The reason why the legal system gives advantages to mothers is to create a support structure when a "traditional marriage" ends. Women are still assigned the role of caretaker for the children because there is a delusion in society that the man works and the woman stays home. When the marriage dissolves, the caretaker of the children (which is the woman, especially in the manosphere culture) will need financial support in raising the children. Since the government doesn't want the tax payers to fit the bill, the financial responsibility is placed on the father. You won't convince a change in legislation because it would require people to drop their antiquated gender roles. Otherwise, fathers should stay home with the kids and demand the wife work.
