  • New York's highest court on Thursday overturned the 2020 conviction of disgraced Hollywood producer Harvey Weinstein on sex crimes charges. The Court of Appeals ruled that the trial judge erred in admitting testimony from women who were not named in the accusations against Weinstein and ordered a new trial.
However, the ruling doesn't affect a separate 16-year rape conviction handed down in California in 2022, meaning the once untouchable Hollywood heavyweight will remain behind bars.
Bombshell allegations against the Oscar-winning producer emerged in 2017, sparking the #MeToo movement, which paved the way for women to fight back against sexual violence in the workplace.

Hearsay and guilt by accusation cannot be used to convict in a criminal trial. This is fundamental law. Don't get me wrong HW is a creep and probably guilty but the judge screwed up.

The money has to go through many secure channels before it reaches the judges. It takes time. Almost EVERY conviction can be overturned on a technicality of some kind. The vast majority of us have neither the money nor the connections to fix the results.

The judges are doing thier work. He will be convicted but according to the law. It’s not about how it looks, or feels, is a technical result. It’s sad and hard for the victims because they have to testify and be cross examined again, but that is the fault of the initial judge that allowed crao just to look supportive and partial to the women.

What is the definition of a fair trail? Does everyone who is rich and looses gets a new trail? Or was the assumption of innocence until proven guilty? Maybe it is time to a real reform of our justice system. Still no evidence of what constitutes an unfair trail?

I think what the court was looking at in reality is if NY would have had the victims from his California case testify in the NY case, that would have been ok. I do not think this is against women like people are trying to make it out to be. What the ruling says is. Unless the person testifying either has a case ruled in court and won they cannot testify against the defense. This has a wide range of implications. It stops prosecutors from going out and picking random people to testify against a defendant.

what a sick justice system to destroy a man because of eye witness, or some people waking up YEARS after the "deed". If there was something real those women should have complained immediately after the deed. Instead, they took the money, the jobs and accepted the situation . years later they got a better social position, security and change their mind. Tell me how one differentiate the real case and this situation? You cant, the only conclusive argument would be if the women don't complain immediately. Sorry for real cases of abuse, dear women.

Okay I'm sorry but "Sexual abuse survivor"? Isn't that a little over-dramatic? I'm not trying to downplay the horror of sexual abuse here, but its hardly lethal... If it was robbers wouldn't need guns, they'd just pull their pants down at the bank.
