.
Late Friday night, the state’s high court temporarily blocked Cox from obtaining an abortion while it reviewed the case.
In its ruling late Monday, the Texas Supreme Court - comprised of nine Republicans - called on the state’s medical board to provide more guidance on the “medical emergency” exception at the heart of Cox’s case.
The same legal group representing Cox - the Center for Reproductive Rights - is also representing a group of women and physicians before the Texas Supreme Court in the lawsuit seeking clarity. The state argues the law is adequate.
Cox has been to the emergency room four times in the last month due to symptoms like severe cramping, diarrhea, leaking of fluid and elevated vital signs, her attorney said. And because she’s already delivered two children via C-section, her physicians have warned she is at high risk for complications, including possible uterine rupture in future pregnancies.
This pregnancy would need to be delivered via another C-section, which Cox fears could jeopardize her health and future fertility, her attorneys said.
Additionally, the fetus has trisomy 18, a fatal genetic condition sometimes called Edwards syndrome that can cause heart defects and other organ abnormalities. In at least 95% of cases, the fetus doesn’t survive full-term and the pregnancy ends in miscarriage or stillbirth, according to the Cleveland Clinic.
As his office has done in the broader case on this issue before the state Supreme Court, Paxton’s attorneys also argued “a fatal fetal condition does not meet the medical exception,” adding the exception applies only to the mother’s condition.
Paxton’s office also said none of the physicians who have treated Cox in the Dallas-Fort Worth area have recommended an abortion.
Dr. Damla Karsan, a Houston-based physician - and a plaintiff in the other case - is cited in legal filings as having reviewed Cox’s medical records, recommended the abortion and agreed to provide the medical care.
