Even in no fault states, proof can often sway the judge on the exact split of assets where they have discretion. If she had stopped everything and apologized, he may have been willing to forgive. If not, he needed that proof. Cheates will lie and conduct a smear campaign when you call them out.
No point in taking back a cheating spouse. The rate of recidivism is high especially if the “first love” is still around or not married and there is no definite commitment of the mind, will and emotion to truncate the relationship with the “first love.”
